WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable
consideration,lawful money of the United States,paid by the party of the second part,does hereby
grant and release unto the party of the second part,the heirs or successors and assigns of the party
of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Southold, County of
Suffolk and state of New York,known as Lot 2 on a certain minor subdivision known as Cabots
Woods,more particularly bounded and described as follows:
BEGINNING at a point where the extreme southwesterly corner of lot one on subdivision
known as Cabots Woods intersects with the southeasterly corner of lot 2 on said subdivision map;
Said point making the northeasterly corner of lands heretofore conveyed by Harold E.Goldsmith
and Alvah B. Goldsmith to Clarence F. Diller to Milrose J. Diller by deed dated December 31,
1954 and which point is distant 4485.37 feet northwesterly from the northerly side of Middle Road
(CR 48);(Said pont also being distant 295.00 feet northwesterly from a 10 foot right of way leading
to Middle Road (CR 48)); Thence from said point or place of beginning north 85 degrees 42
minutes west 186.70 feet to a point;Thence north 48 degrees 13 minutes 20 seconds west,247.70
feet to lands now or formerly of Ross;Thence along the northeasterly side of lands now or formerly
of Ross north 40 degrees 17 minutes 30 seconds west, 365.54 feet to a point; Thence north 3
degrees 8 minutes 20 seconds west,to the ordinary high water mark of Long Island Sound 76.46
feet more or less;Thence southeasterly along the mean high water line of the Long Island Sound;
on a tie line which course is south 81 degrees 13 minutes 18 seconds east, 163.27 feet to a point
northwesterly corner of an aforesaid lot no. 1;Thence along the southerly side of lot 1 the following
two courses and distances: 1) south 26 degrees 36 minutes 30 seconds east, 82.82 feet, more or
less;2)south 43 degrees 30 minutes east,600 feet to the point or place of BEGINNING.
Together with and subject to the rights of ways as described in liber 3571 cp 303 as amended in
liber 3818 cp 551, 3819 cp 13,4214 cp. 510,6991 cp 241, 7016 cp 302,9684 cp 336 and 10227
cp 366.
Subject to a Lighting Agreement in liber 6266 cp 101 which affects a 10 feet wide strip of land
running through premises.
SAID PREMISES known as 30160 Cabots Wood Road, Peconic, New York 11958, Section 73,
Block 4 and Lot 2.1.
BEING THE SAME PREMISES conveyed to the Grantors herein by deed dated October 29,2005,
and recorded in the Suffolk County Clerk's Office on June 22,2006 in Liber 12456 and Page 302.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part,covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The word "party"shall be construed as if it read"parties"whenever the sense of this indenture so
requires.
