HomeMy WebLinkAboutLP-01/23/2018 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, January 23, 2018 at 7:00 p.m. Town Hall Annex – Land Preservation Department Members Present: Sam McCullough, Chairman (left 8:46 p.m.) Anne Murray Will Lee John Simicich Doris McGreevy Lillian Ball Members Absent: Eric Keil Also present: Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Land Preservation Secretary Jim King, former Town Trustee & property owner in vicinity of Krupski Family, LLC property Commencement:  The meeting began at 7:00 p.m. with six LPC members present. Committee Minutes and Adoption:  Acceptance of LPC meeting minutes from January 9, 2018 MOTION made by Lillian Ball, seconded by Anne Murray, to adopt the 1/9/2018 LPC meeting minutes as amended. Motion carried: 4/0/2 (LPC members Will Lee and John Simicich abstained as they were not present for the 1/9/2018 LPC meeting) Land Preservation Applications and Inquiries:  SCTM #1000-100.-3-12 (KRUPSKI FAMILY, LLC) PDR application: Appraisal review \[Executive Session\] Jim King spoke to the Committee and showed photos of stormwater runoff coming off the Krupski Family, LLC farm parcel, located at the corner of Mill Road and Reeve Road and carrying silt into Mattituck Creek. He spoke of past efforts by the Town to work with the landowner to mitigate the runoff, and his support for the Town, if given the opportunity, to purchase all or part of the property to do so in order to stop the damaging runoff from the property. EXECUTIVE SESSION. The LPC members entered into LPC reviewed the appraisal. END OF EXECUTIVE SESSION LPC discussed the storm water runoff issue and agreed that the Town should move forward with some type of preservation of all or part of the property to mitigate the runoff; however, LPC questioned whether property should be preserved under the Town’s farmland program as, although the property is currently farmed, it is located within an area where the predominant land use is residential, making this a lower priority for farmland preservation purposes. The LPC asked Melissa to present the appraisal and LPC’s concerns to the Town Board for direction prior to the LPC continuing discussion at the next meeting.  SCTM #1000-109.-1-10.1 (CARNATION PROPERTIES, INC. / McCALL FAMILY HOLDINGS) PDR application: Appraisal review \[Executive Session\] LPC Chairman Sam McCullough was not present during any discussion involving this project due to his business relationship with the potential purchaser. EXECUTIVE SESSION. The LPC members entered into LPC reviewed the appraisal. END OF EXECUTIVE SESSION MOTION made by Lillian Ball, seconded by Anne Murray, to recommend to the Town Board that a purchase offer supported by the appraisal be made to the landowner, Carnation Properties, Inc. (SCTM #1000-109.-1-10.1), for the acquisition of a farmland development rights easement on approximately 51.6 buildable acres. Landowner will retain development rights on an 80,000 sq. ft. reserved area in the southeast corner that will include the residential house and barns. This reserved area will be linked to the farm. LPC will require no additional lot coverage restrictions other than those imposed by the Town Code. Motion carried: 5/0 (LPC Chairman Sam McCullough not present during this project discussion and vote)  SCTM #1000-83.-2-16 (RICHARD McBRIDE and JAMES McBRIDE) PDR Application: Review Land Preservation Coordinator Melissa Spiro presented background information on property, her meeting on January 17, 2018 with the property owners, Richard and James McBride, and LPC Chairman Sam McCullough as well as her site visit to the property on January 19, 2018 attended by LPC members Anne Murray and Doris McGreevy. Landowners have proposed reserving a 6.5± acre area around the existing residential house, barns, and agricultural structures leaving approximately 24.5 acres offered to the Town as a farmland preservation development rights easement. Melissa worked on several optional concept plans for size/shape of the reserved area that were reviewed by LPC. MOTION made by Doris McGreevy, seconded by Anne Murray, to direct Land Preservation Coordinator Melissa Spiro, with the approval of the Town Board, to commission an appraisal for the purchase of a development rights easement on the McBride Property (SCTM #1000-83.-2-16) using two scenario options: (a) a 6.5± acres reserved area and, (b) a 4.5± acres reserved area. A restriction will be placed on the property allowing the landowner, or future landowner, to apply to subdivide the excluded area, and to subdivide it from the farm area; however, the restriction shall ensure that at least one development area with a minimum area of 80,000 sq. ft. shall remain linked to the area subject to the development rights easement area. Appraiser to be instructed to value the “after” value with two different approaches pertaining to agricultural structures and to present values with no additional lot coverage restrictions, and with lot coverage restrictions limited to 10 and 2 percent. Appraiser to be informed that property has a winter water view. Motion carried: 6/0  PROJECT STATUS UPDATE Not discussed due to time constraints.
