SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25 of the Suffolk County Department of Planning issued its reply dated September 29, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: This parcel is a non-conforming 31,377 sq. ft. parcel located in the Residential-40 (R-40) Zoning District improved with a two story "under construction" single family residence and accessory building. The two story single family dwelling and accessory building, once constructed, will measure 2,772 square feet. The property is accessed from Main Road via a 15 feet wide private right of way which has 257.43 feet frontage along the westerly property line. The distance of this parcel from NYS Route 25, Main Road is 177.82 feet using this same 15 feet right of way. The property measures 140.2 feet along the northerly property line, measures 164.47 feet along the easterly property line and 145.57 feet along the southerly property line. The property is bordered to the north by a commercial property with a parking lot and bordered to the south with a single family dwelling all as shown on a site plan prepared by Jakov Saric,R.A. dated September 5, 2017. BASIS OF APPLICATION: Request for a Variance from Article XXIII Section 280-124 and the Building Inspector's June 30, 2017 Notice of Disapproval based on an application for building permit to construct a garage addition to an "under construction" single family dwelling, at; 1) less than the code required minimum front yard setback of 40 feet, located at: 57130 Main Road, Southold NY. SCTM#1000-63-4-5.3. RELIEF REQUESTED: The applicant requests a variance to construct a garage addition to an "under construction" single family dwelling on this non-conforming 31,377 square feet lot with two front yards in the Residential R-40 District. The subject addition is not permitted pursuant to Article XXIII, Section 280-124 which states that, on lots measuring between 20,000 and 39,000 square feet in total size, the minimum front yard setback is 40 feet. The addition will have a front yard setback of 18 feet, 2-3/4 inches (18.1975 feet) as noted on the site plan prepared by Architect, Jakov Saric on September 5, 2017. The front yard setback is directly adjacent to the Page 2,February 1,2018 #7116,Kandic SCTM No. 1000-63-4-5.3 neighboring commercial property on the northerly line making it appear more like a side yard. The proposed new construction will measure 25 feet by 24 feet, 11-3/4 inches (24.979 feet) or 624.475 sq. ft. with a height (from finished ground to top of ridge) of 18.4 feet. ADDITIONAL INFORMATION: No written or oral communication was received from neighbors. On June 30, 2017, the Building Department issued a building permit to the applicants for the construction of a new single family dwelling with an attached pool house structure. During the public hearing the Board members questioned about two accessory structures along the front property line of the 15 foot wide right of way depicted on the artist's rendering and the site plan. The structures were described as pergolas by the applicant's agent. These structures were not cited on the notice of disapproval or the applicant's submitted application. The agent was then informed that he would need to apply for a building permit to construct these structures in a non-conforming front yard. After the hearing, the applicant opted to remove the pergolas from his plans and on January 25, 2018 submitted revised site plans, building plans and artist's rendering in which the subject accessory pergolas were eliminated. Additionally, the rendering and site plans depict an addition to the southern portion of the house not previously viewed, but is not a matter for this Board, since it doesn't create any non-conformity from code required area setbacks or lot coverage. The revision date of the set of plans is indicated as January 24,2018 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 18, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The parcel is situated behind commercial property with the proposed addition approximately 18 feet from the shared property line. The addition cannot be seen from Main Road/Route 25 and allowable lot coverage will not be exceeded. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Since the parcel has two front yards, other functional locations for an attached garage would also require a setback variance. The proposed location its proximity to the parking area of a commercial parcel, and is less conspicuous than placing it south of the home where a swimming pool will be constructed and southern exposure may be hindered. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 45.5% relief from the code. However, the proposed placement of the attached garage addition is behind the parking lot of commercial property where it has no adverse impact on other neighboring residential properties. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of or the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a two car garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Planamento, and duly carried, to GRANT the variance as applied for, and shown on the site plan and building plans, pages 1 through 13, prepared by Jakov Saric,Registered Architect, and last revised January 24, 2018, received January 25, 2018. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(3) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one(1)year terms. The applicant will be required to apply to the building department if they want these structures to remain on their plans and to construct them. I will contact them today to inform them of their options, and suggest that they eliminate the structures from their plan. #7121 DiSimone: Options for the applicant is remove the home office fixtures and label the 2nd floor as storage, or classify the structure as a two story pool house. Although choosing these options, the Building Department has concerns as to the possibility that after C of O's are issued that the second floor may morph into a nonconforming use, which is why the use should be identified prior to any approvals. Furthermore, identifying the home office assists the building department in monitoring and limiting prohibited uses within accessory buildings.
