IT. Board and Office Policies, Practices, and Activities:
Code Change Cha ter 280-141 C Special Exception Uses
On January 16, 2018 the Town Board approved code changes proposed by the ZBA
and authored by the Town Attorney„ to Section 280-141 (C) 6 which stated that a
Special Exception Permit approval was only valid for a period of six months by
which time the use must be undertaken to become lawful. If an applicant could not
meet that time frame, the ZBA could have extended the validity of the permit for one
additional .six mond period with a required:new public hearing. Since Special
Exception Permit applications frequently require site plan approval by the Southold
Town Planning Board as well as approvals fiom the Department of Health and other
agencies, the ZBA found it unreasonable to expect property owners to obtain these
approvals, complete needed construction and undertake the use within a six month
time frame. Moreover, we felt that if ZBA approval had already been granted, that it
was a financial burden to a property owner and a redundant use of the ZBA's time to
require another public hearing. In essence, the code changes remedied these
circumstances by allowing the ZBA flexibility in requiring an applicant to obtain all
necessary approvals, complete construction, and begin the approved special exception
use, within a time frame of from six months to three years, depending;on the scope of
the prosect. The ZBA thanks the Town.Board for approving these code changes.
.ZBA Annual O a ational Meeting
The Annual ZBA Organizational Meeting that was scheduled on January 4, 2018, had
to be rescheduled because of a Town Hall closure due to a snowstorm. The new date
is March 15, 2018, which is the next available date when all Board members will be
present to participate. The agenda will include a discussion and re-adoption of the
ZBA Procedural Guidelines, Code of Conduct, and Guidelines to Open Meetings Law
and Ethical Issues; a review and update of all templates for writing draft decisions;
and the meetings scheduled for 2018.
111. Financial/Budget/Personnel Issues:
Retirement of ZBA n5irf time Secretary
On January 16, 2018 the Town Board accepted the intent to retire effective as of
January 31, 2018 of part time ZBA secretary Lucille Cappabianca and authorized the
Town Clerk to advertise for her replacement. We are grateful to Lucille for her 1.2
years of outstanding service to the office of the Board of Appeals and the Town.
