In the evem that such a;~proval is necessary, the holder of this permit shall not commenc~ operations here- under until such approval has been obtained in writing. The failure to obtain such other approval' when required' shall subiect this permit, to immediate revocation by the Trustees~ upon receipt by the Trustees- from governmental 'or municipal author[ties of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take ail precautions for the prevention of injuries to persons and uroperty resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by ~is oermit are being conducted, do, by the acceptance of this permit, give consent to the Town, and ~ts officers and employees to enter upon the premises where such operatic qs are betn~, conducted To make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. Thi~ operation will not substantially: A. Adversely affect the wetlands of the town. B, Cause damage from erosion, turbidity or siltation. C, Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navi§ation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of an*/waters. H. Haje, President En-Consulfants, Inc. 1329 North Sea Road Southampton, New York 11968 Re: Alexander Koke - Application No. 531 Dear Mr. Haje: The following action was taken by the Board of Town Trustees during their regular meeting held on July 27, 1987 regarding the above matter. WHEREAS, Eh-consultants, Inc. on behalf of Alexander Koke applied ;o the Sottthold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 1, 1987, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public heai'ing was held by the Town Trustees with respect to said application on July 27, 1987 at which time all interested persons were given an opportunity to be heard, and no objections were raised, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered ail the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will -. not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Eh-Consultants, Inc. on behalf of Alexander Koke BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: To construct a house, pool, sanitary ~ystem, bluestone driveway, extension of berm parallel to bulkhead and approximately 40' from it. To fill with 3500 cu. yds. of fill. To construct a timber dock off the bulkhead consisting of a 4' x 4~ platform, 3' x 16' hinged ramp, (3) 6' x 20~ floats secured by (4) 8" pilings on the inside. Property is located on Pine Neck and North Bayvie;v Road, Southold. Board of Trustees - Page 2. Alexander Koke This permit will expire on July 27, 1989 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability ~nsurance policies insuring against any liability which may ar~se in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees. which said policies shall name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. RESOLVED that the Southold Town Trustees WAIVER the need of a Wetland Permit for the placement of the 3500 cu. yds. of fill for the construction of a berm on property located on Pine Neck Road and North Bayview Road, Southold. The berm is to be constructed with a slight swale to prevent any run off into the water and it is to be vegetated before the winter. The following recommendations were made at that meeting: No. 527 - Mr. and Mrs. John Lang - Recommend approval with the stipula- tion that applicant does not distub the natural vegetation (spartina wetland). No. 528 - Mr. and Mrs. Alan Watson - Recommend approval. No. 529 - Hide-A-Way Boat Basin- Recommend approval. No. 530 - West Lake Association - Recommend approval. No. 531 - AleXander Koke - Recommend approval of the berm and filling. No. 532 - Gardiners Bay Property Owners Association - Recommend approval. No. 533 -Yan H. Rieger - Recommend approval. No. 534 - Peter Fakiris - Recommend approval of the dock but disapprove of the bulkheading. The CAC suggests applicant extends the ramp from the base of the dock up further and that would eliminate the need for the bulkheading. The CAC does not approve of the bulkhead because there are no other bulkheads in the area and the bulkhead would x~reate erosion problems. No. 536 - John C.W. Campbell - Recommend approval with the stipulation that a 50' natural vegetation buffer be maintained between the house and bulkheading. No. 510- James E. Fitzgerald Jr., Pres., Broadwaters Cove Association, Inc. Recommend approval. No. 522 - Michael S. Gillilund - Recommend approval with the stipulation that it be mandatory that applicant does not disturb the natural vegetation buffer between the house and bluff.
