THIS CERTIFIES that the removal and replacement in-place of approximately 194 linear feet
of existing timber bulkhead with vinyl bulkhead,• remove and replace in-place existing f8' and±19'
timber bulkhead returns with vinyl returns and backfill with approximately 25 cubic yards of clean sandy
fill to be trucked in from an approved upland source,• reconstruct in-kind/in-place existing 2'x3' steps to
grade-, construct a 10'x12' on-grade wood deck using untreated decking; install t8 linear feet of stepping
stones to existing dock; and to establish and perpetually maintain a 8'-10' wide non-turf buffer along the
landward edge of the reconstructed bulkhead;with the condition of the use of a silt boom during
construction and the revegetation of any disturbed areas seaward of the new construction with spartina
altemaflora;

Conforms to the application for a Trustees Permit heretofore filed in this
office Dated December 11,2017 pursuant to which Trustees Wetland Permit#9150
Dated January 17, 2018,was issued and-conforms to all of the
requirements and conditions of the applicable provisions of law. The project
for which this certificate is being issued is for removal and replacement in-place of approximately 194
linear feet of existing timber bulkhead with vipyf bulkhead;remove and replace in-place existing f8' and
f 19' timber bulkhead returns with vinyl returns and backfill with approximately 25 cubic yards of clean

TERMS AND CONDITIONS
i
The Permittee Norman Parton&Ellie Becker,residing;at 1920 Minnehaha Boulevard, Southold,
New York as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
I
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages,of suits arising directly or indirectly as a result of any j
operation performed pursuant to this permit,and the said Permittee will,at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized,or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required, ;
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been'
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit,which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Sir/Madam:
The undersigned is the owner of the above-referenced property.As such I requesting a site visit
to the property to determine what plants may be removed from the property and whether any
permits are required for such removal.I am granting the Trustees permission to enter the
property for the purpose of making such determination.The specific area on the property in
question is the section of the property to the right of the shed in the backyard.
I am available to meet the trustee on Monday December 3rd in the morning,if possible,
Otherwise I consent for Jack Weiskopf to meet with the trustee at the time of the visit or for the
trustee to speak to Mr.Weiskopf via telephone to discuss this matter.
We are currently nearing the completion of a bulkhead replacement project and we would like to
do some landscaping beyond the buffer in our lawn area while the equipment is still located on
the property and want to make sure we do it correctly,so if this visit can be arranged for
December 3rd or as soon thereafter as possible it would be greatly appreciated.
The$50 check has been sent separately by mail.

TERMS AND CONDITI6",.o
The Permittee Norman Parton &Ellie Becker residing at 1920 Minnehaha Boulevard, Southold,
New York as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice, to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, January 17, 2018 regarding the above matter:
WHEREAS, En-Consultants on behalf of NORMAN PARTON & ELLIE BECKER, applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated December 11, 2017,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 17, 2018, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally,viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of NORMAN PARTON &
ELLIE BECKER to remove and replace in-place approximately 194 linear feet of existing timber
bulkhead with vinyl bulkhead; remove and replace in-place existing t8' and t19' timber
bulkhead returns with vinyl returns, and backfill with approximately 25 cubic yards of clean
sandy fill to be trucked in from an approved upland source; reconstruct in-kind/in-place existing
2'x3' steps to grade; construct a 10'x12' on-grade wood deck using untreated decking; install t8

En-Consultants on behalf of NORMAN PARTON & ELLIE BECKER request a Wetland Permit to
remove and replace in-place approximately 194 linear feet of existing timber bulkhead with vinyl
bulkhead; remove and replace in-place existing ±8' and ±19' timber bulkhead returns with vinyl
returns, and backfill with approximately 25 cubic yards of clean sandy fill to be trucked in from an
approved upland source; reconstruct in-kind/in-place existing 2'x3' steps to grade; construct a
10'x12' on-grade wood deck using untreated decking; install ±8 linear feet of stepping stones to
existing dock, and to establish and perpetually maintain a 8'-10' wide non-turf buffer along the
landward edge of the reconstructed bulkhead. Located: 1920 Minnehaha Boulevard, Southold.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is CONSISTENT with the below listed'Policy Standards and therefore is CONSISTENT
with the LWRP provided that:
1. To further Policy 6, protect indigenous vegetation during construction.
In the event the action is approved the following is required.
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:
(2) Erosion control. Installation of an erosion control structure is necessary during
any building, grading, landscaping or site work activity within Trustee jurisdiction.... All
intertidal construction and excavation requires the installation of a silt boom that
will retain all suspended sediments within the immediate project area.

Require the installation of a silt boom in areas where practicable.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by
reason of such proposed operations (use attachments if appropriate):
Either by the original cinder block seawall or the subsequently constructed timber bulkheading(see Town Wetlands
Permits 204& 1942),the subject property has been retained and protected from flooding and erosion by bulkheading since
prior to 1977. There is no viable non-structural alternative means of maintaining and protecting the upland portion of the
property in its current location,so without the replacement and maintenance of the bulkhead,the subject property and
structures located thereon would be exposed to severe flooding and erosion damage. The project provides the ecological
benefits associated with replacing a treated timber bulkhead with untreated vinyl sheathing;and the on-grade deck
proposed on the landward side of the new bulkhead would be constructed with untreated wood decking. And to reduce the
lawn area adjacent to Corey Creek and increase the on-site absorption of stormwater runoff and the potential contaminants
contained therein,a 8'to 10'wide,approximately 1,675 sf,non-turf buffer will be established adjacent to the reconstructed
bulkhead. Therefore,the project will effectively maintain the historically existing conditions along the shoreline without
causing any significant adverse effects to the adjacent tidal wetland vegetation or tidal waters of Corey Creek.

assessment is intended to supplement other information used by a Town of Southold agency in
