SCHEDULE A
ALL that certain piece or parcel of land situate in the Town of Southold, County
of Suffolk, and State of New York, more particularly bounded and described as follows:
BEGINNING at a monument set at a point 140 feet northeasterly 73 degrees 25
minutes 00 seconds from the monument set on the east side of Bailey Avenue,which
monument is 511.99 feet south of the intersection of the easterly side of Bailey Avenue
with the southerly side of Kings Highway;
THENCE northeasterly 73 degrees 25 minutes 00 seconds, for 13 feet;
RUNNING thence southeasterly 33 degrees 27 minutes 00 seconds, along the
easterly map line of"Map of Buckley Farm"filed September 5, 2014 in the Suffolk
County Clerk's Office Map No. 298, for 60 feet;
THENCE southwesterly 73 degrees 25 minutes 00 seconds, for 13 feet, to a
monument on the east side of Bailey Avenue;
THENCE northwesterly 33 degrees 27 minutes 00 seconds for 60 feet, to a
monument, the point or place of beginning.
Said parcel being designated as S.C.T.M. (Suffolk County Tax Map) District
1000, Section 34.00, Block 4.00 and a part of Lot 16;
Being and intended to be a part of Lot 16,which Lot 16 adjoins Lot 8 to the west
(known as SCTM District 1000, Section 34, Block 4.00, Lot 8)and Lot 19.004 to the
east (SCTM District 1000, Section 34, Block 4, Lot 19.004), part of which is owned by
Suffolk County pursuant to the deed dated June 30, 2010 and recorded July 8, 2010 at
Liber 12630, Page 152; and
The part of Lot 16 conveyed herein is a part of what is described as a right of
way on the "Map of Buckley Farm"filed September 5, 1914 by Charles G. Bailey and
Clara E. Bailey, his wife, in the Suffolk County Clerk's Office as Map No. 298, which
right of way runs from the North Road (a/k/a Route 25 and a/k/a Kings Highway)on the
north to Champlain Place on the south, but the title to said right of way was erroneously
excluded from the deed for Lot 8, which was initially conveyed by Charles G. Bailey and
Clara E. Bailey, his wife,to Franklin W. McCreary, by deed dated December 22, 1927,
and recorded January 9, 1928, at Liber 1325 Page 326,which conveyance includes a
reference to the easement for the right of way, but failed to also convey the land

referred to as the"right of way,"which error was also made in the initial deeds from
Charles G. Bailey and Clara E. Bailey, and/or their heirs and executors,for the initial
transfers of the newly created lots following the filing of subdivision Map 298,for Lots
1.1, 4.1, 5, 6, 7, 8, 9, 10, 11, 12 and 13,while it was included in the deed for Lot 14, all
of which lots are bounded by Bailey Avenue on the west and the right of way which is
now denominated as Lot 16 to the east. Additionally, this strip of land, now known as
Lot 16,was not deeded by Charles G. Bailey and Clara E. Bailey or their heirs or
executors when the parcels to the east of Lot 16, now known as Lots 2, 19.3, 19.4 and
15 were initially conveyed following the filing of Map 298 or subsequently. This error
was carried forward in all subsequent deeds for these Lots 1.1 through 13 and for Lots
2, 19.3,19.004 and 15, resulting in the creation of what is now known as Lot 16, a lot
which is not on Map 298 and which is 13 feet wide and which does not have any owner
of record, as reflected in the records of the Suffolk County Real Property Tax Service
Agency-,
TOGETHER with an easement of ingress and egress in,to and over the above
described premises for access to and from Champlain Place and the North Road (also
known as Route 25 and also known as Kings Highway).
BEING AND INTENDED TO BE the remainder of the premises intended to be
conveyed in the conveyance from Charles G. Bailey and Clara E. Bailey, his wife,to
Franklin W. McCreary described above, pursuant to subdivision Map No. 298 described
above, which deed states that the property is"bounded Westerly by Bailey Avenue,
Northerly, Easterly and Southerly by other land of Charles G. Bailey and Clara E.
Bailey, his wife,"subject to the free and uninterrupted use of a certain right of way . . .
on the eastern side of the premises above described and extending from the north side
of Champlain Place to the south side of the North Road.
