EASEMENT AGREEMENT

A.
TA. MORTON(hereinafter referred to as"Morton"),with an address of/P.O. Box 134,Orient,New
York, and ANDREAS LAZAR AND ELANNA LAZAR, (hereinafter referred to as "Lazar"),with
an address of 850 Park Avenue, Apt 11 D,New York,NY 10075.
The parties recite and declare as follows:
A. The parties have a fee interest in adjoining real property situated in the Town of Southold,
County of Suffolk and State of New York designated respectively on the Suffolk County Tax
Map as 1000-025.00-04.00-011.009 (Morton) and 1000-025.00-04.00-011.007 (Lazar).
B. The parties have agreed to create an easement benefitting and providing access to the Lazar
parcel from Orchard Street and crossing over the Morton parcel.
In consideration of the above recitals and the terms and the covenants of this Agreement,the
parties agree as follows:
I. An easement for ingress and egress for vehicle and foot traffic in favor of the parcel owned
by Lazar is hereby created and granted over a strip of land on the Morton parcel which
easement provides an additional uniform width of 6 feet from the Orchard Street entrance
contiguous to the driveway extending to the transformer box to the West of the property line
of house being purchased by the Lazars.
2. Notwithstanding the foregoing, Morton shall have the right to use the entrance driveway
and the easement to access the farm parcel.
3. The easement created by this Agreement is a covenant that shall run with the land and be

binding on the heirs, distributees, legal representatives, successors and permitted assigns
of the respective parties.

BEGINNING at a point on the southerly side of Orchard Street where the same is intersected by

Morton" and filed in the Office of the Clerk of the County of Suffolk on November 25, 2003 as
Map Number 11030, said point being distant 424.60 feet easterly as measured along the
southerly side of Orchard Street from the corner formed by the intersection of the southerly side
of Orchard Street with the easterly side of Navy Street (Orient Street);
