COUNCILMAN GHOSIO: NOTICE IS HEREBY GIVEN WHEREAS, there has been
presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 29th
day of August, 2017, a Local Law entitled "A Local Law to consider amending Southold
Town Code Chapter 189 (Parking)" and
NOTICE IS HEREBY FURTHER GIVEN that the Town Board of the Town of Southold will
hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road,
Southold, New York, on the 26th day of September, 2017 at 7:31 p.m. at which time all
interested persons will be given an opportunity to be heard.
The proposed Local Law entitled, entitled "A Local Law to consider amending Southold
Town Code Chapter 189 (Parking)" reads as follows:

A Local Law entitled, entitled "A Local Law to consider amending Southold Town Code
Chapter 189 (Parking) to amend the dates that Town Parking Permits".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Chapter 189. Parking
Article L Parking at Beaches
189-3. Parking permits.
Parking permits for parking vehicles in the parking areas designated in § 189-2 of this article
shall be issued as follows:

A. Resident parking permit.
(1) A resident parking permit shall be issued by the Town Clerk or a person
designated by him to all persons who are qualified residents of the Town
of Southold. Persons applying for a resident parking permit shall be
requested to sign an application in affidavit form and submit for inspection
the following as proof of residence:

No. 11-1987]
(a) A valid tax receipt stub for the current year for any taxable real
property within the Town of Southold assessed in the name of the
applicant.
(b) A valid motor vehicle registration in the name of the applicant and
to an address located within the Town of Southold or to an address
corresponding to the address of a validated tax receipt stub for the
current tax year for any taxable real property within the Town of
Southold affixed to the application.
(c) Such other proof of residence as is satisfactory to the Town Clerk.
(2) The Town Clerk or a person designated by the Town Clerk shall inspect
such application to determine that the applicant is a qualified resident of
the Town. Upon approval of the application, a resident parking permit
shall be issued and inscribed with the vehicle license registration number.
Such permit shall not be transferred to any other vehicle. [Amended
3-25-1975 by L.L. No. 1-1975; 12-28-1984 by L.L. No. 10-1984]
(3) Resident parking permits for motor vehicles shall be permanently affixed
to the right side of the front bumper of such vehicle and shall be valid for
the vehicle and an attached trailer. [Amended 5-9-1972; 10-18-1994 by
L.L. No. 21-1994]
(4) A Resident Parking Permit shall be valid for two years. The first two (2)
year permit period shall commence January 1, 2018 and terminate on
December 31, 2019. Thereafter, a new two (2)year permit period shall
commence on January 1 st of every even-numbered year.
(4)(5) The fee for the residential parking permit period, or any part thereof,

prescribed by resolution of the Southold Town Board.
II. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
III. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
I have an affidavit here, signed and notarized, that this has been noticed in the Suffolk Times and
also in the Town Clerk's office and on the bulletin board. That is it.

SUPERVISOR RUSSELL: Would anybody like to address the Town Board on this particular
local law?
ROBERT DUNN: Robert Dunn, Peconic. I just have two questions on it. That's Dunn with no
e, everybody. Someone slipped one in a month ago. The residential parking permit A, is one
and then A, B and C. The first section, that's a choice, correct? In other words you have got to
provide either a tax receipt or a valid motor vehicle registration or such other proof that is
satisfactory to the Town Clerk?
SUPERVISOR RUSSELL: Yes.
MR. DUNN: Or.
SUPERVISOR RUSSELL: Yes, it provides a variety of options for the Town Clerk's office to
evaluate and determine...
MR. DUNN: I just wanted to be clear on that, because some of it would be a hassle. It would
seem to me that the information, a valid tax receipt, that should be available but if it's any one of
those three, then I am fine with that. The second question is I've always gotten one for my
daughter, am I still going to be allowed to do that? How does that work?
SUPERVISOR RUSSELL: Is the car registered in your name?
MR. DUNN: No, it's her car.
TOWN CLERK NEVILLE: Does she live with you? Does she live in the Town of Southold in
your residence?
MR. DUNN: She has a bedroom but she doesn't live here, no.
TOWN CLERK NEVILLE: Okay, then it has to be a guest permit for her.
MR. DUNN: Oh, I paid more. I mean, it cost me where mine was $10 or $15, hers was $40.
SUPERVISOR RUSSELL: Yes.
MR. DUNN: And I am fine with that.
TOWN CLERK NEVILLE: Then it would not be a two year permit.
MR. DUNN: Okay.
TOWN CLERK NEVILLE: The lessee or the guest, hotel-motel are still going to remain one
year. it is only going to be the resident.
MR. DUNN: And I will just again, pay the appropriate amount.

SUPERVISOR RUSSELL: Same process.
MR. DUNN: Okay, that's fine. She brings baby seats and it's just easier.
SUPERVISOR RUSSELL: There is a discussion in raising fees, in this particular instance, I
know there was a proposal by Councilwoman Doherty to raise it from $10 to $15. The Board
felt that, you know, it's an expensive proposition maintaining beaches but our first goal should
be to try to reduce costs before we start increasing fees. There is a schedule of fees that we are
looking at for guest permits and all that. We will do that by resolution at a future date.
MR. DUNN: I don't have a problem with raising fees.
SUPERVISOR RUSSELL: Good.
MR. DUNN: I think it's really kind of...
SUPERVISOR RUSSELL: Let me take a look at what I was going to propose.
MR. DUNN: You can repeat me on that one.
SUPERVISOR RUSSELL: Would anyone else like to address the Town Board on this particular

Article I. Parking at Beaches
§ 189-3. Parking permits.
Parking permits for parking vehicles in the parking areas designated in § 189-2 of this article shall be issued as
follows:
A. Resident parking permit.
(1) A resident parking permit shall be issued by the Town Clerk or a person
designated by him to all persons who are qualified residents of the Town
of Southold. Persons applying for a resident parking permit shall be
requested to sign an application in affidavit form and submit for inspection
the following as proof of residence:

(2) The Town Clerk or a person designated by the Town Clerk shall inspect
such application to determine that the applicant is a qualified resident of
the Town. Upon approval of the application, a resident parking permit
shall be issued and inscribed with the vehicle license registration number.

"PARKING"
THE PROPOSED LOCAL LAW FOR WHICH A PUBLIC HEARING IS BEING HELD THIS
EVENING PROPOSES TO AMEND CHAPTER 189 "PARKING" OF THE TOWN CODE.
SPECIFICALLY, IF ADOPTED, THE LOCAL LAW WOULD AMEND SECTION 189-3 OF
THE TOWN CODE BY CHANGING TERM FOR RESIDENTIAL PARKING PERMITS
FROM 1 YEAR TO 2 YEARS, EFFECTIVE JANUARY 2018. THE FEE FOR THE PARKING
PERMIT WILL CONTINUE TO BE SET BYTHE TOWN BOARD BY RESOLUTION.

of Southold. Persons applying for a resident parking permit shall be
requested to sign an application in affidavit form and submit for inspection
the following as proof of residence:

(a) A valid tax receipt stub for the current year for any taxable real
property within the Town of Southold assessed in the name of the
applicant.
(b) A valid motor vehicle registration in the name of the applicant and
to an address located within the Town of Southold or to an address
corresponding to the address of a validated tax receipt stub for the
current tax year for any taxable real property within the Town of
Southold affixed to the application.
(c) Such other proof of residence as is satisfactory to the Town Clerk.
(2) The Town Clerk or a person designated by the Town Clerk shall inspect
such application to determine that the applicant is a qualified resident of
the Town. Upon approval of the application, a resident parking permit
shall be issued and inscribed with the vehicle license registration number.
Such permit shall not be transferred to any other vehicle. [Amended
3-25-1975 by L.L. No. 1-1975; 12-28-1984 by L.L. No. 10-1984]
(3) Resident parking permits for motor vehicles shall be permanently affixed
to the right side of the front bumper of such vehicle and shall be valid for
the vehicle and an attached trailer. [Amended 5-9-1972; 10-18-1994 by
L.L.No. 21-1994]
(4) A Resident Parking Permit shall be valid for two years. The first two (2)
year permit-period shall commence January 1 2018 and terminate on
December 31 2019. Thereafter, a new two (2)year permit period shall
commence on January 1 st of every even-numbered year.
(4)(5) The fee for the residential parking permit period, or any part thereof,
resident par-king ,:mit shall be suef as shall be
prescribed by resolution of the Southold Town Board.
II. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid,the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
III. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
AUGUST 29, 2017:
WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 29th day of August, 2017, a Local Law entitled "A Local Law to
consider amending Southold Town Code Chapter 189 (Parking)" now, therefore, be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, on the
26th day of September, 2017 at 7:31 p.m. at which time all interested persons will be given an
opportunity to be heard.
The proposed Local Law entitled, entitled "A Local Law to consider amending Southold
Town Code Chapter 189 (Parking)" reads as follows:

A Local Law entitled, entitled "A Local Law to consider amending Southold Town Code
Chapter 189 (Parking) to amend the dates that Town Parking Permits".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Chapter 189. Parking
Article I. Parking at Beaches
§ 189-3. Parking permits.
Parking permits for parking vehicles in the parking areas designated in § 189-2 of this article
shall be issued as follows:
A. Resident parking permit.
(1) A resident parking permit shall be issued by the Town Clerk or a person
designated by him to all persons who are qualified residents of the Town
of Southold. Persons applying for a resident parking permit shall be
requested to sign an application in affidavit form and submit for inspection
the following as proof of residence:
