RESOLVED that the Southold Town Board of Trustees approved the
~equest for amendment to permit ~3929 to reduce the deck and
reconfigure plan within foot print as per plan dated April 30,
1993 and approved by DEC. Also to extend this permit to expire
on July 21, 1994.

part of the consideration for the issuance of the Pemdt does understand and prescribe m the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Petmittee will, at his or her own expense,
defend any and all such suits initiated by thinl parties, and the said Permittee assumes full liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 2 4 mos. which is considered to be the
estimated time required to complete the work involved, but should ciro~m~rances warrant, request
for an extension may be made to the Board at a later dat~
3. That this Permit should be retained indefinitely, or as long as the said Permitme wishes
4. That .the work involved will be subiect to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, ma7 be cause for
revocanon of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and Iow water marks.
7. That if future operations of the Town of Southold requite the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Tmatees, the
work shall cause unreasonable obstmmon to free navigation, the said Permittee will be requital,
upon due notice, to remove or alter this work or proiect herein stated without expenses to the Town
of Southold.
8. That the said Board will be notifled by the Permittee ot the completion of the work auth-
orized.
9. That the Permittee will obtain all other permits and consents ,that may be required
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Mr. Klein:
The Southold Town Trustees in granting a wetland approval for
your property on East Legion Road were most pleased to see a lot
merger with a well thought out low impact landscaping plano
However, the Board and Conservation Advisory Council are most
concerned that the existing sanitary system be upgraded and
located a maximum distance from the creek. Although not
specifically requiring a new system in your wetland permit,
Trustees would highly recommend you contact the Suffolk County
Health Department for the information on what would be required
to upgrade your sanitary system. Typically the sanitary system
you now have has a limited life-span and you may wish to install
a new one to avoid future damage to your landscaping.

On behalf of my client, James E. Klein, I am requesting a modification of permit
#3929. The enclosed site plan illustrates the proposed change in the footprint of
the building. Except for the steps no grade on the north side of the deck, the
structure will non be ~ny closer to the wetlands than it is on the approved site
plan.
I believe that the permit expires on July 12, 1993 Is it possible to extend the
deadline for completion? If-so, please consider this letter a requesn for such an
extension.

Dear Ms. Lachenmeyer:
The following action was taken by the Board of Town Trustees during
its regular meeting held on July 11, 1991 regarding the above matter:
WHEREAS, LAN-DUSE COMPANY ON BEHALF OF JAMES KLEIN applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated May 23,
1991 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on July 11, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS~ the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREA~, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT LAND USE COMPANY ON BEHALF OF JAMES KLEIN BE AND HEREBY
IS GRA~.~ED PERMISSION UNDER THE WETLAND ORDINANCE TO: Combine two
pre-exi~ting, single and separate residential building plots in
order t~ expand existing dwelling. Expansion will include 30' X 40'
living ~rea and 10' X 60' dec~. A 110' timber retaining wall and 20'
retaining wall will be back filled with 500 c.y. clean material to
match existing grade at road and on east property line.
Deck/dwelling will be located 50' landward of TWL line.
This permit will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months
of the date of this notification. Two inspections are required and
the Trustees are to be notified upon completion of said proj~ect.
Please returnto the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to
be done below Mean High Water Mark:
No fees due.

RESOVI-ED to recommend to the Southold Town Trustees disapproval of
Wetland ApplicatiOn No~104-7-7 of Paolo Lavagetto to construct a timber
cock consisting of a 4' x 130' fixed elevated (max. 3.5' above g~ade~
wa k with r~ml~eCl up landward end; 4' x 14' hinged ramp; two 6J ~x 20'
floats secured'by three pilings. The CAC recommends.disapproval
becat~se the project is oversized for the location. The CAC suggests the
a~p!icant get accurate soundings. The Council believes that the soundings
would shdw that if applicant moved ~he catwalk as far to. the west as
possible the applicant would reach a deeper area faster. The CAC
~ug§ests the ~plicant shorten the catwalk so it does not extend
further out than the neighboring docks. Also the walk s~ould be
eleYated at leas~ 4' above grade.

existing dwelling. Expansion to include 30' x 40' living area and 10' x

east property line. Deck/dwelling will be located 50' landward of TWL line.
Applicant also proposes to install a vegetative buffer of native upland
shrubs between the TWL line and timber retaining wall. Shrubs the
