Based on site conditions and the owners requests we would like to make a few amendments to our site plan. When I was completing the construction drawings for the residence, I kept the house,terrace and 2nd floor deck within the Trustee approved footprint. This resulted in a smaller house footprint(which I believe has less impact),but is at variance with the approved plan. When I was completing the construction drawings for the residence,I'kept the house,terrace and 2°a floor deck within the Trustee approved footprint. This resulted in a smaller house footprint(which I believe has less impact),but is at variance with the approved plan. Existing House Conditions("As-Built"): Construct a new two-story single family 1,912 sq.ft. dwelling(2600 sq. ft. approved)with 522 sq.ft. attached garage(770 sq.ft. approved), 104 sq.ft. covered terrace(w/2°a floor 82 sq.ft. deck above), 30 sq.ft. covered entry and 385 sq.ft. open terrace for a total building and terrace area footprint of 2953 sq.ft. (3370 sq.ft. approved). Remove existing patio and concrete path on water side of house. Include north&east terrace steps to grade. Proposed Amendments: 1- Construct a patio of loose laid bluestone pavers in grade on a raised level in front of the terrace on the east side(water side)of the house. Based on the height of the first floor(El+11')which was elevated for flood conformance,there would be a significant drop to return to existing grade (El+5'). The"owner would like to add this patio (20'x28"+/-) at an intermediate level(E1+8.5")to provide a useable area that would form a transition between'the finished floor of the house and the existing grade.A low stone wall and informal"boulders"&plantings would be installed to stabilize the grade transition. An additional 100 cy. of fill and 100 cy. of topsoil will be brought in to establish revised grades. The 20' wide non-turf buffer would of course be maintained. 2- Construct an outdoor shower against the north side of the house with a privacy fence as shown on the attached site plan. 3- Eliminate the retaining wall that was added around the sanitary system in the renewal application. The sanitary system has been installed, inspected and approved by the Suffolk County Department of Health without the requirement of a retaining wall. In reviewing the installed leaching pool heights (top of slab cover El+5'-7" and top of precast leaching pool ring El+5'-2")there is virtually no difference between that height and the existing surrounding grades (northwest property corner El+5.1' and southwest property corner El+5.1'). While a retaining wall could be built, on a practical basis it would not retain any outflow from the sanitary system and would be a significant expense to the owner. 4- Miscellaneous: Include(2)raised pads for AC units and a front walk. Amelia Murphy 230 Inlet Lane, Greenport NY Re: Objection to Proposed Amendments to the Wetland Permit #9118 for Tax Parcel 43-5-5 Summary: We have owned our house at 230 Inlet Lane since 1994, and are immediately adjacent to the new construction at 160 Inlet Lane. Accordingly, we are submitting this written statement to formally register our objection to the request to amend wetland permit #9118 The Town has a clearly articulated wetland policy, with detailed requirements and restrictions to meet its goals. (The language is attached.) We feel strongly that it should be applied uniformly and consistently throughout the Town. The only way the Town can achieve the goals of this policy if it is applied consistently - and there is no compelling reason to provide this variance. We formally object to the proposed amendment to the existing Wetland Permit for this property, which if approved would allow significant construction within the wetland setback, drastically altering the natural condition of the property, and detrimentally impacting the neighboring properties, and be counter to the objectives of the Town's Wetland § 275-3 code. Findings: purpose jurisdiction; and setbacks. 1) In 2012 we requested an extension of our existing patio - by 4'6", at an elevation of approximately 18" above the natural grade to slightly expand the existing patio built with the structure in the 1950's. We hired and incurred the expense of a professorial surveyor, who concluded that our proposed extension would be beyond the 100' setback required for wetland abutting properties. Subsequently, despite the professional survey, the Southold Board of Trustees walked the property and made an independent determination that the property setback as measured by the professional surveyor, Peconic Surveyors, was incorrect, and that an extension would marginally infringe upon the 100-foot setback - and our application was denied. 2) The current waiver request for 160 Inlet Lane provides for an addition of a large patio significantly encroaching into the 100-foot setback requirement. Further it is raised significantly above the natural contours of the property. (Approximately 5 feet). No other parcel of land along the entire waterfront strip from Gull Pond to Young's Point Jetty has been altered/disturbed from its natural contour. With the exception of this alteration, the topography of the waterfront along this entire strip retains its natural aesthetic which the wetland guidelines were put in place to protect. Memorandum 3) Was an environmental impact review required to change the contours of land abutting protected wetlands in such a dramatic fashion? This proposed change will alter storm water runoff and drainage in undetermined and unpredictable ways. 4) While it's our understanding that this hearing is for consideration of the requested waiver, much of the work has already been completed. Fill has already been distributed and the property has already been re-graded and primed for'installation of this expanded 18'-28' patio with an elevated base and the walk way removed. Is construction allowed for alterations that are subject to amendment - before approval of such is granted? Further it appears that proposed patio comes within 45 +/- feet of the wetland line, dramatically within the setback requirements. 5) We recognize that the proposal includes the addition of one or more dry wells, but in an area where the natural water table is approximately 2 1/2 feet from the surface, how effective can a dry well really be? 6) Beyond the encroachment into the required setback, the proposal (and action to date at the property) dramatically alters the property to the sole benefit of the applicant, while detrimentally impacting his neighbors and the environment. The reality is that water will run off to each of the adjacent properties, as well as towards and into the wetlands that are supposed to be protected by the setback requirements and there is no reason to believe that one or more strategically placed dry wells in am extremely shallow water table environment will appropriately address this concern or properly protect the environment. 7) The addition of the AC pads and the outdoor shower appear to be encroaching upon the required set backs to our property, which given the original foot print of the demolished property do not comply with existing setback requirements. Certainly with the construction of this project, AC installation was anticipated, and we object to any waiver of locating these pads or the outdoor shower if either are beyond the current code setback required. This was 100% new construction, and these considerations could have easily been incorporated into the design, which appears to maximize the building footprint by conforming to the original footprint - which are exempt from current requirements. If AC units and an outdoor shower were anticipated, the footprint could have been adjusted to provide compliance. Memorandum "Wetlands Law of the Town of Southold." § 275-3 Findings; purpose; jurisdiction; setbacks. A. Findings. The Town Board of the Town of Southold finds that rapid growth, the spread of development and increasing demands upon natural resources are encroaching upon or eliminating many of its wetlands and patent lands, which, if preserved and maintained in an undisturbed and natural condition, constitute important physical, social, aesthetic, recreational and economic assets to existing and future residents of the Town of Southold. In addition, there has been a significant increase in the applications for and the numbers of fixed and floating piers and docks accessory to upland residential and other uses. Most of these structures and the uses they support are on and in publicly owned land and waters and always have some effect on physical, biological, ecosystem functions and values, development patterns and the aesthetic character of the area. Therefore, it is essential to regulate the type and placement of such structures. B. Purpose. It is the intention of this chapter to ensure for the citizens of the Town of Southold the protection, preservation, proper maintenance and use of its wetlands, giving due consideration to the reasonable economic and social development of the Town. In addition, the Town Board declares that it is the intention of this chapter to regulate the type and placement of fixed and floating piers and docks for the protection, preservation, proper maintenance and use of its waters and wetlands. Therefore, the Town Board declares that the regulation of the wetlands of the Town of Southold is essential to the health,safety and welfare of the people of the Town of Southold. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policy standards and therefore is CONSISTENT with the LWRP provided the Board considers the following: Due*to the proximity of the dwelling to ground and surface waters (Note that the surface water body shows'evidence of high nutrient loading due to the amount of floating vegetation due to poor flushing). It is recommended that the Board consider requiring the following conditions on the parcel to further Policy 5 and Policy 6 and protect water quality: 1. Chapter 268 of the Southold Town Code defines a landscape buffer as: LANDSCAPED BUFFER-A land area of a certain length and width which is planted with indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover within two years of installation. Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation-and establishing a four-foot-wide access path constructed of pervious material for access to the water body.
