The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence'operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and -employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. PROJECT DESCRIPTION: At rear of garage, place 42' of 10-!00 lb. stone rip-rap in front of existing broken concrete to reinforce. Replace within (18") 95' of timber bu]3dhead and backfill with 7 cd yds. of sand and loam on s/s of inner basin. Replace (flush against) 43' of timber bulkhead and backfill with 4+ cu. yds. of sand/loam. Remove an existing 50+x10' double sheathed solid fill walk and replace it with open-work walk on pilings. R~ove and replace outer basin and build a new bulkhead 45+' long 5+' landward of old. Remove 5' of intervening soil to depth 4' below MLW. Dredge outer basin of approx. dimensions 55' x 50' (prop,) plus 10'x50' at entrance to basin to 4' below MLW. Approx. 285 cd. yds. of spoil will partially be-used as backfill (if appropriate) or removed to suitable upland site (Town Landfill). Install a 4' x 12' b_inged ramp and (2) 6' x 16' floats secured by (2) 8" diam. x 20 pilings in dredged outer basin. Note: Owner requests permission to install "rip-rap along 95' of deteriorated bulkhead at s/w end of inner basin instead of replacement bulkhead at his discretion. Final decision to be reade at time of construction, with the provision that the floating dock and-ramp and float assembl~ that abuts the creek, is removed, and the Revocation of mooring permit 1883 moozing 620 in James Greek, Mattituck. and provided that only 200 cu. yds. of dredging is to be taken from the private boat basin, no dredging is to be dene in James Creek. Spoil to be trucked to the Town Landfill. Moved by Trustee Krupski. seconded by Trustee Larsen WHEREAS, John J. Newman applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated November 25, 1985, and. WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 23, 1986 at which time all interested persons were given an opportunity to be heard, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and, WHEREAS, the Board considered all testimony and documentation submitted concernlng this application; and it is noted for the record that testimony was taken during the public hearing and is under separate cover; and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED, that John J. Newraan be granted permission under the provisions of the Wetland Ordinance of the Town of Southold, New York all an accordance with the application submitted. Cooper, CAC Secretary At the regular meeting of the CAC the following recommendations were made: Wetland Application No. 319, Ted Dowd - The Council will continue to Table this application until they can speak with Mr. Dowd. Wetland Application No. 333, Dr. Vincent Claps - Tabled, the Council wishes further information before making a recommend- ation. Wetland Application No. 334, John Xikis - Disapprove, the CouncS1 feels the present wal] is servmng its purpose, there is no need for bulkheading. Also of concern is the severe impact on the downdrift neighbors of the proposed groin. In additionj creation of additional land vo an existing beach is contrary to the existing wetlands ordinance. In conclusion, the applicant should leave AS IS, the stones and screens appear quite secure. The cove is sheltered from the northwest. Wetland Application No. 337, Joseph Schoenstein - Disapprove, The Council sites four reasons for its recommendation. They are as follows: 1) Creek ms about to be d~signated as a significant habitat. It is critical to vast freshwater wetlands and uplands as far north as Moores Woods. 2) The setback is not observed with care on the present lot. Rubble fronting on creek and banks are already a hazard. 3) The building can be sited perpendicular to current plan. 4) Town ordinances are already in question due to expansion of facilities and previous variances. Wetland Application No. 338, Albert J. Breneisen Disapprove. The Council recommends disapproval because the pool,~is within the 75' setback requirement. The bulkhead represents a severe alteration of the shoreline contour. Withou~ the pool the retaining wall has no function. The Council suggests an alternative by placing the poo~ on ~he north side of the house. Page 2 We~/a~d Application No, 335 John Newman - Table. If ZBA does approve, then questions will be asked re: Cesspool capacity increase and loading re: Pilings If ZBA does no~ approve, then it is not clear if pilings are necessary. Cooper - Secretary Also present were: Mr. Bergman Henry Smith DISCUSSIONS: Mr. Bergman (Planning Board referral - Proposed Subdivision) appeared before the Council ro explain the exacE location of the proposed house in relation to the slope and marsh area. At the Council's requesv, Henry Smith was in aErendance to answer the ques~mons raised a~ the previous meeting regarding his Wetland Application No. 313. Regarding the amoun~ of dredging 5o take place, Mr Smith informed the Council that the application had been amended from the ormginal 1000 c.y. of dredging ~o 96 c.y. When questioned about the placemen~ of dredge spoils, he explained the dredge spoils would be loaded on a barge and unloaded ar Goldsmith's, then trucked away. '~ The Council also wished ~o know if there had been any dredging done in the same area in the historic pasE. According ~o Mr. Smith, the Counvy had dredged in the area up ~o the park aE the end of Youngs Avenue. REPORTS: Heather Cusack, the Council's STOP represenEative reported the program for 1986 would beg~n organizing in February and sEar~ getting information ou~ ~o the public with special aEtention being g~ven ~o businesses. Ms. C~sack-also repor~ed-~n a reques~ received from Councilman Paul.Stoutenburgh. Councilman Stoutenburgh~wou~d like the CAC zo Page~2 make up a map showing all the places in the area with drainage pipes going into creeks. It would help pinpoint sensitive areas. The Council felt that it was a worthwhile project. Council Chairman Martin Garrell will contact Paul Stoutenburgh zo set up organizing and financing the project. The members of the Council thought it would be best to hire someone, possibly a college student, to do the actual leg work. Chairman Martin Garrell reported that he is planning a joint meeting for a Saturday, sometime mn January of February, between the Southold, East Hampvon, Southampton, and possibly Riverhead CACs and Conservation Boards. RECOMMENDATIONS: On a motion made by John Tuthill, seconded by Ralph Condit it was RESOLVED zo recommend zo the Southold Town Planning Board approval of the Proposed S~Udivision of Martin and ~arbara Bergman. The Council approves with the stipulation that care be used during excavation and that the natural vegetation be kept as a buffer between the house and marsh area ~o avoid run-off. On a motion made by John Holzapfel, seconded by John Tuthill it was RESOLVED zo recommend ~o the Southold Town Truszees approval of the Wetland Application No. 310 submitted by Eh-Consultants, Inc. on behalf of Neil Simon. Applicant wished zo conszruc~ a variable width timber walkway for house now under construction zo buIkhead (.approx- imately 40') where it will be continous with. a 4' wide x 20' long fixed elevated (min. 3.5' above grade of marsh) walk, 4' x 14' hinged ramp. ~nd 6' x 16' floaf secured by two 8" diameter pilings.
