Relief is requested from: 19 NYCRR Part 1220, Residential Code of New York State (2010), Section R305.1,exception 4, which stipulates that...Bathrooms shall have a minimum ceiling height of 6 feet 8 inches(2036 mm) over the fixture and at the front clearance area for fixtures as shown in Figure RR307.1. A shower or tub equipped with a showerhead shall have a minimum ceiling height of 6 feet 8 inches (2036 mm) above a minimum area 30 inches(762 mm) by 30 inches(762 mm) at the showerhead. [The petitioner requests to relief to permit a toilet in a bathroom with a ceiling height of approximately 6 feet 6 inches over the front clearance area.] FINDINGS OF FACT 1. A bathroom has been constructed within the gable roof area over the first story of an existing dwelling. The ceiling slopes from approximately 5 feet 4 inches to approximately 9 feet in height. 2. The toilet for the bathroom in question has been positioned so that the ceiling pitch is steep enough to allow a ceiling height of approximately 6 feet 6 inches over the required front clearance area 3. With a ceiling height of 6 feet 6 inches most persons would be able to use the toilet in a standing position and ample height to use the toilet in the seated position. 4. The Petitioner proposes that the alterations, in all other respects, will be compliant with all other applicable provisions of the Residential Code of New York State. 6. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would be unnecessary and the granting a variance would not substantially adversely affect the Code's provisions for healthy, safety and security. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220.1, Section R305 1, to permit a toilet in a bathroom with a ceiling height of approximately 6 feet 6 inches over the front clearance area; be and hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the alterations, in all other respects, will be compliant with all other applicable provisions of the Residential Code of New York State.
