Trustees on Thursday, January 27, 1994.
RESOLVED that the Southotd Town Board of Trustees denies the
request for an extension on permit 93822 due to the fact that~
this permit has been expired since April 26, 1992.

required.

we would like to apply for an extension for the
wet lands permit ~ 3822 which expired April 26, 1992.
It was applied for by Gall Schlegel who intended
to purchase this property back in 1990. Do to
clrcumstamces they could not do so.
The permit was for Dist. 1000, Sec. 53. Block 5.
Lot 12.2.
Enclosed is a check for ~10.00 for the extension
permit.

TERMS and CONDITIONS

parr of the conslderadoa for the issuance of the Permit does understand and proscribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are relmsed frtma any anti
all damages, or claims for d~mages, of suits arising directly or indirectly as a reanlt of any oper-
ation performed purmant to this permit, and the said Permlttee wiil, at his or her own
defend any and all such suits initiated by third parties, and the said Permittee resurges full llability
with respect thereto, ro the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 2 4 mos. which is considered to be the
estimated time required ro complete the work involved, but should circumstances warfare, request
for an extension may be made to the Board ar a later date.
5. That this Permi~ should be retained indefinitely, or as long as the said Permi~cee wi~h~
to maintain the structure or project involved, to provide evidence to anyone concerned that anth-
orization was originally obtained.
4. That .the work involved will be subject to the inspection and approval of the Board or
irs agents, and non-compliance with the provisions of the orlginaling appllcatio~ may be e~,,~e for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the
herein authorized.
6. That there shall he nc interference with the right of the public to pass and repass along
the beach benveen high and low water marks.
7. That ff fuVare operations of the Town of Southold require the removal and/or aiteretiom
in the location of the work herein authorized, or if, in the o[finlan of the Board of Trustees, time
work shall cause unreasonable obstraclaon to free navigation, the said Permittee will be req~x~
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permlttee or the completion of the work anl~-
orized.
9. That the Permittre will obtain all other permits and consents .th,at may he reqnio.~l sup-
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Mr. Bowman:
The following action was taken by the Board of Town Trustees during
its regular meeting held on April 25, 1990 regarding the above
matter:
WHEREAS, Land Use IN BEHALF OF Gail Schlegal applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated January
31, 1990 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on April 25, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surroundinq area, and,
WHEREAS, the Board has considered all the testim6ny and documentation
submitted concerning this application, and,
-WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT LAND USE IN BEHALF OF GAIL SCHLEGAL BE AND HEREBY IS
GP~NTED~ PERMISSION UNDER THE WETLAND ORDINANCE TO: reconstruct
existing single family dwelling and expand to 35' X 41' envelope with
attached 12 X 24' timber deck and 6' X 12' stairway; solid fill pier
and boat ramp. CONDITION: Dry wells must be used to retain roof
runoff.
This permit will expire two years from the date it is signed if work
has not commenced by said date. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification, Two inspections are required and the Trustees ~r~ to
be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to

Re: Recommendations
The following recommendations were made by the CAC at its meeting
held Monday, March 19, 1990:
On a motion by Bruce Loucka, seconded by Margaret Feeney it
was
RESOLVED to recommend to the Southold Town Trustees APPROVAL
WITH STIPULATIONS of Wetland Application No. 1-18-90-53-5-12.2
submitted by Gail Schlegel to reconstruct an existing single
family dwelling, solid fill pier, and boat ramp. After recon-
struction, removal of concrete surfacing and installation of
native seaside planting. The CAC approves with the stipulation
that all runoff is contained on property: no runoff from house,
driveway or boat ramp (suggest drywells); hay bales and filter
cloth be used during construction; the concrete debris be removed
from the parcel; and no lawn within 75' of wetlands.
