There shall be no further subdivision, in perpetuity, of either of the two (2) lots shown on the aforesaid Filed Map that would result in additional building lots. No lot lines shall be changed unless authorized by the Town Planning Board 2. There is a 100-foot wide non-disturbance on lot 1 as shown on the Filed Map. All clearing grading and ground disturbance within this buffer, is prohibited, except for the removal of invasive, non-native vegetation. Any permitted clearing is subject to all approvals and permits necessary for clearing near surface waters and other protected natural features. 3. There is a 10-foot wide landscaped buffer running along Oriental Avenue and a 4-foot wide landscaped buffer running along Montauk Avenue on Lot 2, as shown on the Filed Map. The existing fifty (50) trees on Lot 2 as 2 on Lot 2 as shown "to be preserved" on the Filed Map are in lieu of the Street Tree requirement pursuant to §161-44 of the Southold Town Code and shall be preserved into perpetuity unless a hazardous to health safety and welfare. 4. Lot 2 is subject-to a Landscape Plan filed as page two (2) of the approved subdivision map with the Office of the Suffolk County Clerk. 5. All stormwater run-off resulting from the development of any or all of the lots on the Filed Map shall be retained on site and shall be the responsibility of each lot owner. 6. New utilities, including but not limited to electric, gas, telephone and -television, must be located underground. 7. New driveways serving the lots on the Filed Map shall be constructed of pervious materials and shall remain pervious into perpetuity. 8. Each of the lots shown on the Filed Map is subject to clearing restrictions as follows: Lot 1 - 25%, Lot 2 - 35%, pursuant to Southold Town Code §240-49 Clearing. 9. In the event that Southold Town Code §240-49 relating to clearing restrictions is amended to become less restrictive the amended code section shall apply and supercede these conditions. 10.Landscaping a. The use of synthetic fertilizers, herbicides or pesticides on Lots 1 and 2 is prohibited 3 b. The use of native, drought-tolerant plants shall be required in landscaping of said lots. c. No fertilizers containing nitrogen, phosphorus, or potassium shall be utilized between November 1St and April 1st. d. The application of lawn fertilizer within 20 feet of any surface water except: where there is a vegetative buffer of at least 10 feet; or where the fertilizer is applied by a device with a spreader guard, deflector shield or drop spreader at least three feet from surface water is prohibited. e. Only organic fertilizers where the water soluble nitrogen is no more than 20% of the total nitrogen in the mixture may be utilized on the lots. f. A maximum of 1 pound of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 pounds per 1,000 square feet per year is permitted. g. The use of phosphorous containing law fertilizer is-prohibited unless establishing a new lawn or soil test shows that the lawn does not have enough phosphorus. Fertilizer labels have three bold numbers. The number in the middle is the percentage of phosphorus in the product, e.g. 22-0-15. Use of products with 0.67 in the middle or lower is not restricted. Products with a number higher than 0.67 may only be used if a new lawn is being established or a soil test indicates it is necessary. 4 h. The application of lawn fertilizer on impervious surfaces-is prohibited. Any fertilizer that is applied or spilled on impervious surfaces shall be immediately picked up. 11.New underground storage tanks without spill, overfill and corrosion protections are prohibited. The within Covenants and Restrictions shall run with the land and shall be binding upon the DECLARANT, its successors and assigns, and upon all persons or entities claiming under them, and may not be annulled, waived, changed, modified, terminated, revoked, or amended by subsequent owners of the premises unless and until approved by a majority plus one vote of the Planning Board of the Town of Southold or its successor, following a public hearing. If any section, subsection, paragraph, clause, phrase or provision of these covenants and restrictions shall, by a Court of competent jurisdiction, be adjudged illegal, unlawful, invalid or held to be unconstitutional, the same shall not affect the validity of these covenants as a whole, or any other part or provision hereof other than the part so adjudged to be illegal, unlawful, invalid, or unconstitutional. The aforementioned covenants and restrictions are intended for the benefit of and shall be enforceable by the Town of Southold, State of New York, by injunctive relief or by any other remedy in equity or at law. If a Court of competent jurisdiction determines that a violation of these covenants and 5 restrictions has occurred, the Declarant shall pay, either directly or by reimbursement to the Town all reasonable attorney's fees, court costs and,other expenses incurred by the Town in connection with any proceedings to enforce the provisions of the covenants and restrictions set forth herein.
