Y,, parr of the consideration for the issuance of the Permit does rmderstand and preragtibe to the fol- lowing: 1. That the said Board of Trustees and the Town of Southold are released from any a~d all damages, or ~l,lms for damages, of suits arising directly or indirectly a~ a result of any oper- ation performed pursuant to this permit, and the said Permittee will, a~ his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. That this Permit is valid for a period of 24 mos. which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 5. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that anth- orizarion was originally obtained. 4. That .the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of 'this Permit by resolution of the said Boexd. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be interference with the fight of the public to and no pass along the beach between high and low water mnrks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Tmste~, the work shall cause unreasonable obstructxon to free navigation, the said Permit'tee will be required, upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Pexmittee or the completion of the work anth- orized. 9. TuthilI BOARD OF TOWN TRUSTEES Fax (516) 765-1823 Telephone (516) 765-1892 TOWN OF SOUTHOLD Telephone (516) 765-1800 May'29, 1990 / Roy Haje, President En-Consultants, Inc. 1329 North Sea Road Southampton, NY 11968 Re: App. No. 2-3-90-98-1-11.1/Kosm!rnka Dear Mr. Haje: The following action was taken by the Board of Town Trustees during its regular meeting held on May 24, 1990 regarding the above matter: WHEREAS, En-Consultants IN BEHALF OF Martin Kosm!rnkaapplied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated February 21, 1990 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on May 24, 1990 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar -with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED THAT Eh-Consultants IN BEHALF OF Martin Kosmynka BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: To construct a timber dock consisting of a 4' x 40' fixed elevated (4' above grade) walk; a 3' x 15' hinged ramp; (2) 6' x 16' floats secured by (4) 8" diameter spilings. In addition, the applicant is to construct a single-family dwelling, deck, sanitary system, bluestone driveway, with 150 c.y. of fill. Required conditions: a 50' vegetated buffer along creek and installation of dry well for driveway and road run-off. Project location is Pine Tree Road, Peconic, NY fronting Little Creek. This permit will expire two years from the date it is signed if work has not commenced by said date. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for an~ ether permits which may be required for this preject. New York 11971 (5 J.6) 765-1801 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL To: Southold Town Trustees From: Southold Town CAC Dated: March 20, 1990 Re: Recommendations The following recommendations were made by the CAC at its meeting held Monday, March i9, 1990: On a motion by Bruce Loucka, seconded by Margaret Feeney it was RESOLVED to recommend to the Southold Town Trustees APPROVAL WITH STIPULATIONS of Wetland Application No. 1-18-90-53-5-12.2 submitted by Gail Schlegel to reconstruct an existing single family dwelling, solid fill pier, and boat ramp. After recon- struction, removal of concrete surfacing and installation of native seaside planting. The CAC approves with the stipulation that all runoff is contained on property: no runoff from house, driveway or boat ramp (suggest drywells); hay bales and filter cloth be used during construction; the concrete debris be removed from the parcel; and no lawn within 75' of wetlands. Sage Boulevard, Greenport Vote of Council: Ayes: All - Motion carried. - On a motion by John Holzapfel, seconded by Margaret Feeney it RESOLVED to recommend to the Southo~d Town Trustees APPROVAL ~f Wetland Application No. 2-3-90-98-~-11.1 submitted by En- Consultants Inc. on behalf o~ Martin Kosmynka to construct a timber dock consisting of a fixed elevated walk; hinged ramp; and floats secured by pilings. Concerning the Letter of No Juris- diction, the CAC recon~m~nds the Trustees deny the request because the construction envelope is within 75' of the wetlands. Pine Tree Road, Peconic. On a motion by Bruce Loucka, seconded by John Holzapfel, it was RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of Wetland Application No. 3-1-90-40-3-93 submitted by Proper- T Services on behalf of Agnes M. Dunn to demolish an existing house and construct a new house. The CAC recommends disapproval because the new house would be within 75' of the wetlands; no contou~ map was submitted; applicant does not show where grading will occur; and members are concerned about where the runoff would go.
