He has reviewed all of the information and has concluded that based on the permit date, contractors paperwork and payment receipt the system was installed in 1989 in conjunction with the building permit filed with the town and then upon inspection a Certificate of Occupancy was issued by the town as per town procedure. He has informed me that it is not within his license to issue any statement detailing when the system was installed. He can only base his statement on his April 2015 inspection and since he was not present during the original construction in 1989 can not certify the construction date. He can only certify that the system is in proper operating condition with no issues for its intended purpose when he inspected it in April 2015. I request that the documentation be reviewed again as a whole to resolve this issue. Gary Fish who was the inspector of the property and signed the Certificate of Occupancy may be able to resolve some of the questions. The letter states that all additions or changes to cesspool systems starting in 2003 were to be inspected by the Board of Health. Before that they were inspected by the town only requiring no Board of Health approval. The town had full jurisdiction thereby issuing the certificate of occupancy upon meeting required code followed by inspection. That is why on the Certificate of Occupancy it lists NA on the Board of Health line. Therefore the Board of Health would not have any records from 1989. In speaking to the wife of Kenneth.S Miller (he passed away.in 1994) who did the cesspool upgrade she states that Kenneth worked closely with Gary J Fish who inspected his projects. Gary J Fish was the town inspector at the time and signed our certificate of occupancy upon completion of all inspections. Possibly he might be available for further information.
