Dear Mrs. Moor~:
The following action was taken by the Board of Town Trustees during
their regular meeting held on September 24, 1987 regarding the above matter.
RESOLVED that the Southold Town Trustees RESCIND their prior recommendation
made to the Planning Board, dated August 27, 1987 regarding the Raymond
Kerester subdivision proposal as submitted by Patricia C. Moore, Attorney and
the Trustees recommend that ail activity on the property be out of their
jurisdiction as defined by Chapter 97 (13) of the Town Code.

Trustee Larsen: One more quick thing on the Kerester matter. I spoke to
Valarie Scopaz, or she spoke to me on the Kerester property on North Bayview.
She said that the three lots, like one, two three with a wetland here, here and
here. The way the original site plans were a driveway would go over the wetlands.
So she was disappointed that we said no problem. I forget what we said. $o
what they are doing is putting two lots up front and one lot back here. SB
would appreciate from as a resolution stating that we rescinded our other recommendation
and that we would like the proposed houses 100 ft. from the wetlands.
Trustee Bredemeyer: We said that we would approve subject to the office of ecology.
Trustee Krupski: Make it 100.
Trustee Bredemeyer: The distance may be a sticking point, that may need something
to work with. I move to rescind any prior communication and that they constructively
move all construction or activity more than 75 ft. from the fringe.
Clerk: that is more than your jurisdiction then. More than 75 ft.
Trustee Larsen: yes, yes.
Clerk: is there a second?
Trustee Goubeaud: I']] second that.

Dear Mr. Smith:
Thank you for your letter of September 9, 1987. It is my
understanding that the Trustees are not involved in subdivision
applications, furthermore, where any construction occurs outside
of 75 feet from wetlands the Trustees have no jurisdiction. In
ligh~ of the above, please advise what is meant by your resolution
dated September 9, 1987 wherein you stated that "activity on the
property is to be moved ~o~e than 75 feet out of the Trustees
jurisdiction".

The following action was taken by the Board of Town Trustees during
their regular meeting held on August 27, 1987 regarding the above matter.
RESOLVED that the Southold Town Trustees RESCIND their prior recommendation
made to the Planning Board, dated June 18, 1987 regarding the Raymond Kerester
subdivision proposal as submitted by Patricia C. Moore, Attorney and the Trustees
recommend that .all activity on the property is to be moved more than 75' out of the
Trustees iuris diction.
A copy of this letter is being transmitted to the Planning Board for their
file.

Please let this confirm the following discussion with regard
to the above mentioned subdivision at the Monday, May 11, 1987

The Planning Board will conduct a field inspection of the
property prior to any further review or action. Would you please
submit a survey with the wetland grasses which we understand you
had prepared for the Board of Appeals.
This subdivision will be referred to the Town Trustees for
their input with regard to this proposal.
