The time you took to accompany me and my colleagues from the Department of. Environmental Conservation and the U.S.Army Corps of Engineers as we observed the current condition of the beach and structures in the Hashamomuck Cove area of the Long Island Sound shoreline is appreciated. During our visit to your property, we noted that some components of the existing bulkheading sustained damage from the January 4, 2018 storm. Existing stringers failed in one or,more locations and portions of several existing pilings have been eroded/. worn to the point that their structural integrity is in question. We have determined, pursuant to 6 NYCRR Part 661.5(b)(21) [Tidal Wetlands Land Use Regulations]that the repair of up to 25 feet of the existing stringers and the replacement of up to five-(5)worn pilings at'various locations on the existing bulkhead at the referenced property is an activity classified as the ordinary maintenance or repair of an existing, functional structure. As such, these repairs do not require a Tidal Wetland's permit from DEC.
