INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim,the Building Inspector may authorize, in writing,the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Findings: The project meets all the requirements for issuance of an

issuance of an Administrative Permit allows for the operations as indicated on the
survey prepared by Nathan Taft Corwin, III, Land Surveyor, last dated May 3,
2016, and stamped approved on May 18, 2016.

Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code, a

6. Failure to Meet Permit Conditions Failure of the permittee to meet all the conditions of this permit
is a violation of this permit and grounds for an order to immediately cease the permitted activity at the
project site.
7. All Structures Must Be At Least 100 Feet Landward Of The Wetland Boundary This permit
authorizes the construction of new single family dwellings with accessory structures and septic systems
located in the adjacent area at the prescribed minimum setback only. Structures located in tidal wetlands,
or structures in the adjacent area but located less than 100 feet from the wetland boundary, are not
authorized.
8. Development Restrictions New single family dwelling, accessory structure and septic system
projects authorized by this permit must meet all of the applicable development restrictions of 6 NYCRR
Part 661.6(a) (1), (2), (3), (4), (5), (7), and Part 661.6(b):
- The 75 foot minimum wetland setback requirement for all principal structures and all non-water-
dependent structures exceeding 100 square feet in area.
- The 100 foot minimum wetland setback requirement for all components of the septic system.
-The requirement that all components of the septic system be installed at an elevation at least 2 feet
above the seasonal high groundwater elevation for the site.
-The 20%maximum adjacent area coverage limitation for impervious structures and surfaces.
-The minimum lot area requirement for the construction of new principal buildings; 20,000 square feet
in areas with public sewers and 40,000 square feet in areas without public sewers.
-The 75 foot minimum wetland setback requirement for all hard surface driveways, roads, parking areas
and similar impervious surfaces exceeding 500 square feet in area.
9. Sanitary Systems above Groundwater Sanitary system (bottom of tank and leaching pools) shall
be located a minimum of 2 feet above seasonal high groundwater.
10. No Changes To Existing Septic Systems This permit does not authorize any alteration, expansion
or replacement of existing septic systems
11. Establish Vegetated Buffer To protect the values of the tidal wetlands, a permanent vegetated
buffer zone shall be established. There shall be no disturbance to the natural vegetation or topography
within an area extending 50 linear feet landward of the tidal wetland boundary.
12. Straw Bales or Other at Tidal Wetland A row of staked straw bales or approvable erosion
control devices shall be placed at the landward edge of the buffer area or 50 linear feet from the tidal
wetland boundary, or as per the NYSDEC-approved plan, prior to commencement of any regulated
activities and remain in place and in good, functional condition until the project is completed and all
disturbed areas are stabilized with vegetation.

13. Roof Runoff Directed to Drywells Roof runoff shall be directed to drywells with the capacity to
store/recharge the runoff from a 2 inch/24 hours precipitation event. All drywells shall be located.a
minimum of 75 feet landward of the tidal wetland boundary
14. No Drywells in or near Wetland Dry wells for pool filter backwash shall be located a minimum
of 100 linear feet landward of the tidal wetland boundary.
15. Direct Runoff Away from Tidal Wetland and Buffer Roads, driveways, and parking areas shall
be graded to direct runoff away from tidal wetlands and protected buffer areas.
16. Driveway/Parking Area of Pervious Material Driveway and parking areas shall be constructed of
NYSDEC-approved pervious materials.
17. No Pool Discharges to Wetland There shall be no draining of swimming pool water directly or
indirectly into wetlands or protected buffer areas.
18. Clean Fill Only All fill shall consist of clean sand, gravel, or soil (not asphalt, slag, flyash, broken
concrete or demolition debris).
19. Contain Exposed, Stockpiled Soils All disturbed areas where soil will be temporarily exposed or
stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/silt
curtains (or other NYSDEC approved devices) placed on the seaward side between the fill and the
wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
20. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the permitted activities.
21. Area of Disturbance for Structures Disturbance to the natural vegetation or topography greater
than 25 feet seaward of the approved structure is prohibited.
22. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area (upland) and removed to
an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas.
23. Storage of Equipment, Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 75 linear feet from the tidal
wetland boundary.
24. Vegetate All Disturbed Areas The permittee shall revegetate all exposed faces and disturbed areas
to prevent soil erosion prior to the project completion or expiration date of this permit, whichever comes
first.
25. Concrete Leachate During construction, no wet or fresh concrete or leachate shall be allowed to
escape into any wetlands or waters of New York State, nor shall washings from ready-mixed concrete
trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or
waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms.

26. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants, epoxy coatings, paints, concrete; leachate or any other environmentally deleterious materials
associated with the project.
27. State May Require Site Restoration If upon the expiration or revocation of this permit, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent and in such time and manner as the Department of Environmental Conservation may
lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its
former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.
28. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause
loss or destruction of the natural resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State,
and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be completed, the owners, shall, without
expense to the State, and to such extent and in such time and manner as the Department of
Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill
and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.
29. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result from future operations
undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no
claim or right to compensation shall accrue from any such damage.
GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of Environmental Conservation(the Department) to determine whether the permittee is complying with
this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301
and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is a violation of this permit.

2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a
separate written application to the Department for permit renewal, modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.
Any renewal, modification or transfer granted by the Department must be in writing. Submission of
applications for permit renewal, modification or transfer are to be submitted to:

4. Submission of Renewal Application The permittee must submit a renewal application at least 30
days before permit expiration for the following permit authorizations: Tidal Wetlands.
5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revoke this permit. The
grounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding the-scope of the project as described in the permit application;
d. newly discovered material information or a material change in environmental conditions, relevant
technology or applicable law or regulations since the issuance of the existing permit;
e. noncompliance with previously issued permit conditions, orders of the commissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.
6. Permit Transfer Permits are transferrable unless specifically prohibited by statute, regulation or
another permit condition. Applications for permit transfer should be submitted prior to actual transfer of
ownership.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated February 19, 2016 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. The LWRP Coordinator issued a recommendation dated March 8, 2016 Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records
available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards
and therefore is CONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTION: The property is a conforming 2.439 acre parcel located in an R-80 zone.
The parcel runs 310.28 feet along Richmond Creek. The parcel runs 291.66 feet along Wells Road. The parcel
runs 330.27 feet on the South side and 299.53 feet on the North side. The parcel is not improved. Part of the
property is labeled as tidal wetlands. The AE flood line also runs through the property. All is shown on a survey
by Nathan Taft Corwin L.L.S. dated November 4, 2015.
BASIS OF APPLICATION: Request for Variance(s) from Sections 280- 15B&F and the Building Inspector's
February 12, 2016 Notice of Disapproval based on an application for building permit for accessory garage and
accessory in ground swimming pool, at; 1) proposed accessories in location other than code required rear yard or
front yard on waterfront property, 2) accessory garage at more than code allowable 22 feet.
RELIEF REQUESTED: The applicant requests variances to construct a new dwelling with accessory garage and
in-ground pool where construction will result in the garage and pool being in side yard locations. The applicant
proposes to build the garage at 23' '/4" high where the code permits a maximum height of 22 ft.
AMENDED APPLICATION• During the hearing, the applicant was asked to bring the plan into more conformity
with the code. The applicant agreed to build the garage at a code conforming height. On April 18, 2016, the

applicant submitted a revised garage plan showing the proposed height of 22 feet, thereby conforming to the code
and eliminating one variance request.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on April 7,2016 at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and
surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
1. Town Law §267-b(3)(b)(1). Grant of the variances for the garage will produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The neighborhood consists of open farmland
and single family homes. The lot is a large vacant lot. The applicant can convert the area labeled breezeway into
conditioned space thereby attaching the garage to the house and conforming to code. The variance granted for the
pool will not produce an undesirable change to the character of the neighborhood. The parcel is a wide parcel. The
parcel is covered by wetlands and the AE flood line runs through it. The layout of the structures significantly sets
them back from the wetlands and the AE flood zone.
2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. Although the code conforming rear yard is restricted by
wetlands and a 75 foot non-disturbance buffer zone,the applicant could conceivable locate an accessory garage and
pool in a code conforming front yard on the subject waterfront property, or attach the garage to the house.
However, the front yard will contain a driveway and septic system; a pool in a front yard is not characteristic of the
neighborhood; and the parcel is very wide and the proposed garage and pool have side yard setbacks far exceeding
the code requirement.
3. Town Law &267-b(3)(b)(3). The variances granted herein for the pool is mathematically substantial,
representing 100% relief from the code. However, the pool has a proposed side yard setback of+/- 130 feet. The
variance for the accessory garage is mathematically substantial representing 100%relief from the code. '
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code and proposes to locate a
new septic system, garage and pool far from the wetlands and non-disturbance buffer zone on the subject property.
5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law §267-b. Grant of the requested relief for the pool is the minimum action necessary and adequate to
enable the applicant to enjoy the benefit of a swimming pool in a side yard location while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community. Grant of requested relief
for the accessory garage IS NOT the minimum action necessary for the applicant to enjoy the benefit of a garage.
The applicant can move the accessory garage to a code conforming location or the applicant can attach the garage
to the house.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Schneider, and duly
carried, to
GRANT the variance as applied for the swimming pool, and shown on the architectural plans by Irving M. Kusnitz
RE dated 11/24/2015 and labeled A-1 -10 and the survey prepared by Nathan Taft Corwin L.L.S. dated November
4, 2015.

And to DENY the variance as applied for the garage location.
CONDITIONS:
1. Evergreen and landscape screening in the area around the pool shall be installed to provide privacy from
the road.
2. Pool mechanicals shall be placed in a sound deadening enclosure.
3. Drywell for pool de-watering shall be installed per survey cited above.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department of a building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey
cited above, such as alterations, extensions, or demolitions, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the
Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three
(3)years from the date such variance was granted. The Board of Appeals may, upon written
request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one
(1)year terms.
