BOUNDARY LINE AGREEMENT
AGREEMENT made this 4" day of May, 2017, by and among Dean C. Di
Maggio and Barbara Di Maggio, residing at 1365 South Harbor Road, SO-Uthold, New
York 11971, party of the first part, and Michael Croteauand Paul. `�tesiding at
1450 South Harbor Road, Southold, New York 11971, party of the second part.
WHEREAS, the party of the first part is the sole owner of the property known as 1365
South Harbor Road, Southold, New York, which property consists of two (2) adjacent
parcels, more fully described as follows:
(a) Plot 1, bearing tax map designation Section 075.00, Block 04.00, Lot 022.10,
and described in Schedule A annexed hereto and made a part hereof, pursuant to a deed
dated November 25, 1997, and recorded in the office of the Suffolk County Clerk on
December 19, 1997 in Liber 1]868 Page 573; and
(b) Plot 2, bearing tax map designation Section 075.00, Block 04.00, Lot 022.7
described in Schedule B annexed hereto and made a part hereof, pursuant to a deed dated
December 8, 2005, and recorded in the office of the Suffolk County Clerk on January 31,
2006 in Liber 12433 Page 466 (together the "Di Maggio Property"); and
WHEREAS, the party of the second part is the sole owner of property on the east side of -
South Harbor Road, in Southold, New York (also known as Section 075.00, Block 04.00,
Lot 022.9) as described on Schedule C annexed hereto and made a part hereof, pursuant
to a deed dated December 20, 2001 and recorded in the office of the Suffolk County
Clerk on December 26, 2001, in Deed Liber 12160 Page 81 (the "Croteau Property");
and
WHEREAS, the Di Maggio Property and the Croteau Property are contiguous and share a
common boundary line along the southerly side of the Di Maggio Property and the
northerly side of the Croteau Property, said common boundary line consisting of 326.65
feet of the property line described in the deed to the Croteau property as "THENCE
North 79 degrees 22 minutes 10 seconds East 471.84 feet" from the east side of South
Harbor Road;
WHEREAS, the Di Maggio Property and the Croteau Property are depicted on the Major
Subdivision Plat annexed hereto as Schedule D; and
WHEREAS, a fence has been erected running near the common boundary line and is
situate approximately nine (9) feet north of the southerly record line of the Di Maggio
Property; and
WHEREAS, the parties desire to relinquish any and all rights of title or interest they may
have in the land of the other;

NOW, THEREFORE, in consideration of Ten ($10.00) Dollars and other good and
valuable consideration, the parties hereby covenant and agree as follows:
1. The party of the first part has no claim, makes no claim, will not claim and hereby
releases any right, title and/or interest acquired by prescription, adverse possession or
otherwise over the Croteau Property and agrees that the party of the first part has no
rights over the Croteau Property.
2. The party of the second party has no claim, makes no claim, will not claim and hereby
releases any right, title and/or interest acquired by prescription, adverse possession or
otherwise over the DiMaggio Property and agrees that the party of the second part has no
rights over the DiMaggio Property.
3. The parties agree that this agreement may be recorded.
4. This agreement and the covenants herein shall run with the land, and inure to the
benefit of and be binding upon the parties hereto and their respective heirs, legatees,
administrators, executors, legal representatives, successors and/or assigns, including
remote, as well as immediate, successors to and assignees of the parties.
IN WITNESS WHEREOF, the parties hereto have duly executed this agreement the day
