EASEMENT AGREEMENT

THIS INDENTURE made this.G 6 day of October, 2017, by and between Peconic Land
VIII, LLC, P.O. Box 645, 538 Herricks Lane, .lamesport,New York 11947 (hereinafter referred
to as "Grantor"), and Joseph P. Lebkuecher, III and Katherine Mary Lebkuecher, 3475 Aldrich
Lane, Laurel,New York 11948 (hereinafter referred to as "Grantees").
WHEREAS, Grantor owns certain improved lands situate at 2295 Aldrich Lane, Laurel,
New York 11948, Suffolk County Tax Map No. 1000-125-2-1.14, more fully described on
Schedule"A" annexed hereto and made a part hereof("Grantor's Property"); and
WHEREAS, Grantees own certain improved lands situate at 3475 Aldrich Lane, Laurel,
New York 11948, Suffolk County Tax Map No. 1000-125-2-2. (Grantees' Prope y"); and
WHEREAS, Grantor, for good and valuable consideration, is desirous of conveying an
Easement to Grantees over a portion of Grantor's Property so that Grantees can access Grantor's
Property from Aldrich Lane.
WITNESSETH:
I. Grantor does hereby grant, transfer, bargain, sell and convey unto Grantees, in
perpetuity, an Easement in gross of the nature, character, and to the extent hereinafter set forth,
over and upon all that certain parcel of land constituting the southerly most 25 feet of Grantor's
Property described in Schedule "A" attached hereto("Easement Area"). The Easement Area is
more fully described in Schedule "B" attached hereto.
2. The nature, character and extent of the Easement hereby granted is as follows.
A. Grantees shall have the right, subject to the rights of the Grantor, its
successors and assigns as more fully set forth herein,to traverse said Easement Area from
Aldrich Lane to Grantees' Property.
B. Said access shall be limited to pedestrian and vehicular traffic.
C. The location of the Easement Area described in Schedule "B" shall not be
changed without the consent of both parties and their respective representatives.
D. Any and all costs associated with the use of said Easement shall be borne
solely by the Grantees, and furthermore,the Grantees, in conjunction with use of the
Easement by the Grantees, agree to provide the Grantor with proof of liability insurance
provided for by the Grantees, naming the Grantor, its heirs, successors and assigns as the
case may be, as an additional insured thereon as the Grantor's interests may appear.
E. Grantees also agree to indemnify, save and hold Grantor harmless against
any and all claims for property damage and/or personal injury arising out of the use and
enjoyment of said Easement by the Grantees, their heirs, successors and assigns, invitees
and trespassers to the extent not covered by insurance. Grantor, its successors and/or
assigns, shall notify the Grantees by certified mail, return receipt requested, of a change
in ownership in order to facilitate changes in the endorsement.
3. This Agreement shall inure to the benefit of, and bind,the parties, their heirs,
successors, legal representatives and/or assigns, and shall run with the land in perpetuity.
IN WITNESS WHEREOF, the parties hereto have executed this Easement
Agreement on the day and year first above written.
