Dear Mr. Cowan:
The Southold Town Trustees are in receipt of your November 27,
1991 letter to Assemblyman Joseph Sawicki, Jr. in reference to
the A1 Koke tidal wetland application UPA 10-89-1465.
Since you state this project as proposed will impinge on your
department's tidal wetland land use regulations and to the
extent that additional delays may negatively affect the wetlands
of the Town of Southold, we respectfully request that you or the
regional permit administrator walk the site and surrounding area
with us as soon as possible in an attempt to obviate the need
for a tidal wetlands hearing and the additional time delay
commensurate with that process.
Absent any real possibility of your office(s) directing the
appropriate executive approval of this proposal as now before
you, we specifically request you expedite the adjudicatory
process in this matter so that a decision can be rendered prior
to another storm further undermining the existing wetlands and
natural protective features of this creek system.

Whereas Hurricane "Bob" has devastated Southold and all of
Eastern Long Island;
Whereas beach was lost and an inlet started to form breaching a
certain barrier beach commonly referred to as the Jockey Creek
Spoil Island, Southold;
Whereas this area has sustained damage from preceding storms
"Gloria" in 1985 and "Nelson" in 1986;
Whereas this spoil area provides substantial protection to Town
and Jockey Creeks eliminating or minimizing the need for
undesirable bulkheading in these creeks;
Whereas as this spoil area, when it was an Island, was the site
of Colonial Shorebird nesting;
Whereas this site in its historical state contained substantial
vegetated wetlands on the creek side;
Whereas these wetlands and nearly all in Town and Jockey Creeks
will be increasingly threatened from storm tides and winds in
the future;
Whereas publicly owned structures
groins along this beach are fully
and wave;
in the form of bulkheads and
exposed to the effects of wind
Whereas pending before the New York State Department of
Environmental Conservation are applications for wetland permits
which could restore this Island at no additional cost to the
taxpayers of this Town, County and State;
Whereas the proposed projects will improve access to the newly
rebuilt Town boat ramp at Pine Neck Road and could re-create a
true island for conservation of colonial shorebirds;
Therefore be it RESOLVED that the Southol~ Town Trustees pray
that the Department of Environmental Conservation reverse its
long standing obstruction to granting permits for the
Cornacchia and Koke (DEC 10-89-1465) wetland applications;
And be it further RESOLVED that the Trustees are encouraged by
the State Department of Environmental Conservation granting an
emergencyperm±t to the Orient Point State Park for nearly the
same reasons as we have herein and previously outlined. (copy of
Newsday article of-August 30, 1991 and past communications)
And be it further RESOLVED that the substantial public benefit
to accrue from protecting Town and Jockey Creek wetlands be
taken into account by the State Department of Environmental
Conservation, such that an expeditious granting of these permits
willaffirm the principle of equal environmental protection
under the law; that~permits are not solely for the subdivision
of State Parks but for the Towns and their citizens as well;
And be it further RESOLVED that the Trustees shall proceed as a
party of interest in this matter until justice is served and
that the State Department of Environmental Conservation be duly
warned that should any failure on its part to promptly remedy
this situation cause damage to the property or persons of this
Town that the Trustees shall hold the Department of
Environmental Conservation and its employees responsible.

Dear Mr. Koetzner:
With respect to your letter of 7/12/90 concerning the dredging
of the Jockey Creek Spur (Al Koke project), it is heartening
to hear that public safety may be considered in your agency's
decision-making process. Unfortunately, to date the Southold
Trustees have not been kept abreast of your determination in
this matter as requested in that letter.
As a direct consequence of this protracted review by your
agency, the Trustees and Town Highway Superintendent have had to
restrict boat access to the popular public launching ramp there.
A further insult to the public interest in delaying this project
is the fact that no taxpayer dollars will have to go into
fortifying the barrier "island'" ar the entrance to Town and
Jockey Creeks. Fortification of this spit of land will not only
protect the vegetated wetlands inside these creeks, but may even
result in renewed plover and tern nesting habitat.

Dear Mr. Wieland:
I recently received a copy of your June 28, 1990 letter to John
Guldi and wish to clarify that the Town Trustees' letters of
11/20/89 and 3/22/90 in reference to the A1 Koke and above
referenced SCDPW dredge spoil site may have been
mis-interpreted to mean that we oppese re-filling of the area
between the groins at the entrance to Town and Jockey Creek.
This is absolutely not the case! Not only are properties
inside Jockey Creek-~ffering from the loss of this barrier
beach, but only this last week one of the exposed "bulkhead
groins" became the focal point of a boating accident when some
~poor judgement was applied to this area by youthful boaters.

Dear Mr. Koetzner:
Per my conversation with you last month regarding the A1 Koke
dredge application, I thought the enclosed police report might
help expedite the permit process in this matter.
You may recall we discussed how the project was going to help
Southold Town by replacing lost "barrier island" protection at
the entrance of Town and Jockey Creeks in addition to providing
improved access to our recently reconstructed public boat
launching ramp there. You might also recall my offer of help
from the Town and our request that the Town and applican= be
informed of exactly what remains to be done to approve an
amended tidal wetlands permit for the site.
I am no longer in a position to offer assistance, but urge your
prompt intercession in this matter. As the enclosed police
report indicates, a young person was injured at one of the
groins (bulkhead) we requested be refilled with dredge spoil
(sand). Apparently the Trustees preferred spoil area is awash
at high tide and became the focus of some poor boater judgement.
Although hind sight is always 20/20 (or better), it seems a
shame we now find ourselves with a nearly useless, potentially
dangerous boat ramp and a needlessly head injured young person.
All this when reasonable permit issuance by your agency would
have the project completed several months ago.
I hope appropriate executive authority can be exercised by your
agency so that this project proceeds post haste.

Dear Chuck Hamilton:
Regarding the pending application of A1 Koke, and per my
conversation with George Stadnick on March 21, 1990, I have
taken the opportunity to re-visit our Town Trustee file and
permit issued in 1989 in the above-referenced matter.
I believe the Trustees' vague references to the spoils site
(copies of permits enclosed), largely stem from fairly universal
Trustee familiarity with a much larger, higher, "island" in this
location and its historic role in protecting the entrance of
Town and Jockey Creeks.
As a result, we had no problem with spoils desposition on the
bea6h in that area. Although we did not have a concern for the
dredging causing a secondary silting-in impact on the entry to
Town and Jockey Creeks, I must agree this may have been short
sighted. This coupled with the fact we have a pending
bulkhead/retaining wall application for Mr. Carl Vail inside
Jockey Creek ,(predicated upon the lack of the "island" blocking
the fetch from Southold Bay), leads me to think a meeting of
all concerned on site as soon as possible would be beneficial.
-I could be available at 8:00 AM most Wednesdays, Thursdays,
Fridays. If this is agreeable, please contact the Trustee
Office so I may notify the members of the Board and the
applicant.

Dear Mr. Hamilton:
The Trustees would~-like your agency to consider, again, the
possibility of using the spoil from the maintenance dredging
project of A1 Koke, to create a dune.
Presently, your agency has recommended that it be deposited on
the beach. The Trustees feel that depositing it on the island
near the storm breach and planting with beach grass to
stabilize the dune, is a better long-term solution.
We look forward to your comments and will be available to meet
with you at the site, which is located on public ramp at the
end of Pine Neck Road, Southold, NY.
