SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated September 6, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated November 16, 2017. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is as EXEMPT from Coastal Consistency Review pursuant to Minor Actions item "F"which states: Granting of individual setback, lot line and lot area variances, except in relation to a regulated natural feature or a bulkhead or other shoreline structure or any activity with the Coastal Erosion Hazard Area(CEHA). PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 52,287 square foot waterfront parcel located in an R-80 Zoning District with 100.00 feet along the northerly line (Adj. to the Long Island Sound), measuring 100.00 feet along the southerly line on Soundview Avenue, 588.59 feet along the westerly line, and 560.00 feet'along the easterly line. The parcel has and is continued to be improved since the last survey of the property by surveyor Nathan Taft Corwin 111, LS dated August 25, 2015 when the Zoning Board of Appeals of Southold Town on July 21, 2016 granted a variance for additions and alterations to what was a single story residence (now two story) with an attached garage, an accessory structure pool house and in ground swimming pool, a wood deck, a concrete walk and a staircase leading to the beach. BASIS OF APPLICATION: Request for a Variance under Article IV, Section 280-19 and the Building Inspector's July 14, 2017 Notice of Disapproval based on an application for a permit to make roof alterations to an existing accessory building (pool house); at: 1) less than the code required minimum setback from the property line of 15 feet; located at: 18075 Soundview Avenue (Adj.to the Long Island Sound), Southold,NY. SCTM41000-51-1-8. Page 2,December 21,2017 #7112,Kearns SCTM no. 1000-51-1-8 RELIEF REQUESTED: The applicant requests a variance to make alterations to the pre-existing pool house with a non-conforming side yard setback of 4.4 feet. These proposed changes include changing the roof line, replacing and adding new siding along with new windows and sliding glass doors so to aesthetically match the changes that have been made to the house and garage currently under construction. There will be no changes to the existing footprint of the pool house. This is a cosmetic change so that the pool house will look similar to the house and garage structures which were also under renovations. ADDITIONAL INFORMATION: The Zoning Board granted the current owners an area variance on July 21, 2016 for additions and alterations to the dwelling, already non-conforming, requiring a side yard setback of 3.4 feet and a combined side yard setback of 14.8 feet. There are additional pre-existing Certificates of Occupancy from November 4, 2009 for the single family dwelling and accessory structures. A Certificate of Occupancy issued on September 28, 1992 for an addition to the single family dwelling, a Certificate of Occupancy dated November 4, 2009 was issued for a ramp addition and a Certificate of Occupancy was issued for an in ground pool dated March 10, 2016. Presently, there are building permits from the Town of Southold Building Department dated February 21, 2017 for additions and alterations to the dwelling and an accessory building. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 7, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance(s)will not produce an undesirable change in the character'of the neighborhood or a detriment to the nearby properties. The neighborhood consists of single-family waterfront homes. The existing dwelling was built prior to zoning and, therefore, did not have to meet current conforming side yard setbacks. The proposed renovation to reside and reroof the existing accessory pool house will not extend or change the existing 4.4 feet side yard setback. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Because of the pre-existing nonconforming location of the accessory structure, all proposed alterations and additions will require variance relief for a side yard setback. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 70.6% relief from the code. However, the applicant is proposing to maintain all existing setbacks which were established when the structure was originally built. Additionally, the ZBA granted a side yard setback for the principal dwelling of 3.4 feet in File#6926 (July 21,2016). 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a renovated pool house while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3, December 21, 2017 #7112,Kearns SCTM no. 1000-51-1-8 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Goehringer, and duly carried,to GRANT the variance/variances as applied for, and shown on the architectural drawings prepared by Robert R. Brown,Architect,P.C., and dated July 10, 2017. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The accessory building(pool house)shall not be used for habitation. 2. Storm water runoff and drainage plans must be upheld as detailed on the site plan prepared by Robert I Brown, Architect dated July 10, 2017 to include the installation of a new 4" cast iron drain pipe sloped at 1/4 (one-quarter)feet from the pool house to the mudroom to the ejector pump in the existing basement. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. Disturbance to the natural vegetation or topography seaward of the crest(top) of the bluff or hill must be restricted to an 8-foot wide area, including the width of the stairway, as shown on the approved plans. 12. Long-term Plant Survival The bluff face shall be planted with as per plan specifications and the permittee shall ensure a minimum of 85% survival of plantings by the end of five growing seasons.
