SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 28, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject rectangular parcel, located in the Agricultural Conservation Zoning District consists of a conforming two-acre, 87,120 square feet residentially developed lot measuring 303.91 feet along Alvah's Lane with a southern lot line measuring 303.75 feet along an adjacent residence, then running 302.52 feet north along an agricultural field also owned by the applicant, then running east 275.44 feet along the same agricultural field. The adjacent, 226,691 square feet or 5.2041 acre agricultural field to the north and west, owned by the applicant, has 173.33 feet on Alvah's Lane with a shared lot line to the north of the applicant's residential lot running 275.44 feet then turning south 302.52 feet along the western portion of the subject residence, then running 233 feet west along an agricultural field to south with an additional 140.16 feet northwest, creating the southern lot line, before turning north 458.93 feet creating the western lot line, then running east, 654.91 feet along the Long Island Rail Road to Alvah's Lane, creating the northern lot line. The subject property is developed with a 2-story frame house and concrete patio accessed via a stone driveway along with other improvements including a frame garage, frame chicken coop, frame shed and large frame barn as depicted on the survey prepared by John C. Ehlers, Land Surveyor, last revised August 24, 2016. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; and the Building Inspector's October 24, 2017, Notice of Disapproval based on an application for a building permit to demolish an existing single family dwelling and construct a new single family dwelling and construct an in-ground swimming pool, at; 1) existing frame barn located in other than the code required rear yard; 2) existing frame garage located in other than the code required rear yard; 3) existing frame chicken coop located in other than the code required rear yard; Page 2, February 15, 2018 #7133, Cacioppo SCTM No. 1000-101-2-22.1 4) proposed in-ground swimming pool located in other than the code required rear yard; located at: 4805 Alvah's Lane, Cutchogue,NY. SCTM#1000-101-2-22.1. RELIEF REQUESTED: The applicant requests variances to construct a two-story, wood-frame single family residence with covered porches, after demolishing the existing house, siting the newly constructed home 129.7 feet back from Alvah's Lane thereby placing the existing accessory frame garage in the front yard, and he existing accessory frame chicken coop and the existing accessory frame barn in the side yard. The applicant also proposes the addition of an 18 feet by 32 feet in ground swimming pool in a side yard, where the Town Code requires all accessory structures to be located in the rear yard. ADDITIONAL INFORMATION: The applicant owns the adjacent 226,691 square feet, 5.2 acre fallow agricultural field, SCTM #1000-101-2-22.2 to the north and west; this field, once one lot with the subject residence, is encumbered by a Town of Southold Development Rights Easement, restricting residential development and limits its use purely to agriculture. No immediate neighbor or member of the public spoke for or against this application. The builder represented the applicant during the public hearing and provided as follow up on February 2, 2018 two granted variances for similar applications: Zoning Board of Appeals file #5048 and #5130. Additionally, the applicant's representative illustrated the proposed improvements will increase the existing lot coverage by 3,232 square feet from 5,518 square feet to 8,750 square feet for a total lot coverage of 10%, well under the permitted lot coverage for the Agricultural Conservation zone. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 1, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Alvah's Lane is a secondary road linking Main Road, where it originates, to the south with County Road 48 aka North Road to the north, continuing to Oregon Road where it terminates. The streetscape is characterized by open farm fields and vineyards, many of which are preserved limiting residential development. The intensive use of the Long Island Rail Road abutting the subject property to the north creates a substantial nuisance that is detrimental to the rural and bucolic character of the area and residences. Within the immediate vicinity of the applicant's property, homes are set far apart with limited screening and tend to be older residences or working farm properties constructed prior to current zoning and featuring one or more accessory structures in a variety of locations. These structures appear to be non-conforming to current zoning, possibly developed over time and characteristic of an agricultural community. Area residences take advantage of the open space and views. Moreover, the applicant's existing structures, including an accessory garage, frame chicken coop and frame barn have been located on the site for many years, visible from the road, without issue or complaint. The existing farmhouse, slated for demolition, while located closer to the road than the proposed residence, has the frame garage and the frame chicken coop located in a non-conforming side yard, while the frame barn is located in the conforming rear yard. The proposed location for a new farmhouse, set back nearly 130 feet from the road, takes advantage of the location of the existing accessory structures, screening the residence from the railroad and thereby creates the need for a variance on all three of these structures versus two, as they will now all be located in a non-conforming side-yard and front yard location. Furthermore, an in-ground swimming pool is a customary accessory structure to a residence and is common to the immediate neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The frame garage, frame chicken coop and frame barn all Page 3, February 15, 2018 #7133, Cacioppo SCTM No. 1000-101-2-22.1 are preexisting structures and are not easily moved to a conforming location. While the proposed new residence could be built closer to the road or located at the site of the proposed demolition of the existing residence, variances would still be required for the two structures located in the side yard , the frame garage and the frame chicken coop. The barn could remain in a conforming location. However, by allowing the applicant to construct the residence in the proposed location set further back from the road,the three existing structures located in a side-yard will aid in screening the applicant's proposed residence from the Long Island Rail Road and will help to reduce road noise. Moreover, while the applicant could locate the pool in a conforming rear-yard location, the proposed location allows the home owner to properly monitor the pool's safe use from the kitchen, dining and porch areas— those most commonly used during the Summer season when a pool is in use. Additionally, by placing the pool in a side-yard location between the house and the existing frame barn, the applicant proposes at a later date, to seek permits for an adaptive reuse of the frame barn to a pool house or other permitted use, further preserving this structure and the agricultural heritage and character of the community. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for one existing structure located in the front yard, two existing structures located in the side yard and one proposed structure (swimming pool) to be located in the side yard. However, three of the structures are pre-existing, and the proposed pool is set back over 150 feet from the road and is not visible from any neighboring homes. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and to enable the applicant to enjoy the benefit of a new residence and an accessory garage, accessory chicken coop, accessory frame barn and accessory inground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman (Chairperson), seconded by Member Planamento, and duly carried, to GRANT the variances as applied for, and shown on the site plan (Page S2) prepared by John J. Condon, LPE, dated October 2, 2017 based upon a survey prepared by John Ehlers, L.S., dated August 24, 2016, and building plans(Pages Al-A4), prepared by West Creek Builders; LLC., dated November 1, 2017; SUBJECT TO THE FOLLOWING CONDITIONS: 1. Applicant is to receive and submit to the ZBA, Pre Certificate of Occupancy on all existing accessory structures on the subject property, including the frame garage, frame chicken coop, frame barn and frame shed prior to issuance of Town Building Permit to demolish the existing residential structure and issuance of a Town Building Permit to construct proposed single family residence and pool. 2. Drywell for pool de-watering shall be installed. 3. Pool mechanicals shall be placed in a sound deadening enclosure. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted.
