Dear Mr. Bohner:
The Southold Town Board of Trustees reviewed the survey prepared by Harold F.
Tranchon, Jr., P.C. dated November 30, 2017and determined that the proposed
construction of a one-story dwelling, garage and driveway is out of the Wetland
jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town
Code, but not that the section of the wildlife fence south of ribbon 3 which falls within
100 feet of the wetlands.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required.
Please be advised, however, that no clearing, no removal of vegetation, no cut or
fill of land or removal of sod, no construction, sedimentation, or disturbance of
any kind may take place within 100' landward from the top of the bluff, or seaward
of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the
coastal erosion hazard area as indicated above, without further application to,
and written authorization from, the Southold Town Board of Trustees pursuant to
Chapter 275 and/or Chapter 111 of the Town Code.
It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result
from your project. Such precautions may include maintaining adequate work area

between the tidal wetland jurisdictional boundary and the coastal erosion hazard area
and your project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

suggested wildlife fence.
Enclosed is a check payable to the town of Southold in the amount of$50.00. 1 hereby give the trustees
permission to enter property at anytime if need be. I hereby authorize George Fredricks to act on my
behalf and receive the letter of non jurisdiction for this property.

To whom it may concern,
We are requesting that a pre-submission Inspection by done on this property for the purposes of
receiving a determination that the building of an approximate 1,500 sq.ft. single family home and
driveway on the lot is acceptable by the Board of Trustees on this property. It abuts water wetlands to
the south of the property. I understand that the NY D.E.C. may also be required to additionally make
such an assessment and for which this letter is extended in all matters to the NY D.E.C. as well.
I understand that a person needs to meet at the property for which I was informed would be scheduled
for November 8th-the "next available Date". My representative, George Fredericks cell phone number
631-553-3198 will be available to meet you then.
Let this letter be evidence that I fully extend to the Trustees and/or D.E.C. permission to enter the
property for these purposes.
Ultimately, our request is for a receipt of non-jurisdiction letter or permit to allow us to proceed with
the building of a single family home on the property and/or notification on any actions that are
recommended for us to accomplish the same. For that purpose, I have included a marked copy of a
survey, a Suffolk County tax map highlighting the wetlands and scaled drawing of the builder's house
plans intended for use.These plans will be submitted once receipt of the D.E.C. and a Suffolk County
Health Department letter of acceptance is received.
