McBride PROPERTY LOCATION: 11750 Oregon Road, Cutchogue,NY 11935 SCTM# 1000-83-3-5.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 21, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is a non-conforming 15,830.06 square foot lot located in an LI Zoning District. The lot runs 63.68 feet along Oregon Road, 233.52 feet on the North side, 63.68 feet on the East side, and 263.65 feet on the South side. The parcel is improved with a 3,200 sq. ft. barn and a stone/dirt driveway. There is a 15 foot right of way along the Southern side of the lot(subject to Covenants and Restrictions of a filed deed recorded on April 1, 1976, Liber 8011, Page 247). All is shown on a survey prepared by Kenneth M. Woychuk, LLS, dated April 9,2017 BASIS OF APPLICATION: Request for Variances from Article II Section 280-9A(1) and the Building Inspector's September 29, 2017 Notice of Disapproval based on a permit to legalize lot recognition, at; 1) at less than the code required minimum lot size of 20,000 sq. ft., 2) at less than the code required minimum lot width of 300 feet; located at: 11750 Oregon Road, Cutchogue,NY. SCTM#1000-83-3-5.2. RELIEF REQUESTED: The applicant requests a variance to legalize a lot subdivided by deed in 1976. The sub- divided lot is 15,831 square feet where code then required 20,000 square feet. The lot has an average lot width of 67 feet where code then required 300 feet of lot width. ADDITIONAL INFORMATION: The applicant, William Fabb, is the contract vendee who is purchasing the property from Richard and James McBride. The barn on the lot has the benefit of pre-existing certificate of occupancy#Z6892 dated February 23, 1976 legalizing the farm (storage)building as being built prior to 1957. The barn also has a certificate of occupancy # Z7579 dated May 22, 1977 for a farm storage building with addition. y Page 2,March 1,2018 #7126, McBride SCTM No. 1000-83-3-5.2 The property card and a survey by Young and Young LLS, dated February 6, 1976, shows that the lot was separated from a 5.618 acre lot owned by Alex and Shirley Zuhoski on March 24, 1976. A copy of a deed shows that the lot was then sold to Frank McBride on March 24, 1976. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 1,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance(s) will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The lot was subdivided by deed. The building on the lot has the benefit of a pre-existing certificate of occupancy (Pre-CO) indicating that it has been constructed prior to 1957. The area consists of farms, farm houses, farm buildings, and industrial businesses. The farm storage building does not meet current zoning setbacks. Therefore any future expansion of the building, or construction of new structures would require the benefit of an area variance and the non-conformity cannot be expanded without an application to the Zoning Board of Appeals. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot was created by deed 41 years ago. The building department issued the applicant a Pre-Co for a farm storage building and a certificate of occupancy for an addition to the building was issued in 1977 after the lot was created by deed in 1976. The applicant does not have any code conforming options other than to apply for area variances. 3. Town Law 4267-b(3)(b)(3). The variances granted herein for the non-conforming lot size is mathematically substantial, representing 21 % relief from the code. The variance granted herein for the non-conforming lot width is also substantial representing 79% relief from the code. However, current code prevents a subdivision by deed alone and requires much larger lots and average lot widths. Town code requires a formal process to subdivide property that was not in place in 1976. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The contract vendee has chosen to purchase the subject parcel and barn which never received area variances when the lot was created by deed. 6. Town Law §267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a non-conforming parcel while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Weisman, (Chairperson), and duly carried,to GRANT the variances as applied for, and shown on the survey prepared by Kenneth M. Woychuk, LLS, and dated April 9,2017. Page 3, March 1,2018 #7126,McBride SCTM No. 1000-83-3-5.2 SUBJECT TO THE FOLLOWING CONDITION: 1. No further additions or expansion of the pre-existing barn is permitted without obtaining variance relief from the Zoning Board of Appeals. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one(1)year terms.
