Board Room A meeting of the Southold Town Conservation Advisory Council was held Wed., January 10, 2018 in the Town Hall Annex Executive Board Room. Present were: Peter Young, Chairman Peter Meeker, Member John Stein, Member Caroline Burghardt, Member James Abbott, Member James Dinizio, Town Board Liaison Lauren Standish, Secretary Absent: Keith McCamy, Member CALL TO ORDER The meeting was called to order at 4:35PM by Chairman Peter Young. PLEDGE OF ALLEGIANCE CHAIRMAN'S ANNOUNCEMENTS Chairman Peter Young began the meeting with a continued discussion on the re-direction of the CAC. REPORTS John Stein attended the Board of Trustees meeting held on December 13, 2017. Southold Sunsets was Tabled due to no LWRP, Wieczorek was Approved with a raised grade for 2 the pool, Barnes was Tabled and Petrowski was Approved with an Inconsistent LWRP report. NEW BUSINESS Peter Young asked that all budget requests for 2019 be submitted to him for consideration by the Town Board. Councilman Jim Dinizio requested that meeting agendas be posted on the town's website at least one week prior to the meeting. Peter Meeker requested an end-of year report and a copy of the 2018 Budget. APPROVAL OF MINUTES Moved by John Stein, seconded by Caroline Burghardt, to Approve the Minutes of December 6, 2018. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of JAMES BAUMANN & PATRICA PERRY for the removal and replacement of existing bulkhead with 106 If. new vinyl bulkhead and two 6' If long bulkhead returns. Raise existing height 12" above existing top cap elevation and maintain existing previously permitted non-turf buffer area. Remove existing fixed platform, ramp and floating dock and install new 6'X 17' fixed platform, 3'X 16' aluminum ramp and 6'X 40' floating dock with un-treated decking supported by three 10" dia. CCA piles. Located: 1625 Gull Pond Lane, Greenport. SCTM#35-4-13 Inspected by: John Stein, Peter Meeker The CAC Supports the application, however, questions the use of CCA piles in the water. Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by John Stein, it was RESOLVED to SUPPORT the application of VINCENT & DONNA DALEY to construct a swimming pool 480 sf., patio 475 sf., pool equipment and pool drywell. Pool/patio with be a min. of 4' above grade. Located: 135 Hill Rd., Southold. SCTM#70-4-32 Inspected by: John Stein, Peter Meeker Vote of Council: Ayes: All Motion Carried f J 3 Moved by John Stein, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of JOSEPH, MICHAEL, ROBERT & PATRICIA ZEVITS to construct 100' of new retaining wall with a 16' north and south returns. Fill void areas landward of new retaining wall with clean trucked-in fill (approx. 140 cy.) and regrade area. Provide a 25' non-turf buffer and construct a 5'X 5' platform extension between retaining wall and existing dock. Located: 1945 Little Peconic Bay Lane, Southold. SCTM#90-1-13 Inspected by: John Stein, Peter Meeker The CAC Supports the application with a recommendation the location of the retaining wall is depicted on the survey. Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by John Stein, it was RESOLVED to SUPPORT the application of COVE CONDOMINIUMS OWNERS ASSOC. to maintenance dredge to 3' below MLW approx. 82 cy. from channel at entrance of Association docking area and as needed, within.the docking area; dredge as necessary in the same areas to maintain width, depth and full accessibility of entrance channel and docking area on a max. of four additional occasions during the next ten (10 years); spoil will be removed to an approved upland location for deposition. Remove approx. 145' of existing wood bulkhead and construct new bulkhead with two (2) 8' returns on both ends for a total new length of approx. 161'. Remove approx. 180' of existing wood bulkhead and construct new bulkhead with .two (2) returns, 12' on the north end and 8' on the south end for a total new length of approx. 200'. Legalize existing platform, existing fixed dock with two (2) 8' dia. pilings and two (2) 8" square pilings, existing walkway and existing floating dock with 15 8" dia. pilings. Located: 305 Main Bayview Rd., Southold. SCTM#87-5-26&23.9 Inspected by: Peter Meeker, John Stein The CAC Supports the application with a stormwater mitigation plan for the run-off in the area of the boat ramp. Additionally, it was noted that the docks exceed 1/3 across the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of PAUL & CAROLYN AZZARITI to legalize for the reconstruction of the existing dock assembly located along the northwestern shoreline of subject property. Existing structure measures 78' in overall length and consists of the 4 following: 4'X 48' fixed catwalk supported by six (6) posts and including top decking of an open grate design, 3'X 14' hinged ramp and 6'X 20' floating dock secured by two (2) pilings. Located: 1175 Waterview Drive, Southold. SCTM#78-7-15 Inspected by: Peter Meeker, John Stein Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of NORMAN PARTON & ELLIE BECKER to remove and replace (in-place) approx. 194 If. of existing bulkhead with vinyl bulkhead, remove and replace (in-place) existing 8' and 19' timber bulkhead returns with vinyl returns, and backfill with approx. 25 cy. of clean sandy fill to be trucked in from an approved upland source; reconstruct (inkind/inplace) existing 2'X 3' steps to grade; construct a 10'X 12' on-grade wood deck (with untreated wood decking); install 8 If. of stepping stones to existing dock; and establish 8'-10' wide non-turf buffer adjacent to reconstructed bulkhead. Located: 1920 Minnehaha Blvd., Southold. SCTM#87-3-63.1 Inspected by: Peter Meeker, John Stein The CAC Supports the application with the Condition of a 12' non-turf buffer adjacent to the reconstructed bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by John Stein, it was RESOLVED to SUPPORT the application of BARRY ROOT to enclose area under existing carport and create a new entry and expand existing mudroom and create new home office under the footprint of the existing carport, and add an 18'4"X 5'5" deck for the new front entry. Located: 6315 Indian Neck Lane, Peconic. Proposed one-story addition on east side with 3'8" cement stoop 5 and steps to grade; proposed one-story addition on west side and porch; proposed second-story addition on garage and one-story addition; drywell to leaders and gutters and hay bales during construction; first floor slate patio under proposed second-floor deck; and abandon existing sanitary system and construct new sanitary system 100' from edge of wetlands. Vote of Council: Ayes: All Motion Carried Moved by James Abbott, seconded by Caroline Burghardt, it was RESOLVED to SUPPORT the application of DAVID & STEPHANIE SACK to demolish and remove existing one-story dwelling, deck, hot tub, and all other related structures located as close as 25' from the bluff, and construct new two-story, single-family dwelling (with attached garage and roof terrace), 305 sf. swimming pool/spa, 330 sf. on-grade masonry pool patio, and 270 sf. walkway/steps/deck to pool, all located no closer than 50' from the bluff; remove existing sanitary system and install new sanitary system; remove existing driveway and install new gas paver block driveway; install pool enclosure fencing and drainage system of leaders, gutters and drywells; and establish a 1,035 sf. non-turf buffer to be planted with native vegetation in place of existing lawn within 10' of bluff crest. Staging areas and equipment access as shown. Approximately .22 6 acres of underwater land, .04 upland (staging and pre-disposal dewatering of dredge materials. Located: James Creek, W/s Ole Jule Lane, Mattituck. SCTM#122-4-44.8 Inspected by: Peter Young, Caroline Burghardt, James Abbott The CAC Supports the application, however, requests the identification of the disposition of spoils as well as an analysis of the spoils. Vote of Council: Ayes: All Motion Carried Moved by Caroline Burghardt, seconded by James Abbott, it was RESOLVED to SUPPORT the application of SCOTT KAUFMAN to remove existing storm-damaged stairway and terrace retaining walls; construct along eroding toe of bluff approx. 210 If. of stone revetment, including angled westerly return, all consisting of approx. 3 to 5 ton stone placed over 50 to 100 Ib. core stone and filter cloth; restore bluff face using terrace retaining walls, approx. 600 cy. of sand re-nourishment (including approx. 350 cy. to cover proposed revetment) and native plantings; construct 3' wide berm with 50 cy. of sand/loam within 15' wide vegetated non-turf buffer to be established adjacent to bluff crest to control stormwater runoff; and construct new 4'X 50' elevated bluff stairway with landings. The CAC questions the viability without the reassurance the neighbor's will actually harden their shoreline. Vote of Council: Ayes: All Motion Carried Moved by James Abbott, seconded by Caroline Burghardt, it was RESOLVED to SUPPORT the application of the STRITZLER FAMILY TRUST to construct a small kitchen, deck, and bathroom addition to the existing dwelling. Located: 955 Soundview Ave., Mattituck. SCTM#94-1-8 Inspected by: Peter Young, Caroline Burghardt, James Abbott The CAC Supports the application with an updated site plan. Vote of Council: Ayes: All Motion Carried Moved by Caroline Burghardt, seconded by James Abbott, it was 7 RESOLVED to SUPPORT the application of BARRY D. BARTH to construct a 10'X 13' wood deck, 21.3'X 17' one-story addition to be used as an artist studio space and a carport under the studio addition. Located: 2040 Central Dr., Mattituck. SCTM#106-1-26 Inspected by: Peter Young, Caroline Burghardt, James Abbott Vote of Council: Ayes: All Motion Carried Moved by Caroline Burghardt, seconded by James Abbott, it was RESOLVED to SUPPORT the application of THOMAS & LINDA KELLY to remove existing fixed catwalk, ramp and floating dock and replant any disturbed tidal marsh vegetation inkind/inplace; maintain existing 335 sf. on-grade walkway and patio ar3ea consisting of loose stone pavers set in soil on top of berm and associated 3.5'X 8' stone steps; remove existing mulch and landscaping from approx. 175 sf. portion of non- disturbance buffer; remove approx. 340 sf. of existing mulch from cleared pathway that extends onto easterly neighboring property within 100' of wetlands; reduce width of existing cleared/mulched pathway to 4' by restoring approx. 1,350 sf. of pathway with native vegetation; and clear and maintain new 4' wide pathway from existing 12'X 16' timber kayak rack, to remain, to the tidal wetlands boundary along Long Creek. SCTM#107-4-13 Inspected by: Caroline Burghardt, Peter Young, James Abbott The CAC Supports the application, however, the violations within the non-disturbance buffer need to be addressed. Vote of Council: Ayes: All Motion Carried RECOMMENDATIONS-AMENDMENTS TO WETLAND PERMIT AND COASTAL EROSION PERMIT APPLICATIONS ROBERT SINGER & LYNNE VITALE to Amend Wetland Permit#1992 to allow for the construction of a 9' retaining wall and fill void area landward with clean trucked-in fill as needed. Located: 1865 Little Peconic Bay Lane, Southold. SCTM#90-1-12 The CAC did not make an inspection, therefore no recommendation was made. Peter Young will attend the next regular meeting of the Board of Trustees scheduled for Wed., January 17, 2018 at 5:30PM. 8 The next meeting of the Conservation Advisory Council will be held on Wed., February 14, 2018 at 4:30PM in the Town Hall Annex Executive Board Room.
