PHILIP VAN BOURGONDIEN and KATHRYN 10 VAN BOURGONDIEN, his wife, beth residing at 1285 J� Calves Neck Road, Southold, New York. l X party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, Countv of Suffolk and State of New York, being bounded and described as follows : BEGINNING at a point on the northeasterly side of Calves Neck Road, distant 1459 feet more or less southeasterly, as measured along the same, from the corner formed by the intersection of the southeasterly side of Yangs Avenue with the northeasterly side of Calves Neck Road, running thence along the southeasterly side of land now or formerly of Philip Betz, North 38 degrees 36 minutes 10 seconds East 190.80 feet to the southwesterly side of Town Creek; thence southeasterly along the southwesterly side of Town Creek on a Tie Line having a course of South 56 degrees 09 minutes 00 seconds East a distant of 152.48 feet to the northwesterly side of land now or formerly of Reider Carstensen; thence along said land South 45 degrees 47 minutes 30 seconds West 214. 44 feet to the northeasterly side of Calves Neck Road, and thence along the north- easterly sib of Calves Neck Road North 47 degrees 08 minutes 10 second; West 125.47 feet to the point or place of BEGINNING. The premises herein are the same that were conveyed to the grantor on October 1, 1975. The premises herein are conveyed subject to an existing first mortgage held by the Federal Land Bank of Springfield in the principal reduced amount of $ 78, 680. 00 This conveyance is done in the normal course of the grantors business herein. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part; the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
