Chairman Wilcenski: Good afternoon and welcome to the January 22, 2018, Planning
Board Special Meeting.
SUBDIVISIONS
Re-issuance of Final Plat Determination:
Chairman Wilcenski: Noone, Margaret- This proposal is for a 2-lot Standard
Subdivision of a 21,016 sq. ft. parcel where Lot 1 = 10,501 sq. ft. and Lot 2 = 10,515 sq.
ft. in the R-40 & B Zoning Districts. The property is located at 210 Sigsbee Road, on the
west side of Sigsbee Road, 164' south of Main Road, in Mattituck. SCTM#1000-143-1-
4.1
Martin Sidor:
WHEREAS, this proposal is for a standard 2-lot subdivision of a 21,000 sq. ft. parcel
where Lot 1 = 10,501 sq. ft. and Lot 2 = 10,500 sq. ft. in the R-40 & B Zoning Districts;
and
WHEREAS, on November 6, 2017, the Southold Town Planning Board granted Final
Plat Approval upon the map entitled "Standard Subdivision Final Plat Prepared for
Southold Town Planning Board Page 12 January 22, 2018
Margaret A. & Thomas E. Noone" dated March 27, 2009 and last revised April 27, 2017,
prepared by Nathan Taft Corwin III, Land Surveyor, and authorizes the Chairman to
endorse the map; and
WHEREAS, the applicant was not able to obtain the title certification required for the
map to be filed with the Suffolk County Clerk's Office within the 62 day filing period; and
WHEREAS, the 62 day regulatory filing period has since expired; therefore be it
RESOLVED, that the Southold Town Planning Board grants Final Plat Approval upon
the map entitled "Standard Subdivision Final Plat Prepared for Margaret A. & Thomas
E. Noone" dated March 27, 2009 and last revised April 27, 2017, prepared by Nathan
Taft Corwin III, Land Surveyor, and authorizes the Chairman to endorse the map.

Chairman Wilcenski: Motion made by Martin, seconded by Jim. Any discussion? All in

PUBLIC HEARINGS
Chairman Wilcenski: 5:01 p.m. — Ovsianik, Allen —This proposed Lot Line
Modification transfers 0.4 acres from SCTM#1000-97-2-16.5 to SCTM#1000-97-2-15.
Lot 15 will increase in size from 0.3 acres to 0.7 acres and Lot 16.5 will decrease from
1.5 acres to 1.1 acres located in the R-80 and B Zones. The property is located at 225
Eugenes Road, in Cutchogue. SCTM#1000-97-2-15 & 16.5
Chairman Wilcenski: At this time I would like to ask anyone from the audience that
would like to address the Board on Ovsianik Lot Line Modification please step to one of
the podiums, state your name, write your name and address your comments to the
board.
Chris Storm: My name is Chris Storm and I live on 375 Eugenes Road, now why does
he want to- is the building on the two pieces of property?
Chairman Wilcenski: I'm sorry?

Chris Storm: Is the big storage building on the two pieces of property, is that why he
wants to-
Chairman Wilcenski: Yes, this is something that happened many, many years ago, it
was in a split zone and there was a building permit issued-
Chris Storm: It shouldn't have been?
Chairman Wilcenski: Right, correct, and it was between, the property line goes right
between the building and this is to rectify that.
Chris Storm: Let me ask you a question, has he been asked numerous times to clean
up the other lot, where he switched, where he planted those Christmas trees that he
was going to do. I've called the town for a year now and a couple other neighbors have
as well, he was supposed to clean that lot. It's only zoned for agricultural, I would
assume. He's got trucks, trailers, there is a broken down van 3 feet from my property
line and he hasn't done anything about that. So why should you grant him this zone
change when he's blatantly disregarded everything the Town has said for that property.
He cleared, first off he cleared that lot without permission the first time, he put a wood
fence up and that all fell down on my property and is just lying there. He's been asked
numerous times to clean that lot, he's got trailers, boats you name it, its junk, and he
hasn't done anything about it so why should the Town switch the piece of property to
benefit him, to sell that business when the building shouldn't have been put on that
piece of property to begin with?
Chairman Wilcenski: Well that's a very good point, and that's the first we're hearing of
this, to be quite honest with you.
Chris Storm: You've never heard of any complaints on this property?
Chairman Wilcenski: Well some, but not to the extent of this, that is why we are having
the Public Hearing.
Chris Storm: Superintendent Gamberg has complained numerous times too.
Chairman Wilcenski: I'm not disagreeing with you.
Chris Storm: The piece of property is horrible, there is junk everywhere, there is a
broken down van and you can see if from my window at my house and there are people
just hanging out there at night. I think he should rectify that before he gets any special
treatment from the Board to fix a problem. All he wants to do is sell that building, if you
give him permission to do that now, do you honestly think he's going to do anything
about all the other stuff? Not a chance, make him come up to code before you let him
switch that piece of property over.
Chairman Wilcenski: Fair point. Again, we will make referrals to Code Enforcement.

Chris Storm: I've called a bunch of times and no one has ever gotten back to me.
Supposedly I was told that place was supposed to be cleaned up by August, well its
January now and nothing has been done.
Chairman Wilcenski: Okay, we will make sure that we make contact. The only means
we have is code enforcement.
Chris Storm: Yes, but my thing is; should he get special treatment and get this
approved before he takes care of what he was supposed to take of?
Chairman Wilcenski: No, I agree with you, I agree 100 percent and will make sure that
we get some activity and get some action done.
Chris Storm: The fence he put up when he cleared that lot to begin with all fell down,
it's on my property, it's just lying there, he hasn't done anything. I mean, I don't even
know if he lives in this town, does he?
Chairman Wilcenski: I have no idea, but I will definitely make sure to follow up, we'll
have staff follow up and I personally will follow up with the applicant's attorney.
Chris Storm: There are probably 3 or 4 trailers, a boat, a bunch of junk cars, storage
containers, a van, the whole place is just- I can't see how he should get what he wants
when he hasn't taken care of his responsibilities to begin with.
Chairman Wilcenski: Very fair point.
Chris Storm: That's it.
Chairman Wilcenski: Thank you, will you just sign your name and write your name for
the record? Would anybody else like to address the Board on Ovsianik? Anyone have
any other comments? Seeing and hearing none.
