The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. Herrmann En-Consultants 1319 North Sea Road Southampton, NY 11968 RE: SEAN & LESLIE OLSEN 975 WEST HILL ROAD, SOUTHOLD SCTM# 1000-70-4-25 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, November 15, 2017 regarding the above matter: WHEREAS, En-Consultants on behalf of SEAN & LESLIE OLSEN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 13, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the proposed action to remove and replace in-place approximately 85 linear feet of existing timber bulkhead with vinyl bulkhead; incidentally dredge 5' wide area adjacent to bulkhead to a maximum depth of-4' MLW and use approximately 10 cubic yards of sand/silt spoil as backfill; reconstruct in-place existing 4.5x7' seaward platform attached to bulkhead and construct an 8'x20' on-grade, open- grate deck landward of bulkhead be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the reattachment of existing 2.5'x9' ramp and 5'x16' floating dock to remain, be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit for the structures, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on November 15, 2017, at which time all interested persons were given an opportunity to be heard, and, 2 M} WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of SEAN & LESLIE OLSEN to remove and replace in-place approximately 85 linear feet of existing timber bulkhead with vinyl bulkhead; incidentally dredge 5' wide area adjacent to bulkhead to a maximum depth of-4' MLW and use approximately 10 cubic yards of sand/silt spoil as backfill; reconstruct in- place existing 4.5'x7' seaward platform attached to bulkhead and reattach existing 2.5'x9' ramp and 5'x16' floating dock to remain; construct an 8'x20' on-grade, open-grate deck landward of bulkhead; and to establish and perpetually maintain a 10' wide non-turf buffer along newly constructed bulkhead; with the condition of the installation of drywelis for the gutters approaching the bulkhead; all as depicted on the revised site plan prepared by En-Consultants, dated December 12, 2017, and stamped approved on December 14, 2017. There is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location,so without replacement and maintenance of the bulkhead,the subject and adjacent properties would be exposed to flooding and erosion damage. In addition to providing the ecological benefits associated with replacing a treated timber bulkhead with untreated vinyl sheathing,the project includes replacement of the existing dock platform with a platform constructed with open-grate decking. The project also proposes a new 8'x 20'on-grade deck on the landward side of the bulkhead,but this deck will also be constructed with open-grate decking and more than half of it will be located within the limits of a 5'non-turf buffer to be established adjacent to the newly constructed bulkhead. And the localized,ephemeral effects of the proposed incidental dredging to recover lost upland material(to be retained on site as backfill)will be contained by a silt curtain.
