Upon application of PATRICIA A. BAILEY, 2155 Skunk Lane, Box 114,
Cutchogue, NY for a Variance to the Zoning Ordinance, Article III, Sec-
tion 100-31 for permission to reestablish legal building parcels as
existed prior to the 1971 change in area requirements, Lot #2 having
insufficient area and Lot #3 having insufficient road frontage along
Leslie's Road. Location of Property in Question: Skunk Lane and Les-
lie's Road, Cutchogue, NY; County Tax Map Parcel ID Nos. 1000-97-4-11,
12 and 17.
By this appeal, appellant seeks: (a) approval of insufficient area
of proposed Parcel #2 of 34,204 square feet, and (b) approval of insuf-
ficient road frontage of Parcel # 3 of approximately 117 feet, which also
has an area of 5.959 acres. Existing on Parcel #1 is a one-family frame
dwelling house, garage and temporary portable mobile home. Existing on
Parcel #2 is a substantially large barn structure and temporary portable
mobile home at the northeast corner of the premises. Parcel #3 is vacant.
In a previous application to this board, appellant sought similar
relief with Lot #2 having an area of approximately 36,369 square feet;
however a certified survey was not submitted and the board at that time
was concerned as to the nearness of these proposed lot lines in relation
to the existing buildings. On November 13, 1981, Appeal No. 2846 was
denied for lack of adequate information.
It is the opinion of the board that the relief requested is not
substantial (approximately 15% variance) in relation to the 40,000
square foot requirements of the code. It is also the opinion of the
board that in view of the location of the existing barn and garage
structures, the location of the lot lines as existed prior to the change
in zoning (1971) is reasonable and practical under the circumstances.
In considering this appeal, the board determines that the circum-
stances are unique; that by allowing the variance no substantial detri-
ment to adjoining properties would be created; that the difficulty
cannot be obviated by a method feasible to appellant other than a
variance; that the relief requested will be in harmony with and promote
the general purposes of zoning; and in view of the manner in which the
difficulty arose and in consideration of all the above factors, the
interest of justice will be served by allowing the variance as indicated
below.

your May 3rd letter, not to rehear, modify, alter or change
the December 22, 1982 decision in Appeal No. 3055.
You should note, however, that the condition stipulated in
the subject decision does permit an application to the board
for any use of the barns for consideration, after taking the
procedural steps and filing of the appropriate forms.

On December 22, 1982, the Board of Appeals rendered an
approval of Lot #2 which contains a large barn, but had put
restrictions on said barn, as one of the conditions of approval.
It has been brought to the attention of my office that, through
advertising, you are now about to violate a Zoning Board of
Appeals Condition, that is, you are about to store boats, etc.,
in the barn. If you wish to do this, then I would suggest you
request the Z.B.A. to reconsider the barn restriction and re-
main within the confines of the law.

A public hearing concerning this appeal was held on
September 17, 1981 after due notice thereof in the local and
official newspapers.
The Board made the following findings and determination
concerning this appeal:
Appellant has appealed to this Board seeking a variance
for the approval of an insufficient road frontage of approxi-
mately 117.24 feet along Leslie Road of Proposed Lot 3 and
the approval of an insufficient area of exact square footage
of Proposed Lot 2, unknown to the board. Appellant has sub-
mitted a sketch indicating the square footage of Proposed
Lot 2 to be 36,369. The Board is familiar with the premises
and recognizes there are several existing buildings on each
of the three proposed parcels; however the location of the
lot lines in relation to the location of these buildings
has not been provided for consideration. The Board is con-
cerned as to the nearness of the proposed lot lines and
perhaps whether a building may be situated thereon.
On August 6, 1981 this Board held a public hearing
concerning this same appeal, and the Board rendered a deci-
sion at a meeting held August 26, 1981 denying same without
prejudice inasmuch as the notice of hearing was not adver-
tised correctly in both the local and official newspapers
and therefore it was not within the authority of this Board
to favorably act upon this application as advertised.
At a Regular Meeting of the Board of Appeals held Septem-
ber 3, 1981, a resolution was unanimously adopted scheduling
and requiring readvertising of this appeal for public hearing,
which was held and closed on Thursday, September 17, 1981,
pending a decision, upon receipt of an up-to-date certified
survey showing the square footage of proposed Lots 1 and 2
and showing the existing structures with setbacks. Letters
confirming same were forwarded to the applicant on Septem-
ber 23, 1981 and October 28, 1981 and to date the Board has
not received the requested documentation.
The entire premises in question and considered merged
contains an area of approximately 8.3 acres. The zoning
code requires each parcel of land to contain an area of
40,000 square feet with road frontage of 150 feet for
residential purposes. It is the opinion of the Board that
there is adequate land available for appellant to meet the
requirements of the zoning code for 40,000 square feet
without significant economic injury. It is also the opinion
of the Board that the ll7-foot road frontage for Proposed
Lot 3 is not unreasonable and that the unusual shape of
these premises lends itself to practical difficulties in
this appeal for the insufficient road frontage.
In considering this appeal, the Board determines that
the relief requested as to insufficient area may be substan-
tial in relation to the requirements of the zoning code;
that the difficulty can be obviated by some method feasible
for the applicant to pursue other than a variance for
insufficient area; that the circumstances herein are not
unique; that in view of the manner in which the difficulty
arose and in consideration of ~11 the above factors the
interest of justice will be se~ed by denying the variance
as applied for.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Sawicki, it was
RESOLVED, that the application of Patricia A. Bailey,
Appeal No. 2846 be denied as applied for.
