proposed overhead gas pump canopy is shown on the site plan prints SP-1 dated Nov. 12 2013, and SK-1 dated
March 7 14,and drawn by Garrett A Strang,Architect.
BASIS OF APPLICATION:A&S SOUTHOLD OIL CORP.#6757-Request for Variances from Article III
Sections 280-15 and 280-15E and the Building Inspector's April 14,2014,amended April 24,2014 Notice of
Disapproval based on an application for building permit to construct an 1,568 sq.ft.'accessory canopy,at; 1)
proposed location other than the code required rear yard,2)less than the code required property line setback of 5
feet from Main Bayview Road,3) less than the code required property line setback of 5 feet from New York State
Route 25(Main Road).
RELIEF REQUESTED: The applicants request variances to construct a proposed 18 ft. high, 1,568 sq. ft.
overhead gas pump canopy accessory structure located within two front yard areas rather than in a required rear
yard location, and two more variances for a 4 foot setback from State Route 25, and a 2 foot setback from Main
Bayview Road,where a 5 foot setback from both streets is required by Code.
ADDITIONAL INFORMATION: The Zoning Board requested comments from the Planning Board on this
application. In a memo dated June 3, 2014 the planning Board stated they generally have no objections but

requested that the applicant apply for site plan approval concurrently with the ZBA application,which the applicant
did before this decision was rendered. At the public hearing two neighbors submitted letters expressing concerns
about night lighting from the proposed canopy and the impact it might have on changing the rural character of the
neighborhood, both of which are addressed in this decision and will be further addressed in the required site plan
review and approval by the Southold Town Planning Board.
This property was the subject of a previous ZBA two part decision (#4813, dated Oct. 13, 2000), in which the
applicant was granted a variance authorizing a 15 foot rear yard setback for a building expansion.At the same time,
the applicant was denied variance relief in a request to construct an accessory overhead pump canopy in a front
yard location, with proposed front yard setbacks of 2 feet from State Route 25, and 1 foot from Main Bayview
Road.The applicant's current site plan also involves the proposed construction of a new pump canopy,but it is of a
different design from that proposed in#4813 in 2000.The current application also proposes increased setbacks of 4
feet from Route 25,and 2 feet from Main Bayview Road.The current application also includes the installation of a
built-in NYS regulation conforming industrial fire suppression system,-and recessed lighting fixtures with a
primarily downward facing illumination. The bottom height of the proposed canopy is 15-feet from a concrete slab
ground level. The built-in recessed lighting will be at the 15 feet height,which is a similar height to some of the
existing exterior lighting fixtures that are currently in use at the gas station. Since the appeal in 2000, a stop sign
has been installed on Main Bayview Road,at the junction of State Route 25 for the purpose of increased safety at
this road intersection. The calendar has marked the passage of almost 14 years since decision#4813,during which
time overhead gas pump canopies have become both more important and more customary for the operation of a gas
service station. Because of these factors, the Board of Appeals views this current application (#6757) to be
substantively different than the previous application(#4813).
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on June 5,2014,at which time written and
oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and
surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be hue and relevant
and makes the following findings:
1. Town Law§267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. A gas service station and the accessory pumps have existed
at this location for a number of decades,with the existing gas pumps situated within a non-conforming front yard
area, and also situated with non-conforming front yard setbacks from the intersection of two roads. This gas
station is a permitted use in the General Business(B)zone that it exists within. Overhead gas pump canopies have
become customary and incidental to the operation of modem gas stations. The built in fire suppression system
contained in the proposed canopy,and the recessed lighting will increase the overall safety at this location.
2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant can or cannot be achieved by some method,
feasible for the applicant to pursue,other than an area variance. The accessory gas pumps already exist in a non-
conforming front yard area,with non-conforming setbacks,therefore the proposed overhead canopy,with the built-
in fire suppression system and recessed lighting cannot be constructed without the grant of variances. There is no
conforming rear yard on this property large enough to re-locate the gas pumps.
3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 100%
relief from the code required rear yard location for an accessory structure, 60%relief for the 2 foot setback from
Main Bayview Road, and 20% relief from code for the 4 foot setback from State Road 25 However, there is no
conforming rear yard location suitable for the re-location of the existing gas pumps.Additionally,there are wood
and concrete curbs between the subject property lines and the paved surface of Main Bayview Road and Main
Road (RT.25). When these curbs are considered in calculating setbacks,the setbacks of the proposed canopy from
the curbs is approximately 12 feet from the pavement of each street,giving the appearance of greater setbacks from
each road.

4. Town Law 5267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The fire
suppression system built into the canopy will increase safety for the operation of the gas station. The recessed
lighting contained within the canopy will primarily illuminate the area directly beneath the canopy, and this will
lessen the amount of light emanating into the adjacent residential neighborhood. The new recessed lighting will be
at the same 15 foot height as some of the existing outdoor lighting at the gas station. The applicant must comply
with Chapter 236 of the Town's Storm Water Management Code and all State, County and Town regulations
regarding the operation of a gas service station. The applicant must obtain site plan-approval from the Town
Planning Board.
5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a new overhead gas pump canopy'and fire suppression system,while preserving
and protecting the character of the neighborhood and the health,safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Weisman
(Chairperson),and duly carried,to
GRANT, the variances as applied for, and shown on the survey drawn by Nathan Taft Corwin III, last updated
Sept. 14,2013,with the location of the proposed overhead gas pump canopy as shown on the site plan prints SP-1
dated Nov. 12,2013 and revised 6/9/14,and SK-1 darted March 7,2014,and drawn by Garrett A Strang,Architect.
CONDITIONS:
1. The applicant must obtain site plan approval from the Southold Town Planning Board.,Failure to do
so will render this decision null and void.

possible denial by the Building Department of a buildingpermit, and may require a new application and public hearing before

above, such as alterations, extensions, or demolitions, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,setback or other
feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are
expressly addressed in this action
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of
nonconformity.
