State Street) and running 100.18 feet on the western lot line shared with a residential neighbor, to 84.91 feet on the southern lot line abutting lands owned by Oyster Ponds Historical Society and an eastern lot line of 99.06 feet shared with a second residential neighbor. The property is improved with a 2-story wood frame dwelling and an accessory,2-car detached gavage as shown on the site plan and architectural drawings prepared by Meryl Kramer,Registered Architect, and dated August 9, 2017. BASIS F AI'l'1 LCAT ION: Request for Variances under Article XXIII, Section 280-124 and the Building Lnspector's July 31, 2017. Notice of Disapproval lased on an application for a permit to constnict additions and alterations to an existing seasonal dwelling, at: 1) located less than the code required minimum :ear yard setback of 35 feet; 2)more than the code permitted maximum lot coverage of 20%: located at: 435 Skippers Lane (a.k.a. The applicam requests variances for a perrmIt to construct additions ,uid alterations to an existing simAlc farnily dwelling that will result in a rear yard setback of21°i feetwhere the code requires a 35 foot Page 2,November 16,2017 #7105,Burnes,Heath SCTM No. 1000-24-2-3 minimum and lot coverage will increase from 21.9% to 24.3% where the code limits iot coverage to 20%. The proposed renovations and additions include increasing the structure by a total of 198 square feet consisting of a 150 square feet first floor addition to accommodate a mudroom and bathroom, along with an additional 48 square feet for stairs and stoops. The addition of the stairs and stoop attached to the proposed dining area having a distance closest to the rear yard, requires area variance relief. A gable roof is proposed to replace an existing flat roof over a previously built one-story addition on the rear of the residence. ADDITIONAL INFORMATION: Meryl Kramer, AIA spoke on behalf of the applicant and cited three (3) prior Zoning Board of Appeals decisions in the neighborhood regarding approvals. for non-conforming rear-yard setbacks, including files: #2738, September 25, 1980; #4533, January 22, 1998; and 47056, June 16, 2017. Additionally, she cited two (2) prior Zoning Board of Appeals decisions in the neighborhood regarding approvals for excessive lot coverage, including files: #4182, July 22, 1993 and #4533, January 22, 1998. No immediate neighbors or members of the public spoke in favor or opposition to this application. This application also requires approval by the Historic Preservation Commission which was obtained on September 19, 2017 (see above). FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 2,2017 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town i,mv 267-b :3 b `I'. Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Residences along Skipper's Lane, like most of the Village of Orient and immediate surrounding area, were developed and built prior to zoning. Many structures in the vicinity were constructed in the late 18`h or early 190' Century and were continually improved prior to the introduction of zoning in the mid-20`h Century. The vast majority of structures in this densely developed community do not mirror current zoning requirements with many properties developed in a way consistent with Colonial village life; houses close to the street with narrow or irregular side and rear yards. Moreover,the addition of a gable end roof in lieu of the existing flat roof to the single floor addition at the rear of the residence will better conform to the coastal New England character of the neighboring houses and the community at large. 2. Town Law "267-b',3 b 2 . The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As a result of the existing structure being built prior to zoning, the 35 feet rear yard setback as defined by the Town Code, will require any addition to the principal residence to seek relief through a variance. Moreover, the existing lot coverage of the residence and accessory garage structure, as calculated at 21.9%, exceeds the allowable 20% and will therefore also require any addition to the structures to seek relief from the Code. 3. Town Law "267-1i b : . The variances granted herein are mathematically substantial, representing 25.7 % relief from the code regarding rear-yard setback and 21.5% relief from the code regarding lot coverage. However, the applicant proposes to maintain the structure's rear facade setback of 30 feet and proposes a modest addition to allow for stairs and a stoop offering access from the yard into the existing structure and is not proposed to be an enclosed living space. Furthermore, the proposed 21.5% increase in lot coverage (150 square feet for mud room and bath plus 48 square feet for exterior stairs and stoops) is not substantial due to the unique circumstances of this property and the substandard size of the lot area(8,304 square feet). Town Law §267-b(3)0))(4No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The visual impact of the proposed wood stairs and stoop closest to the rear property line will be insignificant, particularly since the the rear yard property line is shared with Oyster Ponds Historical Society lands, as opposed to other residential properties. The applicant mI.Ist comply with Chapter 236 of the Town's Storm Water Management Code and has offered to install gutters and leaders. 5. Town Law §267-b 3 b 5' . The, difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of tile limitations on the use of the parcel tinder the Zonirig Code in effect prior to or at the time of purchase, As indicated above,the substandard parcel was created prior to zoning and would require: a variance to not only expand but also to alter within the existing footprint. 6. Town Law ' 267-b. Grant of the requested relief is the minimum action necessary to enable the applicant to enjoy the benefit o I f tile addition of a mudroom and bath along with the addition of a gable roof and other renovations while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
