Moved by Trustee Goubeaud seconded by Trustee Bredemeyer WHEREAS, Walter Gaipa on behalf of Darold and Hildegard Murray applied to the Southold Town Trustees for relief of teh Wetland Ordinance, Chapter 97, Article II, Section 97-22 for the construction of stairs to the beach from his property located at 1380 The Strand Pebble Beach Farms, East Marion, New York, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and th% surrounding area; and WHEREAS, the Board has considered all the documentation in the file pertaining to this request; and WHEREAS, the Board has made the following findings of fact: 1. By this request appellant requests a Waiver of the Wetland Ordinance Chapter 97, Article II, Section 97-22 to construct a set of steps to the beach, and 2. The property in question is identified on the Suffolk County Tax Map as 1000-030-2-68 and located at 1380 The Strand Pebble Beach Farms, East Marion, New York, IN VIEW OF THE FOREGOING INFORMATION NOW, THEREFORE BE IT RESOLVED that Walter Gaipa on behalf of Darold and Hildegard Murray be and hereby are granted a WAIVER of the Wetland Ordinance for the construction of steps all in accordance with the application submitted. In considering this determination, please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. In April of this year~ York State Department leading from the rear beach on the bluff of we requested permission from the New of Conservation to construct stairs yard to the Murray residence to the Long Island Sound. The main purpose of the construction was to secure a rental agreement with a party for July through September. The rental was accepted with the understanding that the stairs would be installed as soon as the DEC permit arrived, which it did on July 17, 1986. I was then informed that ne% regulations exist where as the Town Trustees have possible jurisdiction in this area. The owner and myself, while appreciating the Town Trustees concern for protecting our environment and our willingness Lo cooperate fully, are faced with a lengthy permit applica- tion period and are in a dilemma of hOC having the stairs installed during the rental period. Therefore, we are requesting a waiver of permit as per Southold code Chapter 97, Sect[on 97-22. Being that the New York State DEC has already, through a lengthy applica- tion and inspection period, granted their approval, the delay caused by a similar operation would be hardship to those involved. We would greatly appreciate it if on July 24th. you could find time in your busy schedule to inspect the site, it is staked, and act upon it at your next meeting on July 31st.
