Councilman Hubbard offered the following resolution,
which was seconded by Councilwoman Kent
RESOLVED, that the Town Clerk is hereby authorized to publish and post the
attached public notice to consider a proposed local law for the amendment of Chapter
237 entitled, " Highways, Streets and Sidewalks" of the Riverhead Town Code, once in
the March 1, 2018 issue of the News-Review Newspaper, the newspaper hereby
designated as the official newspaper for this purpose, and to post same on the
signboard in Town Hall; and be it further
RESOLVED, that all Town Hall Departments may review and obtain a copy of
this resolution from the electronic storage device and, if needed, a copy of same may
be obtained from the Office of the Town Clerk.

PLEASE TAKE NOTICE,that a public hearing will be held on the day of 20th day of March,
2018 at 7:15 p.m. at Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York, to
consider a proposed local law to amend Chapter 237 of the Riverhead Town Code entitled,
"Highways, Streets and Sidewalks" as follows:

Article IV: Obstructions
§ 237-10. Snow and
ice removal for commercial premises; sidewalk maintenance.

A. It shall be the duty of all owners occupants or persons charged with control of stores
shops and other commercial premises including churches any public building or vacant
lots located within any business, commercial or industrial zone during the winter season or
during the time of snow to keep and maintain the sidewalks adjacent thereto free from
obstruction by snow or ice and icy conditions and shall at all times keep the sidewalk in
good and safe repair and maintain it in a clean condition free from filth dirtweeds or other
obstructions or encumbrances.
B. In addition to the duties set forth in §237-10 (A) all owners occupants or persons
charged with control of stores, shops and other commercial premises including churches
any public building or vacant lots located within any business commercial or industrial
zone shall provide snow and ice removal and the immediate area surrounding any bus
shelter, be it located on or fronting said property, as part of and in conjunction with its
obligation to maintain its sidewalks free of snow. The duty to remove snow and ice from
immediate area surrounding bus shelter shall include the area between the sidewalk and
bus shelter so persons may safely gain access from the sidewalk to the bus shelter.

It shall be the duty of all owners or occupants of any house and any owner or person
entitled to possession of any vacant lot within a residential zone during the winter season
or during the time of snow to keep and maintain the sidewalks adjacent thereto free from
obstruction by snow or ice and icy conditions, and shall at all times keep the sidewalk in
good and safe repair and maintain it in a clean condition free from filth dirtweeds or other
obstructions or encumbrances. Snow and ice shall be removed within 24 hours after snow
has ceased to fall, except all owners or occupants of property located within a half mile of
any school shall be required to maintain the sidewalks adjacent thereto free from
obstruction by snow, ice and icv conditions at all times school is open In case snow and
ice on any sidewalk shall be frozen so hard that it cannot be removed without injury to the
sidewalk, it shall, within the time specified above be strewn and kept strewn with sand or
other suitable material, so as to be no longer dangerous to life and limb. As soon as
practical thereafter, the sidewalk shall be completely cleared of snow, ice and other
materials strewn thereon, as provided in this local law.
§ 237-12 Depositing of snow prohibited.
No person shall shovel, plow or otherwise deposit snow onto any sidewalk street public
place or shovel, plow or deposit snow on property owned by any other person or entity in
the Town of Riverhead.

No person shall do or cause to be done any act or thing which shall cause or contribute to
a condition in, within or upon any street, highway, sidewalk or other public way which shall
be dangerous to the health, safety or welfare of persons using the same or impair the
public use thereof or obstruct or tend to obstruct or render the same dangerous for
passage, including but not limited to, the deposit of snow onto any roadway deposit of dirt
filth, waste, or rubbish; display of merchandise signs boxes or material things of any kind:
and, encumbering thereof by an encroachment of buildings structures excavation without
or in violation of road opening permit or otherwise. Nothing contained in this section shall
prevent persons from placing goods, wares, merchandise or household furniture on a
sidewalk temporarily while loading or unloading it if it is done without unnecessary delay
and if such goods, wares or merchandise are not allowed or permitted to remain on the
sidewalk for a longer period than one hour
4 237-14 . Penalties for offenses.
Each violation of this article shall be punishable as follows.-
A.
ollows:A. For the first offense, no less than $250 but no more than $2,500. Each day (24 hour
Period) any and all violations defined herein in this Chapter continue to exist shall
constitute a separate additional offense subject to the penalty provisions in §237-14 (B)
and (C) as applicable.
B. For the second offense, no less than $750 but no more than $2,500.
C. For the third offense or subsequent offense all of which are committed within a period of
30 days, no less than $1,000 but no more than $2,500.

NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that a public hearing will be held before the Town Board of
the Town at Riverhead at Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York, on
the 20th day of March, 2018 at 7:05 o'clock p.m. to amend Chapter 301, entitled "Zoning and
Land Development" of the Riverhead Town Code.
Be it enacted by the Town Board of the Town of Riverhead as follows:
CHAPTER 301
Zoning and Land Development
Article XLV. Supplementary Use Regulations
§ 301-231. Off-street parking.
I. Land provided by the Town of Riverhead for off-street parking shall not be used in
determining the parking areas required by this chapter. However, where a public
parking district has been created, the owner of property being used for other than
any residential use within such district need not provide off-street parking areas
required by this chapter. For all residential uses, including apartments hotels or
multi-family dwelling uses of property within a public parking district off-street parking
spaces shall be provided for those residential uses in the amount as required by this
Chapter. This requirement for off-street parking spaces for apartments hotels or
multi-family dwelling uses shall not be applicable to any lots improved with or having
final site plan for, such residential use prior to the effective date of this amendment
Such improved properties shall be entitled to maintain the existing lot areas and
setbacks without requirement of providing off-street parking except that any
enlargement, alteration resulting in an increase of the residential use shall require
off-street parking in proportion to the increase.

Councilwoman Giglio offered the following resolution,
which was seconded by Councilman Hubbard
RESOLVED, that the Town Clerk is hereby authorized to publish and post the
attached public notice to consider a proposed local law for the amendment of Chapter
289 entitled, " Vehicles, Traffic and Parking Regulations " of the Riverhead Town Code,
once in the March 1, 2018 issue of the News-Review Newspaper, the newspaper
hereby designated as the official newspaper for this purpose, and to post same on the
signboard in Town Hall; and be it further
RESOLVED, that all Town Hall Departments may review and obtain a copy of
this resolution from the electronic storage device and, if needed, a copy of same may
be obtained from the Office of the Town Clerk.

PUBLIC NOTICE
PLEASE TAKE NOTICE, that a public hearing will be held on the day of 20th day of March
2018 at 7:10 p.m. at Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York, to
consider a proposed local law to amend Chapter 289 of the Riverhead Town Code entitled,
"Vehicles, Traffic and Parking Regulations" as follows:
Chapter 289: Vehicles, Traffic and Parking Regulations
Part 1 Vehicles and Traffic
Article IX: Snow Events
§ 289-45. Findings; purpose.
The Town Board of the Town of Riverhead does hereby find that there exists a threat to
public safety any time that snow, freezing rain, sleet, or ice is permitted to accumulate on
Town highways and roadways. The parking or abandonment of vehicles along the
highways and roadways during snow and other winter-weather-related events prohibits
and/or restricts the Town's ability to remediate the hazardous conditions on the highways
and impedes the ability of fire, police, and ambulance vehicles and personnel to provide
necessary services to Town residents. For the above reasons,the Town Board of the Town
of Riverhead finds it necessary to enact legislation prohibiting parking and standing of
vehicles on Town highways and roadways in anticipation of and during major snow or
winter weather events and such other restrictions related to highway safety during snow
and other related winter weather events-. , including travel ban for non-emergency vehicles
and/or temporary closure of highways/roads. Pursuant to and consistent with Executive
Law 24, A a snow or winter storm emergency declaration and local emergency
proclamations shall be made by the Supervisor or his/her designee. Such declaration shall
be made at the discretion of the Supervisor when weather conditions are forecasted or
exist such that the accumulation of snow, freezing rain, sleet, or ice on any roadway will
imperil the public safety, render vehicle travel potentially hazardous and necessitate snow
removal operation or such other remediation efforts to address a winter storm by the Town.
§ 289-46. Declaration of snow or winter storm emergency.
A. The Town Supervisor or his or her designee shall declare a snow emergency or
winter storm emergency in a signed written notice to the Town Clerk or Deputy Town
Clerk within 24 hours of said declaration. Said notice shall become effective
immediately after signing and shall indicate the date and exact time of the
declaration. The Chief of Police and Superintendent of Highways shall be notified
immediately following a snow or winter storm emergency declaration. In addition to
and during the declaration of snow or winter storm emergency, the Supervisor or
his/her designee may promulgate local emergency orders to protect life and property
or bring emergency situation under control.
B. The Supervisor or his/her designee shall notify at least one local Fadie statioR media
immediately following a snow or winter storm emergency declaration and local
emergency orders, and the Supervisor or his/her designee may cause same to be
posted on the Town's official website.
C. The snow or winter storm emergency declaration and local emergency orders shall
be in effect until such time as a snow or winter storm emergency and/or local
emergency order termination has been received by the Town Clerk or Deputy Town
Clerk in accordance with § 289-49 of this article.
§ 289-47. Parking prohibited during snow emergency.
No parking is permitted on either side of any roadway during a snow or winter storm
emergency declaration . pursuant to§ 289-46
of this article.
§289-48. Road closure.
The declaration of a snow or winter storm or local emergency orders may designate and
declare certain highways and roads closed such that vehicular travel is prohibited during
the snow or winter storm emergency or for such other period of time recited in the
declaration of snow or winter emergency or local emergency orders. The only vehicles
allowed on the highways and roads declared closed are emergency vehicles (police and
designated police tow vehicles, fire ambulance) highway department vehicles and other
essential public service vehicles.
§ 28948 49.Snow emergency termination/rescission of local emergency order.
A. The termination of a snow or winter storm emergency and/or rescission of local
emergency orders shall be declared by the Supervisor or his/her designee. Such
termination or rescission shall be made at the discretion of the Supervisor when
snow removal operations or such other required remediation efforts have been
completed to the satisfaction of the Supervisor.
B. The Supervisor or his/her designee shall declare a snow or winter storm termination
emergency or rescission of local emergency orders in a signed written notice to the
Town Clerk or Deputy Town Clerk. Said notice shall become effective immediately
upon receipt and shall include the date and exact time of the snow emergency
termination or rescission of local emergency orders. The Chief of Police and
Superintendent of Highways shall be notified immediately following a snow or winter
storm emergency termination or rescission of local emergency orders.
C. The Supervisor or his/her designee shall notify at least one local radio station
immediately following the termination of a snow or winter storm emergency or
termination of local emergency orders +oris
D. The snow or winter storm emergency termination or rescission of local emergency
orders related thereto shall nullify any provisions or conditions resulting from a snow
or winter storm emergency declaration or local emergency order, as the case may
be as provided for in this article.
§ 289-49 50. Depositing of snow prohibited.
It is prohibited to shovel, plow or otherwise deposit snow onto any roadway in the Town of
Riverhead.
§ 289-W 51. Penalties for offenses; removal of vehicles in violation; penalties {^p
Offenses.
A. Any person, association, firm or corporation, owner or occupant who or which
violates § 289-46 and § 289-50 shall be guilty of a violation punishable by a fine of
not less than $250. Each day the violation continues shall constitute a separate
additional violation.
B. Any vehicle parked on any highway within the Town of Riverhead during a snow or
winter storm emergency behyeeR the he arc of 8:00 p.m. and 6:09 a.m. as set forth in
§289-47 shall be deemed to affect the ability of the Town to remediate hazardous
roadway conditions or create a hazardous condition and/or impede or potentially
impede the ability of fire, police, highway and ambulance vehicles and personnel to
provide necessary services to Town residents on that portion of the public highway
on which said vehicle is parked such that said vehicle may be removed by the
Riverhead Town Police or other personnel so authorized by the Town Board as set
forth in § 289-26, and all procedures set forth in § 289-26, including payment of all
fees related to storage and removal, shall apply to vehicles removed from the
highway pursuant to this provision.
C. Any vehicle traveling on any highway or road within the Town of Riverhead that has
been declared temporarily closed pursuant to a declaration of a snow or winter storm
emergency and/or local emergency order related to such snow or winter event as set
forth in M 289-48 shall be deemed to affect the ability of the Town to remediate
hazardous roadway conditions or create a hazardous condition and/or impede or
Potentially impede the ability of fire, police, highway and ambulance vehicles and
personnel to provide necessary services to Town residents on that highway or road or
portion thereof on which said vehicle traveled such that said vehicle may be removed
by the Riverhead Town Police or other personnel so authorized by the Town Board as
set forth in � 289-26, and all procedures set forth in 289-26 including payment of all
fees related to storage and removal shall apply to vehicles removed from the highway
pursuant to this provision.
D. Any person, association, firm or corporation owner or occupant who or which
violates $ 289-50 shall be guilty of a class B misdemeanor as set forth in New York
State Executive Law § 24 (5).

PUBLIC NOTICE
PLEASE TAKE NOTICE that a public hearing will be held before the Town
Board of the Town of Riverhead at Riverhead Town Hall, 200 Howell Avenue,
Riverhead, New York on the 6th day of March at 2:15 o'clock p.m. to consider a
proposed local law entitled, "Local Law to Increase Salary of Town Highway
Superintendent for 2018 Fiscal Year", subject to permissive referendum as follows:

TOWN OF RIVERHEAD
Local Law No. , the year 2018
A Local Law Increasing Salary of Town Highway Superintendent for 2018 Fiscal Year.
Be it enacted by the Town Board of the Town of Riverhead as follows:
Section I. Title:
This Local Law shall be known and cited as Town of Riverhead "A Local Law to
Increase the Salary of Highway Superintendent for the 2018 Fiscal Year".
Section Il. Legislative Intent:
The intent of this local law is to increase the salary of the Highway Superintendent
position for the 2018 fiscal year to reflect the Town's assignment of additional duties
and responsibilities to the Highway Superintendent related to the Municipal Garage.
Section III. Authority:
This local law is adopted pursuant to Municipal Home Rule Law §10 and New York
Town Law §27 that authorizes the Town Board to increase the salary of certain elected
officials of the Town, including the Highway Superintendent, to an amount in excess of
the amount specified in the notice of public hearing on the preliminary budget for not
more than one fiscal year by adoption of a Local Law pursuant to Municipal Home Rule
Law.
Section IV. Increase of Salary:
The Town Highway Superintendent salary was specified in the notice of hearing on the
preliminary budget of the Town of Riverhead in the amount of$94,803.00, and is hereby
increased by $20,000.00 for the 2018 fiscal year prorated as of the effective date of this
local law.
Section V. Severability:
The invalidity of any clause, sentence, paragraph or provision of this Local Law shall not
invalidate any other clause, sentence, paragraph or part thereof.
Section VI. Effective Date:
This Local Law shall be subject to permissive referendum and shall not become
operative or effective unless and until 45 days have elapsed after its adoption and no
petition protesting against this Local Law has been filed with the Town Clerk or, if such
a petition is filed, a proposition for the approval of this Local Law has been submitted
and received the affirmative vote of a majority of the voters voting thereon. If no petition
is timely filed or if a petition is filed and this Local Law is approved, it shall take effect
upon filing by the office of the New York Secretary of State.
