Dear Mr. Mooney,
The following action was taken by the Board of Town Trustees
during its regular meeting held on February 28, 1996, regarding
the above matter:
WHEREAS, DANIEL MOONEY, applied to the Southotd Town
Trustees for a permit under the previsions of the Wetland
Ordinance of the Tow~ of Southeld, application dated November
15, 1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council fer their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect te said application on Februarlr 28, 1996, at which time
a-ll interested persons were given an opportun%ty to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, an~,
WHEREAS, the structure cummties with the standard set forth in
Chapter 97-18 of the Southotd Town Code,
WHEREAS, the Board has determined that the pro~ect as proposed
will not affect the health, safety and general welfare o~ the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board oE Trustees approves the application of
DANIEL MOONEY to move an existing house at 480 Rabbit Lane,
(from Bay side) to across the street (on Lake side) property/
with condition that cesspools (on Bay side) be puaL~e~ and capped
and no loose debris be left on property (Bay side). Located:
480 Rabbit Lane, East Marion. SCT~
Permit to construct project will expire two years Erom the date
it is signed if not started. Fees must be paid, if applicable,
and permit issued within six months of the date cf this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

Dear Mr. Reynolds:
As you know the Board of Trustees is currently reviewing the
above referenced application to move the existing house from one
lot to another.
The applicant plans to leave the current septic system and
foundation at lot 9 until such time as he applies to rebuild at
that location.
The Board would like the Health Departments opinion on leaving a
septic system in place on a vacant lot for an unknown length of
time?
By copy of this letter, we ask the opinion of the DEC in this
matter.

Dear Madame/Sir,
Yon may recall that at the last meeting of the Board of Trustees I appeared in support of my
application to move the house located at 480 Rabbit Lane, diagonally across Rabbit Lane, onto a lot
owned by me.
At that hearing I suggested to the Board that the foundation of the house would be enclosed
in an earthen berm. I have since decided not to pursue an earthen berm. However, I am enclosing
herewith 2 copies of a smwey from Van Tuyl Surveyors which shows the decks on the current house
which will be moved onto the pared on the north side of Rabbit Lane.
In addition, with respect to the application of my wife and I to move the house from
480 Rabbit Lane, please be advised that until such time as we complete the plans for a new home,
that the septie s~stem will be properly capped until such time as I obtain a building permit and
commence construction of the new home at 480 Rabbit Lane.
I intend to appear at the hearing on Thursday, and if you have any further questions I will
be happy to answer them.
