Krupski, Jr. President, Board. of Trustees June 27, 1994 Resolution to the Department of Transportation The following Resolution was approved by the Board of Trustees on June 23, 1994: WHEREAS, the Trustees of the Town of Southold have been involved in the protection and regulation of the Town's wetlands for over three years, WHEP~EAS, non-point source storm water runoff has been identified as a major contributor to water pollution, WHEREAS, the recreational and economic values of the wetlands and creeks has been well established, WHEREAS, almost all of the creeks in the Town of Southold have been seasonally or permanently close~ to shellfishing, RESOLVED, that the Southold Town Trustees applaud every and all efforts on the part of the New York State Department of Transportation to mitigate storm water r~neff from state roads into the waters of the Town of Southold. The quality of the Town'S creeks have always been a major concern of the Town Trustees and we would greatly appreciate any time, money and effort that the Department of Transportation could provide in improving the environmental quality of the Town's waters. Jorling Commissioner Based on the information you have submitted, the New York State Department of Environmental Conservation has determined that: Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYC~ Part 661) no pe~it is re.ired under the Tidal Wetlands Act Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a pe~it. It is your responsibility to ensure tha~ all necessary precautions are taken to preven~ any sedimentation-or other alteration or disturbance ~o the ground surface or veqetation within Tidal Wetlands jurisdiction which may result from yo~ project. Such precautions may include maintainzng ade~ate work area between the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 20' wide const~ctlon area) or erectinq a temporary fence, barrier, or hay bale be~. The following terms when used in this Part shall have the following meanings: (a) "Act" shall mean the Tidal Wetlands Act (Article 25 of the environmental conservation law as from time to time amended). (b) (1) "Adjacent area" shall mean any land immediately adjacent to a tidal wetland within whichever of the following limits is closest to the most landward tidal wetland boundary, as such most landward tidal wetlands boundary is shown on an inventory map (see explanatory figures 1-6]: ~(i) 300 feet landward of said most landward boundary of a tidal wetland, provided, however, that within the boundaries of the city of New York this distance shall be 150 feet (see figure 1); or · ' (iX) t_po the seaward edge of the closest '.~ // lawfully and presently existing Ci.~-- ~ of Au~Ust~0, ~977), fu~nctZonal and s~stant~al m%n~mado structure (including, but not limited to, paved streets and highways, railroads, bulkheads and sea walls, and rip-rap walls) which lies generally parallel to said most tandward tidal wetland boundary and which is a minimum 0'f 100 feet in length as measured generally parallel to such most landward boundary, but not including individual buildings (see figure 2); or (iii) to the elevation contour of 10 feet above mean sea level, except when such contour crosses the seaward face of a bluff or cliff, or crosses a hill on which the slope equals or exceeds the natural angle of rgpose of the soil, then to the topographic crest of such bluff, %
