A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Capitol One Bank Building, First Floor Conference Room, 54375 Main Road at Youngs Avenue, Southold on Thursday, November 16, 2017 commencing at 4:00 P.M. Present were: Leslie Kanes Weisman, Chairperson/Member Gerard P. Goehringer, Member Patricia Acampora, Member Nick Planamento, Member Eric Dantes, Member William Duffy, Town Attorney Kim Fuentes, Zoning Board Assistant Call to Order at 4:18 P.M. by Chairperson Weisman. TRAINING Case Law Update presented by William Duffy, Town Attorney 4:52 p.m. Motion was offered by Chairperson Weisman, seconded by Member Goehringer to enter into Executive Session for Attorney/Client advice. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Dantes was absent. EXECUTIVE SESSION: Attorney/Client advice. Page 2—Minutes Special Meeting held November 16, 2017 Southold Town Zoning Board of Appeals 5:31 p.m. Motion was offered by Chairperson Weisman, seconded by Member Goehringer to exit Executive Session.Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). WORK SESSION: a) Requests from Board Members for future agenda items. b) Special Exception Templates. POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARINGS: MATTITUCK 2012. LLC#7098 —Request for Variances under Article IX, Section 280- 42A and the Building Inspector's January 11, 2016, Amended March 30, 2016 and June 19, 2017 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling with a business office; at: 1) less than the code required minimum rear yard setback of 75 feet; 2) less than the code required minimum side yard setback of 20 feet; 3) less than the code required total side yard setback of 45 feet; at: 36570 NYS Route 25, Cutchogue, NY, SCTM#1000-97-3-2. BOARD RESOLUTION: Motion was offered by Chairperson Weisman, seconded by Member Acampora to close the hearing reserving decision. Vote of the Board:Ayes: All. This Resolution was duly adopted (4-0). DILIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with agenda items, and commenced deliberations on the following application. DALEY and DIANE L. DALEY#7099 APPROVED AS APPLIED WITH CONDITIONS: MATTITUCK 2012, LLC#7098 55500 MAIN ROAD. LLC—ERIC and SUSAN RUSSELL#7100 SEBASTIAN HEATH and SARAH BURNES#7105 JOHN WICKHAM#7101 Page 3—Minutes Special Meeting held November 16, 2017 Southold Town Zoning Board of Appeals Vote of the Board:Ayes:All. This Resolution was duly adopted (5-0). RESOLUTIONS: A. RESOLUTION ADOPTED: Motion offered by Chairperson Weisman, seconded by Member Goehringer to authorize advertising of hearings for the next Regular Meeting to be held December 7, 2017 at 8:30 AM.Vote of the Board:Ayes:All. This Resolution was duly adopted(5-0). B. RESOLUTION ADOPTED:Motion was offered by Chairperson Weisman, seconded by Member Planamento to approve minutes from November 2, 2017, Regular Meeting. Vote of the Board:Ayes:All. This Resolution was duly adopted(5-0). C. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Goehringer to declare the Zoning Board of Appeals as Lead Agency for Special Exception Petition of the Enclaves Hotel and Restaurant and issued a Positive Declaration.Vote of the Board:Ayes:All. This Resolution was duly adopted(5-0). There being no other business properly coming before the Board at this time, Member Dantes declared the meeting adjourned.
