Dear Mr. Domino:
Please find enclosed an application for an Administrative Wetlands Permit to construct a new
+100' vinyl bulkhead and +32' vinyl return in place of an existing timber bulkhead and return;
remove and replace (in-kind/in-place) an existing 8' x 12' on-grade deck landward of the
bulkhead; and establish a 15' wide non-turf buffer adjacent to the new bulkhead.
We are requesting an Administrative Wetlands Permit because the existing bulkhead and deck
are permitted structures pursuant to Trustees Permit No. 4240 and 4687, respectively; and
Section 275-5(B)(2)(1) and Section 275-5(B)(2)(i), respectively, allow for an Administrative
Wetlands Permit to be issued for "decks" and for "the construction of a permitted bulkhead, as
per §275-11, which is to replace an existing functional bulkhead, subject to the following:
[That the new bulkhead is constructed substantially similar to the design and measurement of
the existing bulkhead; [ The new bulkhead is in the same location as the existing bulkhead;
and LN Any such operations shall require the addition of a nonturf pervious buffer area."
Consistent with these requirements, the new vinyl bulkhead will be constructed in the same
location as the existing bulkhead and up to 12 inches higher to match the elevation of the
adjoining bulkhead to the west; and a 15' non-turf buffer is proposed to match the 15' non-turf
buffer required for the adjacent property to the west pursuant to Administrative Wetlands Permit
No. 8868A, issued on August 22, 2016.

Contravention of this/these Article(s) of the ECL is a violation and/or a misdemeanor punishable by a
fine of no more than $10-15,000/a day. Penalties may be assessed for each day that the violation continues.

Dear Mr. Costello:
The following action was taken by the Board of Town Trustees
during its regular meeting held on December 18, 1996 regarding
the above matter:
WHEREAS, Costello Marine on behalf of DR. FRANK MONTELEONE
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated November 13, 1996, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on December 18, 1996, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed_
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
cover existing concrete porch and steps with timber decking.
Square off porch by adding 8' X 25' timber deck. Install two
sets of timber access stairs. Also 8' X 12' deck landward of
