SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated September 6, 2017 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The subject property is is a conforming 48,281 square foot parcel located
in an R-40 Zoning District. The parcel measures 135.00 feet along Hobart Avenue, 388.81 feet on the North side,
145.00 feet on the West side, and 266.77 feet on the South side. There is a wetlands pond flagged by En-
Consultants, Inc. on the front of the property along Hobart Avenue. The property is improved with a one and one-
half story frame house and garage, a frame shed, and solar panels as shown on a survey prepared by Nathan Taft
Corwin LLS last revised July 16, 2017.
BASIS OF APPLICATION: Request for Variance(s)from Sections 280-105C and the Building Inspector's August
4, 2017 Notice of Disapproval based on an application for a permit to legalize "as-built" accessory ground-
mounted solar panels; at 1) located less than the code required minimum setback from the property line of 15 feet.
RELIEF REQUESTED: The applicant requests a variance to legalize the solar panels installed 15 to 20 years ago,
measuring 115 feet in width, with a height of over 6 feet, and located at a non-conforming 2.5 foot side yard
setback where code requires 15 feet.
ADDITIONAL INFORMATION: Site inspection and the applicant's testimony showed that the parcel is heavily
wooded and the current location of the solar panels gives the panels more sunlight than other locations on the
property. The solar panels measuring over six feet in height were installed in 2007 by the prior owner of the
parcel. The current owner purchased the property in 2016 and is requesting that the as-built solar panels be
legalized. A letter of support for the requested variance was received by the Board from a neighbor. At the hearing
another adjacent neighbor indicated no objection as long as there was no proposed expansion.

FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on December 7, 2017 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property
and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The property is a wooded lot and the solar panels are not
visible from Hobart Avenue and are screened from view of the adjacent parcel owned by the Southold Historical
Society by existing vegetation along the shared property line.
2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The applicant could put the solar panels in a code conforming
location. However, solar panels need to be in the sunniest location on the property in order to make the most
electricity possible.
3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 83%relief
from the code. In 2007, the panels were installed in an area of the property that would provide optimal sun
exposure. However, the panels are temporary in nature and will be removed once they no longer function. They
have a lifespan of approximately 20 years of peak performance.
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase
6. Town Law X267-b. Grant of requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of solar panels while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Planamento, and duly
carried,to
GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin, I11, LLS, last
revised July 16,2017.
SUBJECT TO THE FOLLOWING CONDITION:
1. This variance is valid for the lifespan of the"as-built"solar panels. Once lifespan has expired and the solar
panels become inefficient,they must be removed. If the applicant elects to replace the solar panels,they
shall be placed in a code conforming location, or the applicant must apply for an area variance if proposed
in a nonconforming location.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.

Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department of a building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey
cited above, such as alterations, extensions, or demolitions, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of
Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a
subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such
variance was granted. The Board of Appeals may,upon written request prior to the date of expiration,
grant an extension not to exceed three (3) consecutive one(1)year terms.

REASONS FOR APPEAL(additional sheets may be used with preparer's signature):
AREA VARIANCE REASONS.
(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a
detriment to nearby properties if granted,because:
the existing solar panels were installed by the prior owners. The location was selected for
maximum sun exposure and minimum disruption to the rear yard. The property is one of two
lots developed by Louis Edson and the Town of Southold created a drainage system in the front
yard to capture road runoff and filter it prior to draining into the creek. The lot is therefore
encumbered by a Town drainage system in the front leaving only the rear yard usable. The
adjacent property is owned by the Southold Historical Society.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the
applicant to pursue,other than an area variance,because:
The front yard is not available due to the drainage structure and the solar panel was placed on
the side of the rear yard to keep it from interfering with the recreational use of the rear yard.
The relocation of the solar panels and the underground utility connections would be expensive.
The only alternative to the owner would be to remove the solar panels.
(3) The amount of relief requested is not substantial because:
The variance is substantial, however the use is a "utility". There is no activity or habitation, it
merely collects solar power. Placement of the structure at 15' from the side yard was not
practical. The solar panels have no impact to the adjacent property.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district because:
No impact whatsoever. Solar energy collection is a beneficial use to the environment.

Based on the information you have submitted, this Department has determined that:
The property landward of the 19' elevation contour as shown on the survey prepared by
Joseph A. Ingegnb dated March 15, 2000 is beyond jurisdiction of Article 25.
Therefore, in accordance with the current Tidal Wetlands Regulations (6NYCRR Part
661) no permit is required..Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands
jurisdictional boundary, as indicated above,without a permit. It is your responsibility to
ensure that all precautions are taken to prevent any sedimentation or other alteration or
disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which
may result from your project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your project(i.e. a 15'to 20'
wide construction area) or erecting a temporary fence, barrier,or hale bay berm.
Please be further advised that this letter does not relieve you of the responsibility of

Please find enclosed a copy of the Legal Notice describing your recent application. The Notice
will be published in the next issue of The Suffolk Times.
1) Before November 20th:
Please send the enclosed Legal Notice, with both a Cover Letter including your telephone
number and a copy of your Survey or Site Plan (filed with this application) which shows the
new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable, you are requested to make other attempts to
obtain a mailing address or to deliver the letter to the current owner, to the best of your ability,
and to confirm how arrangements were made in either a written statement, or during the
hearing, providing the returned letter to us as soon as possible;
AND not later than November 27th: Please either mail or deliver to our office your Affidavit of
Mailing (form enclosed) with parcel numbers, names and addresses noted, along with the
