Main Rd. &Youngs Ave.) n& Southold, NY Telephone: 631 765-1938 www.southoldtownny.gov " 1 free r � 1 � �A� ,., PLANNING BOARD OFFICE TOWN OF SOUTHOLD June 5, 2018 Mr. Charles Southard Jr. 435 Bay Home Road Southold, NY 11971 Re: Approval - Site Plan for Pindar Agricultural Storage Building 37325 NYS Route 25, ±1,341' w/o corner of Peconic Lane & Route 25, Peconic SCTM#1000-85.-2-9 Dear Mr. Southard: The following resolutions were adopted at a meeting of the Southold Town Planning Board on Monday, June 4, 2018: WHEREAS, this Agricultural Site Plan is for the proposed relocation and construction of a 1-story 3,259 sq. ft. building for agricultural equipment storage and no basement, located on 70.4 acres in the AC Zoning District, where there is 7,151 sq. ft. of existing buildings; and WHEREAS, on January 26, 2018, Charles Southard, authorized agent, submitted an application for Site Plan review; and WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C of the Southold Town Code, has the discretion to waive any or all of the requirements in §280- 133 for those applications involving uses strictly related to agriculture as long as they are not necessary to further the objectives set forth in Town Code §280-129 to maintain public health, safety, and welfare. The Planning Board has found that this application is eligible for a waiver of certain elements of the Site Plan requirements because it is an agricultural use, the details of which are included in the Staff Report dated February 5, 2018; and WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code §280-131 B (5), has the discretion to vary or waive the parking requirements for Site Pindar Agricultural Building Page 2 June 5 2018 Plan Applications where doing so would not have a detrimental effect on the public health, safety or general welfare, and will not have the effect of nullifying the intent and provision of the Site Plan Requirements chapter of the Town Code. The Planning Board has found that this application is eligible for a waiver of parking requirements because there is no need to provide for parking - the application is for an agricultural storage building not open to the public and the parcel is large in size relative to the proposed structure (less than 1% lot coverage total); and WHEREAS, on February 5, 2018, the Planning Board formally accepted the agricultural application as complete for review; and WHEREAS, on February 5, 2017, the Southold Town Planning Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action as a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(3) agricultural farm management practices, including construction, maintenance and repair of farm buildings and structures, and land use changes consistent with generally accepted principles of farming. The action is for the construction of a 1-story 3,259 sq. ft. building for agricultural equipment storage and no basement; and WHEREAS, on February 20, 2018, the Architectural Review Committee reviewed the application and approved it as submitted; and WHEREAS, on February 22, 2018, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, the proposed action is exempt from review by the Suffolk County Planning Commission (SCPC); and WHEREAS, on February 26, 2018, the Southold Town Fire Inspector reviewed and determined that there was adequate fire protection and emergency access for the site; and WHEREAS, on March 7, 2018, the Southold Fire District determined there was adequate fire protection for the site; and WHEREAS, on March 12, 2018, the Public Hearing was rescheduled to April 9, 2018 because the Planning Board did not have a quorum for the scheduled hearing; and WHEREAS, on April 9, 2017, a Public Hearing was held and closed; and WHEREAS, on April 17, 2018, the Southold Town Engineer reviewed the above- referenced application and has determined that the proposed building and site meet the minimum requirements of Chapter 236 for Storm Water Management; and Pinder Agricultural Building Page 3 June 5 2018 WHEREAS, on April 18, 2018, the Town of Southold LWRP Coordinator reviewed the above-referenced project and has determined the proposed project to be consistent with Southold Town LWRP policies; and WHEREAS, on April 23, 2018, the Southold Town Chief Building Inspector reviewed and certified the proposed Agricultural Storage Building as a permitted use in the A-C Zoning District; and WHEREAS, on June 4, 2018, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — Site Plan Approval of the Town of Southold, have been met; therefore, be it RESOLVED, that the Southold Town Planning Board hereby waives certain Site Plan Application requirements as noted above; and be it further RESOLVED, that the Southold Town Planning Board hereby waives the parking requirements as noted above; and be it further RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board grants Approval with three (3) conditions to the Site Plan entitled "Relocated Steel Storage Building for Pindar Vineyards" prepared by Charles B. Southard, dated October 19, 2017 and authorizes the Chairman to endorse the Site Plan. Conditions: 1. Provide a minimum of ten (10) evergreen plantings along the west side of the subject building, to extend north from the existing hedge row, at 7' — 8' tall and five feet on center; 2. No exterior lights were reviewed or approved in connection with this site plan. Any exterior lights on or around the outside of this barn must be reviewed and approved by the Planning Board and must meet Town Code §172 Lighting. 3. This building is approved for agricultural storage only. It may not be used for retail sales or access by the public. Please also note the following requirements in the Southold Town Code relating to Site Plans: Pindar Agricultural Building Pace 4 June 5 2018 1. Proposed storm water run-off containment systems must be inspected by the Town Engineer at the time of installation. Please call the Southold Town Engineer prior to beginning this work. 2. Approved Site Plans are valid for eighteen months from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 3. Any changes from the Approved Site Plan shall require Planning Board approval. 4. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. A copy of the Approved Site Plan is enclosed for your records. One copy will also be sent to the Building Department and the Town Engineer/Highway Department. Local Waterfront Revitalization Program (LWRP) The proposed action is CONSISTENT with the LWRP: • The area is included and identified as an archeo-sensitive area (NY State Historic Preservation Office GIS-Public Access (2011)). The single family residence is SPLIA listed (PE-9 attached). The NYSOPRHP Cultural Resource System (CRIS) was referenced and it was found that a Phase I Archeological Survey was conducted in the center of the property. No further information was provided. 2 The placement of the storage barn will not directly affect the SPLIA structure. It is recommended that more information on the footings of the proposed structure is requested; • It is recommended that the Planning Board assess the location of the agricultural barn on-site. It is expected that existing structures and vegetation will partially screen the 82'.6" L x 39'6" W x 20' H, 3,259 sq. ft. agricultural storage building. An existing agriculture structure (white barn) can partially be seen on the property from the New York State Route 25 (figures 1 and 2) travelling east. The proposed storage barn will be located 62' to the west of the existing structure and 184' from the front property line. The 62' separation distance will site the proposed storage barn where vines currently exist (approximately 6 rows in). The proposed storage barn is located behind a hedge running east/west and will be partially screened from view from westbound travelers. Note that the hedge shown on the plans does not correlate to the actual length in proportion to the proposed storage barn location. Architectural Review Committee (ARC) Reviewed the proposed project and approved it as submitted; Southold Fire District The Board of Fire Commissioners reviewed the proposed site plan and determined that that there is adequate fire protection for this property; Town Engineer The proposed agricultural storage building meets the minimum of Chapter 236 so long as storm water controls are provided around the perimeter of the building; as was previously approved with a 2' x 2' deep backfilled trench to accept storm water run-off; Staff Analysis: - Public Hearing was held and closed with no comments on 4/9/18; V: Staff Recommendations 1. Discuss the comments from the LWRP regarding- 3 a. Location of the proposed building, it's relation / distance to existing buildings on site and whether vines are necessary to be removed; b. Referrals Suffolk County Planning Commission (SCPC) — exempt Fire Marshall No comments or concerns regarding the proposed site plan. Local Waterfront Revitalization Program (LWRP) The proposed action is CONSISTENT with the LWRP: • The area is included and identified as an archeo-sensitive area (NY State Historic Preservation Office GIS-Public Access (2011)). The single family residence is SPLIA listed (PE-9 attached). The NYSOPRHP Cultural Resource System (CRIS) was referenced and it was found that a Phase I Archeological Survey was conducted in the center of the property. No further information was provided. The placement of the storage barn will not directly affect the SPLIA structure. It is recommended that more information on the footings of the proposed structure is requested; It is recommended that the Planning Board assess the location of the agricultural barn on-site. It is expected that existing structures and vegetation will partially screen the 82'.6" L x 39'6" W x 20' H, 3,259 sq. ft. agricultural storage building. An existing agriculture structure (white barn) can partially be seen on the property from the New York State Route 25 (figures 1 and 2) travelling east. The proposed storage barn will be located 62' to the west of the existing structure and 184' from the front property line. The 62' separation distance will site the proposed storage barn where vines currently exist (approximately 6 rows in). The proposed storage barn is located behind a hedge running east/west and will be partially screened from view from westbound travelers. Note that the hedge shown on the plans does not correlate to the actual length in proportion to the proposed storage barn location. Architectural Review Committee (ARC) Reviewed the proposed project and approved it as submitted; Southold Fire District The Board of Fire Commissioners reviewed the proposed site plan and determined that that there is adequate fire protection for this property; Town Engineer The proposed agricultural storage building meets the minimum of Chapter 236 so long as storm water controls are provided around the perimeter of the building; as was previously approved with a 2' x 2' deep backfilled trench to accept storm water run-off; Staff Analysis: - Public Hearing was held and closed with no comments on 4/9/18; V: Staff Recommendations 1. Discuss the comments from the LWRP regarding.- 3 egarding:3 a. Location of the proposed building, it's relation / distance to existing buildings on site and whether vines are necessary to be removed; b. Existing hedge row on site does not correlate with location shown on the site plan. This should be clarified by the applicant; c. Consider the recommendation to provide approximately ten (10) evergreen trees at 7' — 8' tall and five feet on center, along the west side of the subject building extending north from the existing hedge row; 2. All site plan requirements listed in §280-133 of the Town Code have been met and it is recommended that the above referenced site plan application be scheduled for determination by the Planning Board at tonight's public meeting. 3. Consider the following as conditions to the site plan- a. Provide a minimum of ten (10) evergreen plantings along the west side of the subject building, to extend north from the existing hedge row, at 7' — 8' tall and five feet on center; b. No exterior lights were reviewed or approved in connection with this site plan. Any exterior lights on or around the outside of this barn must be reviewed and approved by the Planning Board and must meet Town Code §172 Lighting. c. This building is approved for agricultural storage only.
