PUVA Town Clerk Applicants/Owners: Gian Mangieri Property Location: 2050 NYS Route 25,Laurel,NY 11948 SCTM No. 1000'-I ~3 —z 3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further requirements under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 29, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD PLANNING BOARD: The application was referred to the Southold Town Planning Board for comments. In their November 15, 2017 memorandum, the Board indicated that they do not support the waiver of merger and gave reasons which included concerns with the creation of insufficient lot areas. Furthermore, the Board noted that the creation of a non-conforming lot is not consistent with the goals related to the Southold Town Comprehensive Plan. PROPERTY FACTS/DESCRIPTION: The applicant's property consists of a total (merged) area of 523,286 square feet or approximately 12.0130 acres consisting of agricultural lands and flagged wetlands located in the Agricultural Conservation (A-C)Zoning District. The property is made up of two parcels, recognized as SCTM #1000-125-3-2.3, consisting of approximately 504,117 square feet, and 1000-125-3-18, consisting of approximately 19,169 square feet. Lot 2.3 is improved with a single-family residence, several outbuildings and sheds, an agricultural storage building, five greenhouses, a horse barn and a stationary mobile home and contains over approximately 100,000 sq. ft. of underwater land and flagged wetlands. Lot 18 is unimproved - BASIS OF APPLICATION: Request for a Lot Waiver under Section 280-11 to unmerge a vacant land area of 19,169 square feet (CTM 125-3-18) from an adjacent land area of 504,117 square feet(CTM 125-3-2.3), based on the Building Inspector's Notice of Disapproval pursuant to Section 280-10A, determining the properties have been merged. Page 2, December 21, 2017 47109, Mangieri SCTM No. 1000-125-3-2.3 & 18 ADDITIONAL INFORMATION: The subject parcel is located in the Agricultural Conservation (A-C) Zoning District with development rights intact. Applicant's agent presented paid tax bills and a copy of deeds for each separate parcel along with a Title Search completed by Fidelity National Title, dated April 7, 2017, certifying that the subject properties have been in single and separate ownership in title since prior to April 1, 1957. Furthermore, Mr. Finnegan indicated that should the Waiver of Merger be approved, his client will accept as a `condition,' approval by the Town of Southold Planning Department for a proposed lot line change, to be applied for after the completion of the Waiver of Merger process. It is the applicant's desire to clear the way for a lot line change to reconfigure both parcels to conform to the Town's bulk schedule requirement of a minimum of 80,000 sq. ft. in area, and to construct one additional home on the southwest corner of Lot currently known as 2.3. In addition, a property 1 owner living directly across from the subject parcel on Main Road, submitted comments and appeared before the Board to ask questions to ensure that the waiver of merger would not have adverse environmental impacts to Brush's Creek and her own property. And that the subject property would continue to be farmed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 7, 2017, at which time written and oral evidence were presented. Pursuant to § 280-11 the Applicant has submitted documentation, to the satisfaction of the Board that these lots were merged consequent to the death of the owners. There have been no transfers of ownership outside the family since the time merger was effected. The single and separate search confirmed that Mario and Louise Mangieri came into title to Lot 18 on June 21, 1994 by way of a conveyance from Helen McCarthy, James McCarthy and George J. McCarthy, as distributes of the Estate of George A. McCarthy and Helen McCarthy, recorded in Liber 11689, Page 757. Less than six month later, Mario and Louise Mangieri conveyed Lot 18 to Gian Mangieri by Deed dated December 30, 1994, recorded in Liber 11712, Page 142. As such,there have been no transfers to an unrelated person or entity since the time the merger was affected. Pursuant to §280-11,the Zoning Board finds that (1) The waiver would recognize a lot that is comparable in size to a majority of the improved lots in the neighborhood. The stretch of the Main Road in Laurel where Lot 18 lies, is surrounded by larger farm parcels and some residential lots of equivalent size. The proposed waiver of merger would create a non-conforming 20,473 sq. ft. lot, which is about 25% of the code required square footage in the AC zone district. However, with the condition imposed herein, lot 18 and lot 2.3 will become two parcels that are entirely conforming to current bulk-schedule requirements I the AC zone district. (2) The waiver would recognize a lot that is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation because: As confirmed by the title certification from Fidelity dated April 7, 2017,Lot 18 can be traced back to December 29, 1945. Since that date, the Town has consistently treated the lot as single and separate. It still appears as a separate lot on the Suffolk County Tax Map, the Town of Southold property record card recognizes it as a separate lot, and it is assessed and taxed as a separate lot. (3) The proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district because: There will be no adverse impact on the physical and environmental conditions in the neighborhood or District. Unmerging Lot 18 from Lot 2.3 will simply enable Page 3, December 21, 2017 #7109, Mangieri SCTM No. 1000-125-3-2.3 & 18 the property owner to create two conforming lots within the A-C Zoning District. No development is contemplated on the existing Lot 18 prior to a lot line approval by the Town Planning Board. RESOLUTION OF THE BOARD: In considering and balancing the above factors and pursuant to the Waiver Provisions of the Town of Southold Merger Law, Section 280-11, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried to GRANT the waiver of merger as applied for and as shown on the survey by David L. Saskas, Licensed Land Surveyor, Saskas Surveying Company, P.C. dated December 15, 2004 and revised June 27, 2017 with the following condition: SUBJECT TO THE FOLLOWING CONDITION: 1) This waiver of merger is subject to approval by the Town of Southold Planning Board for a lot line change that will create two lots conforming to the bulk schedule in the Agricultural Conservation Zoning District within eighteen (18) months from the date of this decision. The applicant may,if necessary and prior to the date of expiration, request in writing,an extension for an additional twelve (12) months. Failure to comply with this condition will result in nullification of the waiver of lot merger granted herein. It is our understanding that the proposal would unmerge the two parcels referenced above, creating a non-conforming parcel, Lot 18, at 20,473 sq. ft. The creation of a nonconforming lot that is only one quarter of the minimum lot size permitted by zoning is not consistent with the Southold Town Code and the goals of the numerous plans which collectively comprise the Southold Town Comprehensive Plan. These plans consistently reflect goals to maintain a lower density of housing and preserve open space. Box 9398 Riverhead,NY 11901-9398 (631) 727-2180 Dated: December 7, 2017 j#���`� FACTUAL BACKGROUND The Applicant, Gian Mangieri, is seeking a waiver of merger of two parcels located on the Main Road in the Hamlet of Laurel, and identified as SCTM 441000-125-3-2.3 and 18. As depicted on the survey submitted, Lot 18 is a vacant, unimproved parcel in the A-C Zoning District comprised of approximately one-half acre. Lot 2.3 is an 11.5-acre parcel in the A-C Zoning District that is improved with a single-family residence, an agricultural storage building, five greenhouses and a horse barn. All existing structures are legally existing on the premises. The Development Rights for Lots 18 and 2.3 are intact. Prior to the Mangieris' ownership, the property was significantly exploited and disturbed by the prior owners' sand and gravel mining operation during the 1960s and 1970s. The parcel had not been actively farmed since 1959. Over the last 20 years, Mr. Mangieri has worked tirelessly to level the property and to restore the integrity of the soil and the viability of the pond, which runs through Lot 2.3. As it is today, Lot 2.3 is operating as Laurel Creek Landscaping Nurseries, a wholesale grower of large container hydrangeas. Lots 18 and 2.3 became inadvertently merged pursuant to Town Code §280-10 as of June 21, 1994 when they were conveyed to Mr. Mangieri's parents, Mario and Louise Mangieri. The only subsequent conveyance was to their son, Gian Mangieri, the Applicant herein, on December 30, 1994. Mr. Mangieri is seeking a waiver of merger to clear the way for a lot line modification application. As previously mentioned, the Development Rights on Lot 2.3 are intact and the property has the potential to be subdivided into three or four lots under current zoning. Mr. Mangieri would prefer not to develop the property. He does, however, need the ability to construct one additional home on the southeast corner of Lot 2.3. If the waiver of merger were ��4 granted, Mr. Mangieri will seek to move the western lot-line of Lot 18 to divide Lot 2.3 into two conforming parcels. ARGUMENT MANGIERI HAS SATISFIED THE CRITERIA FOR THE GRANTING OF A WAIVER OF MERGER UNDER§280-11 OF THE SOUTHOLD TOWN CODE With respect to a waiver of merger, §280-11 of the Town Code provides that: If a lot has merged pursuant to the provisions of§280-10, the Zoning Board of Appeals may waive the merger and recognize the original lot lines upon public hearing and finding that: A. The lot proposed to be recognized has not been transferred to an unrelated person or entity since the time the merger was effected. Here, the single and separate search provided confirms that Mario and Louise Mangieri came into title to Lot 18 on June 21, 1994 by way of a conveyance from Helen McCarthy, James McCarthy, and George J. McCarthy, as distributees of the Estate of George A. McCarthy and Helen McCarthy, recorded in Liber 11689, Page 757. Less than six months later, Mario and Louise Mangieri conveyed Lot 18 to Gian Mangieri by Deed dated December 30, 1994, recorded in Liber 11712, Page 142. As such, there have been no transfers to an unrelated person or entity since the time the merger was affected. Section 280-11(B) requires the Zoning Board of Appeals to balance the following factors: 1. Whether the proposed waiver would recognize a lot that is comparable in size to,a majority of the improved lots in the neighborhood. The stretch of the Main Road in Laurel where Lot 18 lies is surrounded substantially by larger farm parcels. The residential parcels in the vicinity are, however, consistent in size with Lot 18. Specifically, the adjacent parcel, SCTM#1000-125-3-3 is comparable in size. It is noteworthy that the Applicant's goal is to create two parcels that are entirely conforming to current bulk-schedule requirements. 2. Whether the lot proposed to be recognized is vacant and has historically been treated and maintained as a separate and independent residential lot since the date of its original creation. As confirmed by the title certification from Fidelity dated April 7, 2017, Lot 18 can be traced back to December 29, 1945. Since that date, the Town has consistently treated the lot as single and separate. It still appears as a separate lot on the Suffolk County Tax Map, the property record card recognizes it as a separate lot, and it is assessed and taxed as a separate lot. 3. Whether the proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or District. There will be no adverse impact on the physical and environmental conditions in the neighborhood or District. Unmerging Lot 18 from Lot 2.3 will simply enable the property owner to create two conforming lots within the A-C Zoning District. Request Delay to Gauge Potential Impact The letter from the petitioner's attorney,which contained the hearing notice and lot plan map, was dated Nov. 20, 2017. As stated in the hearing notice, lot#1000-125-3-2-18 merged with lot#125-3-2.3 as a result of 6 r the Building Inspector's July 6,2017 Notice of Disapproval.A history outlined on a section of the survey map seems to indicate that"proposed lot lines" dated "June 27, 2017" may have been what drew the "disapproval"from the inspector.So I hope during this hearing light will be shed on what precisely prompted that"disapproval." With such information, I will be better able, if the board will allow a continuance of the hearing, to study and discuss with neighbors the potential impact of the requested "unmerging." Need More Time to Evaluate Initial Concerns No one wants a neighbor to struggle to conform with unnecessary and arbitrary regulations or enforcement. But the Agricultural Conservation (AC) District Zoning aim is to preserve as much as reasonably possible our town's agricultural and low-density residential character,a worthy mission indeed.Yet, regrettably,sometimes well-meant rules impose needless hardship on local farmers whose survival is AC zoning's declared aim. My initial reaction to the waiver application is to support the Building Inspector issuing the Notice of Disapproval because I believe in the mission assigned to AC zoning. I am concerned that waiving the merger of the lots imposed by the inspector enforcing the AC zoning statute would undermine efforts to retain our town's agricultural and low-density residential character. Overturning the inspector's finding should not even be considered unless the particular code enforcement is clearly shown as running contrary to the stated purpose of the code. I believe the immediate community potentially impacted should have more time to get more information (a)on the history and particulars of lots involved, (b)on existing and any proposed structures and infrastructure, (c)on the opportunities of the petitioner had to bring the non- i conforming lot into compliance,and (d) on what"bulk" and other specifics prompted the Notice of Disapproval.
