SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru 25, and the Suffolk County Department of Planning issued its reply dated November 28, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated January 22, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with the LWRP policy standards and; therefore, is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a 12.03 acre (524,063 sq. ft.) parcel located on the northerly side of Sound View Avenue in Peconic. The northerly line (Adj. to the Long Island Sound) measures 367.93 feet, the easterly side measures 1,350.04 feet, the southerly side measures 252.59 feet and the westerly side measures 1,456.49 feet with shared stone driveway. The property has a two story single family dwelling with attached garage and an accessory in-ground swimming pool in the side yard. Deer fencing in the front, rear and side yards as shown on site plan prepared by Tom Samuels, R.A. dated October 4, 2017. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-13C; Article XXII, Section 280- 105C; and the Building Inspector's October 12, 2017,Notice of Disapproval based on an application for a building permit to construct an accessory building and to legalize an "as built" six feet high deer fence in the front yard, at; 1) the proposed accessory structure (private residential fitness building with basement) is not a permitted use, 2) fence more than the code permitted maximum four (4) feet in height when located in the front yard; located at: 3945 Soundview Avenue, (Adj. to the Long Island Sound)Peconic,NY. Page 2,March 1,2018 #7132,Mendez/Henshaw SCTM No. 1000-68-1-15.1 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 1, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of,the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: AREA VARIANCE RELIEF REQUESTED, DEER FENCING: The applicant requests a variance to legalize an "as built" 6 foot high deer fence in the front yard, while the code only permits a maximum 4 foot high fence in the front yard. 1. Town Law&267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel is more than 12 acres and the dwelling is accessed by a private Right of Way that serves one other residence. The as built deer fence is set back more than 450 feet from a public road,which is far greater than the code required setback for a principal dwelling. It is further hidden from street view by dense woodland. The fencing protects the garden and planting surrounding the house and is hidden in hedgerow along the R.O.W. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The code does not permit fencing in a front yard that is higher than four feet; the as built deer fencing in the front yard is 6 feet in height. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100 % relief from the code. However, since the "as built" deer fence is set back 450 feet from the public road, it can be considered less substantial on this 12 plus acre parcel because it more than meets the code required front yard setback of a principal dwelling, and is not visible from the road or from surrounding properties. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an.adverse impact on the physical or environmental conditions in the neighborhood. The six foot non permitted deer fence will not be visible from the road or surrounding areas. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a 6 feet high deer fence in the front yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. DETERMINATION TO OVERTURN THE NOTICE OF DISAPROVAL FOR THE PROPOSED SQUASH COURT IN AN ACCESSORY STRUCTURE BASIS OF APPLICATION: the Building Inspector's October 12, 2017, Notice of Disapproval based on an application for a building permit to construct an accessory building (private residential fitness building with basement) which is not a permitted use; 3945 Soundview Avenue, (Adj. to the Long Island Sound) Peconic, NY. The applicant requests a building permit to construct an accessory building to house an indoor squash court,with changing and viewing areas and a half bath. 2. The applicant submitted to the Board a copy of printed media illustrating his daughter's participation in the sport of squash, and testified that the accessory structure/squash court would be used only by his daughter for her personal practice when in residence, and for the enjoyment of the property owners,their family members, and their friends. 3. The neighborhood consists of many large dwellings on the waterfront side of Soundview that, like the subject dwelling, cannot be seen from the road. The proposed accessory use(squash court)will be contained within the accessory structure that is designed to look like a barn on this 12.03 acre sound front property. The front yard is a conforming location for an accessory structure on waterfront property. The proposed private residential recreational accessory building will be setback from Soundview more than 400 feet and is proposed to be one story in height,with a ground level entry and basement level for the squash court and changing area to reduce the overall height and visual impact and sit within the slope of the property. 4. The accessory building will not be used for public functions of any kind, such as tournaments, and will be used for personal recreation only and shall be otherwise non-inhabitable; i.e. no living, cooking, or sleeping will take place in any part of the accessory building. 5. The code currently permits tennis courts as incidental and accessory to a principal dwelling, and it does not prohibit them from being enclosed.A squash court is a similar racquet sport, has a smaller footprint than a tennis court and, as proposed, is a private recreational use that is also incidental and accessory to the principal dwelling in a residential zone district. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Acampora, and duly carried,to GRANT the variance as applied for a six (6) feet "as built" six feet high deer fence in the front yard, and shown on the site plan prepared by Tom Samuels,R.A., dated October 4, 2017. Vote of the Board: Ayes: Members Weisman (Chairperson), Goehringer,Dantes,Acampora(Member Planamento was absent). In addition, this use will be contained entirely within the accessory structure, which is in all other ways conforming to zoning. It would have less impact, especially with regard to sound, than an outdoor tennis court, which is considered a "customary accessory use". Regarding the existing deer fence, which is located more than 450 feet back from the road, an undesirable change has not been produced, as it is completely invisible from the public domain. 2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than a variance, because it is the very use of the accessory building as a squash court which has been disapproved. ADDITIONAL INFORMATION AND EVIDENCE CONSIDERED BY THE BOARD: 1. Although the property is a large, 12.5 acre lot, the ground elevations drop sharply between 20 and 30 feet near the proposed single-family dwelling, as indicated on the March 5, 2001 survey map prepared by John C. Ehlers, L.S. The only feasible area to place the accessory pool, which is level, is on the easterly side yard of the property 2. In discussing the proposed 14 5' setback with the applicant at the February 27, 2001 hearing, the Board requested that the applicant increase the side yard set back as much as possible. The applicant agreed, and submitted an amended map, which 'places the accessory swimming pool in the easterly side yard, at 30 feet from the property line at its closest point. 3 The Board accepted the amended relief requested by the applicant to locate the accessory swimming pool in the easterly side yard at a minimum distance of 30 feet from the easterly property line, and therefore determine that; I REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings. 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties.
