The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and oroDerty resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all ac~s or omissions of applicant, his agent and employees. The applicant and the owner and 'occupants of the premises upon which the c aerations authorized by mis permit are being conducted, do, by the acceptance of this permit, give consent ~o the T?wn, a. nd its officers aha employees to enter upon the premises where such operauons are uemg conauctea to make such inspections as the Town may deem qecessary to insure that such operations are being con- ducted in conformity with this permit. Cause saltwater intrusion into the fresh water resources of the town. D, Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the ~own. Go Change the course of any channel or the natural movement or flow of any waters. H. That the Trustee Pemmit most be prominently displayed on the premises effecte~ thereby during the period of ~Drk under the pemmit. I. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper- ation performed pursuant to this permit, and the said Permitter will, at his or he~ own expense, defend any and all such suits initiated by third parties, and the said Permitter assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit is valid for a period of' 12 mos. which is considered to be the estimated time required to complete the work involved, but should cixo,m~tanCes warrant, request for an extension may be made to the Board at a later date. 5. That this Permit should be retained indefinitely, or as long as the said Permktee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that auth- orization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or -~its agents, and non-compliance with the provisioas of the originating application, may be ,'a,,~:e for revocation' of this Permit' by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of 'the work herein authorized. 6. New York 11971 February 25, 1988 Edward & Regina Nordstrom F(R 1 Laurel Hollo;v Wading River, New York 11792 Re: Apphcation No. 598 Dear Mr. & Mrs. Nordstrom: The following action was taken by the Board of Town Trustees during their regular meeting held on February 24, 1988 regarding the above application: WHEREAS, Edward and Regina Nordstrom applied to the Southold Town Trustees fora permit under the provzsions of the Wetland Ordinance of the Town of Southold, application dated November 24, 1987, and WHEREAS said appligation was referred to the Southold Town Conservation Advisory Council for fheir findings and recommendations, and it is noted that they recommended approval, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on February 24, 1988 at which time all interested persons were gzven an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this aptblication, and WHEREAS, the Board has determined that the project as proposed wilt not affect the health, safety and generM welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Edward & Regina Nordstrom BE AND HEREBY ARE GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETI~AND ORDINANCE OF THE TOWN OF SOUTHOLD TO: construct a 3' x 49' catwalk, 3' x 16' ramp and a 6' x 18' float with 12 pilings.. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insumance policies 'insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies s~ll name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project; Please return to the Building Dept. for a determination on the need of any other town permits that may be required for this project. Group Inspections were scheduled for 3:00 P.M. on Thursday, January 21, 1988. Members will meet at the Southold Town Hall. ANNOUNCEMENTS Monday, December 21, 1987 a meeting regarding Freshwater Wetlands is scheduled to be held at 7:00 P.M. at the Southold Town Hall. Margaret Feeney will attend. Chairman John Holzapfel announced that the Council on Environ- mental Quality (CEQ), which is the Suffolk County Conservation Advisory Group, meets once a month at the H. Lee Dennison Bldg. The Southold Town CAC is mnvited and has a vote on items pertaining To Southold.
