II. Board and Office Policies, Practices, and Activities:
Com etion of ZBA Re aired Annual Training for 2017
Can November 2, 2017 the Board :Members met with ZBA planning consultant Carrie
O'Farrell of NPI who provided an overview of the present regulations and
procedures required by SEQRA, and the ZBA's obligations thereunder, as prescribed
by o NYCRR Part 617 State Environmental Quality Review (SEAR) and the New
York State Environmental Conservation law §§3-0301(1)(b), 3-302(2)(m) and 8-
0113. She also explained to the Board how to evaluate and apply the
recommendations of the ZBA's SEQRA consultants and Town Planning Department
in rendering decisions involving Special Exception Permits for commercial uses.
On November 10, 2017, Town Attorney Duffy provided the Board members with an.
overview and surnmary of legal determinations rendered by the various courts of New
York State involving appeals of decisions made by Zoning Boards that include
special exception permits, use variances, area variances, code interpretations, and
nonconforming uses. TA Duffy previously discussed NYS Agriculture and Markets
law with the Board (on September 21, 2017). Collectively, these work sessions
complete the Town Board approved four hours of required annual training for 2017.
Proposed Code Changes
Bed and Breafast Special, Exceplion Permits
On November 21, 2017 Board Members Mantes, Ctoebringer, Planmento and I met
with the Town Board at their work session to raise and discuss various issues and
concerns about current and future B&B operations in Southold Town. Topics
included locations, proof of required full time residency, transferability of a B&B
permit, identifying owner's private spaces and shared guest spaces, and compliance
by operators with a required annual inspection and permit renewal. A follow up
discussion.was scheduled for the Town Board work session on December 5, 20170

Also, on November 21, 2017 the ZBA and TA Duffy discussed proposed changes to
the time (tame currently required by code in which to implement the use granted
through a special exception pen-nit approval (currently 6 months). The Board
presented specific language changes to the code which would give the ZBA the
flexibility to increase that time frame, as needed, so that property owners can obtain
necessary approvals from other agencies, such as site plan approval from the Planning
Board, prior to the expiration of the permit. This proposal was favorably received by
the Town Board and will be scheduled for a public hearing, The Board and I would
like to thank the Town Attorney for his prompt and expert guidance in this matter.
