Ha3e, The following action was taken by the Board of Town Trustees during its regular meeting held on Februar~ 28, 1996, regarding the above matter: WHEREAS, Eh-COnSUltants Inc., on behalf of ROBBERT MORRISSEY, applied to the Southotd Town Trustees for a permit under the provisions of the Wetland Ordinance of the To%rn of Southotd, application dated February 5, 1996, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommeBS~tionsr and WHEREAS, ~ Public Hearing was held by the Town Trustees with respect to said application on February 28, 1996, at which time all interested persons were given an opportun%t!rto be heard. Wn~AS, the Board members have personally viewed and are familiar with the premises in guestion and the surrounding area, and, WHEREAS, the Board has considered all the testimonlrand documentation sutmnitted concerning this application, end. WHEREAS, the structure complies with the standard set forth.in Chapter 97-18 of the Southold Tow~ Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safet~ and general welfare of the people of the town, NOW THEREFORE BE IT. RESOLVED, that the Board of Trustees approves the application of ROBERT MORRISSEY to remove and replace 139 1.f. of bulkhead in same location and. configuLration an~ ad~ two ~' retLurns. Dredge up to 10-feet off bulkhead to maximum depth of 4' below ALW. Resultant spoil will be used for hack~ill, approx. 30 c.y., with condition applicant place a 20' non-turf/non-fertilized k~ifer landward of bulkhead. Located: 265 Elizabeth Lane, Southold. SCTM ~78-5-5 Permit to construct pro~ect will expire two years fro~ the date it is signed if not started. New York 11971 CONSERVATION ADVISORY COUNCIL At a meeting of the Southold Town Conservation Advisory Council held Monday, February 26. 1996 the following recommendation was made: No. ~ 323 Moved by Allan Connell, seconded by John Hagerty, it was RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL ¥/ITH CONDITIONS of the Wetland Application of ROBERT MORRISSEY 78-5-5 to: remove and replace 139 I.f. bulkhead in same location and configuration; add two (2) returns; dredge up to 10 feet off bulkhead to maximum depth of below ALW. Resultant spoil will be used for backfill. The CAC recommends approval with the condition that a 20' non-turf buffer be maintained. 265 Elizabeth Lane.
