Main Road Cutchogue, NY 11935 1982 and Filed April 20, 1982 [Appellant (s) ] At a Meeting of the Zoning Board of Appeals held on ~ay 26, 1982 the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section [X] Request for Variance to the Zoning Ordinance Article III, Section 100-31 JEROME E. and M. DOROTHY BLOOM Request for [ ] A public hearing on this matter was held on May 26, 1982, at which time the hearing was declared closed pending deliberations and the follow- ing determination: By this appeal, appellants seek approval of insufficient road frontage (width) of two parcels of 119.87 feet each along the Main Road (S.R. 25). The westerly parcel, No. 1, will contain an area of 54,944 square feet, and the easterly parcel, No. 2, will contain an area of 55,197 square feet inclusive of the 35 right-of-way to the rear parcel of Jayne at District 1000, Section 23, Block 1, Lot 10. The board agrees with the reasoning of appellants in this applica- tion and find this proposal to be very practical and reasonable under the circumstances. In considering this appeal, the board determines that the variance request is not substantial in relation to the code requirements; that the circumstances herein are unique; that by allowing the variance no substantial detriment to adjoining properties would be created; that the difficulty cannot be obviated by a method, feasible to appellant, other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general pur- poses of zoning; and that the interests of justice will be served by allowing the variance as indicated below. On motion by Mr. Douglass, seconded by Mr. Sawicki, it was RESOLVED, that the application for JEROME E. and M. DOROTHY BLOOM be and hereby is GRANTED approval of insufficient width of two proposed parcels AS APPLIED FOR in Appeal No. 2977. Location of Property: North Side of Main Road, East Marion, NY; bounded north by Jayne and L.I. Sound; west by Swick & Shikler; south by Nodine and Main Road; east by Hicks and Williams; County Tax Map Parcels No. 1000-23-1-10 and 11. Vote of the Board: Ayes: Messrs. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because it would require the applicant to maintain a family residence on a substantially oversized lot, to wit: A parcel containing 110,141 sq.ft, with a frontage of 239.74 feet. The appli- cant would then be compelled to improve and maintain an area of land 70,141 sq.ft, greater than that required by our present Zoning Ordi- nance. The area variance requested to the width requirement of the Ordinance is not substantial, to wit: Approximately 20%. This would have no detrimental effect on surrounding properties, but if denied to the applican~ surely would cause substantial practical difficulties, and while not necessary to establish for this area variance, a con- ceivable loss in the financial value of the applicant's premises. 2 The hardshipcreatedis UNIQUE and isnotshared by all prope~ies alike in the immediate vicinity of this property and in this use district.~;~ Applicant seeks an area variance involving only relief from the width requirements of the Ordinancej and in such circumstances, need not establish a condition unique and peculiar to his property. 3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the variance sought is an area variance and not a use variance, and thus, there is no change in the character of the zone district.
