WITNESSETH, that the party of the first part, in consideration often dollars and no/100 ($10.00),
lawful money of the United States, to them paid by the party of the second part, does hereby grant
and release unto the party of the second part, the heirs, successors or assigns of the party of the
second part forever,
ALL that certain lot, piece or parcel of land together with the buildings and improvements located
and to be erected thereon, situate, lying and being at Southold, County of Suffolk and State of New
York, being known and designated as Lot Number 18 on a certain map entitled, "Subdivision Plan,
Smithfield Park," and filed in the office of the Clerk of the County of Suffolk on December 27,
1966, as Map Number 4770, being more particularly bounded and described as follows:

BEING the same premises conveyed by Harold J. Adams, Peter F. Adams and Walter E. Adams,
all as devisees under the Last Will and Testament of Harold A. Adams, Grantors, to Mathew A.
DiPietro and Rosemary DiPietro, Grantee, by Deed dated October 20, 1995 and recorded in the
Suffolk County Clerk's Office on November 1, 1995 in Liber 11748 of Deeds at page 416.
SUBJECT to covenants, conditions, restrictions and rights of way of record, if any.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,

AND the party of the first part covenants that the party of the first part has not done or suffered

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
