FAMILY LLC 450 SOUND BEACH DRIVE MATTITUCK,NY SCTM#1000-99-1-38.2 Wetlands Statement of Effect: The proposed project consists of the demolition of an existing single-family dwelling and the construction of a new, larger dwelling in approximately the same location along this heavily developed stretch of shoreline associated with Long Island Sound(see Figure 1). The wetlands setback of the new dwelling will exceed by nearly three times the 100' wetlands setback required by§275-3(D)(1)(a)(1),as it will be located more than 280 feet from the surface waters of Long Island Sound. The project has nevertheless been determined by the Board of Trustees to be situated within Chapter 275 jurisdiction due to its location within 100 feet of the landward limit of the dune area on the property. However,the nearest point of the proposed construction is set back approximately 50 feet from the Trustees-defined landward limit of dune area; and all construction and related disturbance will occur entirely landward of the Coastal Erosion Hazard Area(CEHA). And pursuant to the variance approval issued by the Board of Appeals(Case No. 6798),a natural vegetated buffer will be maintained on the seaward side of the CEHA boundary. Project mitigation also includes the installation of a new,upgraded sanitary system on the roadside of the dwelling,where it will be located more than 340 feet from surface waters and more than 100 feet from the dune area and thus outside Chapter 275 jurisdiction. Additionally,the proposed driveway,though also outside wetland jurisdiction,will be comprised of pervious gravel; a drainage system of leaders, gutters, and drywells will be installed to collect roof runoff from the new dwelling; and the potential for temporary runoff and site disturbance during construction will be contained by a project limiting fence located landward of the CERA boundary. Together these various design and mitigation measures will maintain construction as far from Long Island Sound as practicable;provide maximum preservation of the adjoining natural environment and vegetation; improve the treatment of on-site septic effluent reaching the groundwater table; limit the potential for increased surface water runoff;and filter and absorb potential contaminants(e.g.,fertilizers,pesticides)contained in runoff that does move toward Long Island Sound,thus mitigating both the quantity and quality of potential runoff. The project has nevertheless been determined by the Board of Trustees to be situated within Chapter 275 jurisdiction due to its location within 100 feet of the landward limit of the dune area on the property. However,the nearest point of the proposed construction is set back approximately 50 feet from the Trustees-defined landward limit of dune area;and all construction and related disturbance will occur entirely landward of the Coastal Erosion Hazard Area(CEHA). And pursuant to the variance approval issued by the Board of Appeals(Case No. 6798),a natural vegetated buffer will be maintained on the seaward side of the CERA boundary. Project mitigation also includes the installation of a new,upgraded sanitary system on the roadside of the dwelling,where it will be located more than 340 feet from surface waters and more than 100 feet from the dune area and thus outside Chapter 275 jurisdiction. Additionally,the proposed driveway, though also outside wetland jurisdiction,will be comprised of pervious gravel; a drainage system of leaders, gutters, and drywells will be installed to collect roof runoff from the new dwelling; and the potential for temporary runoff and site disturbance during construction will be contained by a project limiting fence located landward of the CERA boundary. Together these various design and mitigation measures will maintain construction as far from Long Island Sound as practicable; provide maximum preservation of the adjoining natural environment and vegetation; improve the treatment of on-site septic effluent reaching the groundwater table; limit the potential for increased surface water runoff; and filter and absorb potential contaminants(e.g., fertilizers,pesticides)contained in runoff that does move toward Long Island Sound,thus mitigating both the quantity and quality of potential runoff. Therefore, consistent with Policies 5 and 6,the project will ensure the protection and potential improvement of water quality and will not result in the physical loss, degradation,or functional loss of ecological components or otherwise adversely impact the natural ecosystem associated with the adjacent dune area, beach,or surface waters/tidal wetlands.
